L.-33004/99 सी.जी.-डी.एल.-अ.-23062023-246772 xxxGIDHxxx CG-DL-E-23062023-246772 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2643] नई ददल्ली, िुििार, जनू 23, 2023/आषाढ़ 2, 1945 No. 2643] NEW DELHI, FRIDAY, JUNE 23, 2023/ASHADHA 2, 1945 सामाजजक न्याय और अजधकाररता मंत्रालय (सामाजजक न्याय और अजधकाररता जिभाग) अजधसचू ना नई ददल्ली, 23 जून, 2023 का.आ. 2763(अ).—सेिा या प्रसुजिधाओं या सहाजयदकयों के पररदान के जलए एक पहचान दस्ट्तािेज के रूप म ें आधार का उपयोग सरकारी पररदान प्रदियाओं का सरलीकरण करता है, पारदर्शिता और दक्षता लाता ह ै और फायदाग्राजहयों को सुजिधापूिवक और जनबावध रीजत म ें उनकी हकदाररयों को सीध े प्राप्त करन े में समथ व बनाता ह ै और आधार दकसी व्यजि की पहचान को साजबत करन े के जलए जिजभन्न दस्ट्तािेज प्रस्ट्तुत करने की आिश्यकता को समाप्त करता है; और, सामाजजक न्याय और अजधकाररता मंत्रालय, सामाजजक न्याय और अजधकाररता जिभाग, भारत सरकार, अनुसूजचत जाजत और अन्य के जलए पूिव मैररक छात्रिृजि का संचालन कर रहा ह ै (जजसे इसमें इसके पश्चात स्ट्कीम कहा गया ह)ै । केंद्रीय रूप से प्रायोजजत इस स्ट्कीम का उद्देश्य प्री-मैररक चरण में पढ़ रह े अपन े िाडों की जिक्षा के जलए अनुसूजचत जाजत और अन्य िंजचत श्रेणी से संबंजधत बच्चों के माता-जपता को जििीय सहायता के माध्यम से समथवन करना है जजससे उनकी भागीदारी में सुधार हो, ड्रॉप आउट की घटनाओं में - जििेष रूप से प्राथजमक से पूिव और प्राथजमक से माध्यजमक स्ट्तर तक पररितवन को - न्यूनतम दकया जाए, िे जिक्षा के पश्च-मैररक चरण में प्रगजत के बेहतर अिसर का प्रदिवन करते हैं.. जजसे राष्ट्रीय छात्रिृजि पोटवल (एनएसपी) और राज्यों/संघ राज्यक्षत्रे (जजसे इसमें इसके पश्चात कायावन्ियन अजभकरण कहा गया ह)ै के माध्यम से दियान्यजित दकया जाता है; 4000 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, स्ट्कीम के अधीन, स्ट्कीम और उसके अधीन जारी जिद्यमान ददिा जनदेि के अनुसार, कायावन्ियन अजभकरण द्वारा अनुसूजचत जाजत के छात्रों और अन्य (जजसे इसमें इसके पश्चात प्रसुजिधा कहा गया ह)ै को छात्रिृजि (जजसे इसमें इसके पश्चात फायदाग्राही कहा गया ह)ै दी जाती है; और, स्ट्कीम के कायावन्ियन में भारत की संजचत जनजध से उपगत दकया गया आिती व्यय सजममजलत है; अत:, अब, केंद्रीय सरकार, आधार (जििीय और अन्य सहाजयदकयों, प्रसुजिधाओं और सेिाओं का लजक्षत पररदान) अजधजनयम, 2016 (2016 का 18) (जजसे इसमें इसके उक्त अजधजनयम कहा गया ह)ै की धारा 7 के अनुसरण में, जनम्नजलजखत को अजधसूजचत करती है, अथावत्:- 1. (1) स्ट्कीम के अधीन फायदा प्राप्त करने के इच्छुक बालक को आधार संयाया होने का प्रमाण प्रस्ट्तुत करने या आधार प्रमाणीकरण से गुजरने की अपेक्षा होगी। (2) स्ट्कीम के अधीन फायदा प्राप्त करने के इच्छुक दकसी भी बालक, जजसके पास आधार संयाया नहीं ह ै या अभी तक आधार के जलए नामांदकत नहीं है, को रजजस्ट्रीकरण से पहले अपने माता-जपता या अजभभािकों की सहमजत के अधीन आधार नामांकन के जलए आिेदन करना होगा। स्ट्कीम के जलए परंतु िह उक्त अजधजनयम की धारा 3 के अनुसार आधार प्राप्त करने का हकदार हो और ऐसे बालक आधार प्राप्त करने के जलए आधार के जलए नामांदकत दकसी भी आधार नामांकन केंद्र (भारतीय जिजिि पहचान प्राजधकरण (यूआईडीएआई) की िेबसाइट www.uidai.gov.in पर उपलब्ध सूची) पर जाएं। (3) आधार (नामांकन और अद्यतन) जिजनयम, 2016 के जिजनयम 12 के अनुसार, मंत्रालय/जिभाग को अपनी कायावन्ियन अजभकरण के माध्यम से उन फायदाग्राजहयों के जलए आधार नामांकन सुजिधाएं प्रदान करना अपेजक्षत है जो अभी तक आधार के जलए नामांदकत नहीं ह ैं और यदद संबंजधत ब्लॉक या तालुका या तहसील में कोई आधार नामांकन केंद्र जस्ट्थत नहीं है, मंत्रालय/जिभाग अपनी कायावन्ियन अजभकरण के माध्यम से यूआईडीएआई के जिद्यमान रजजस्ट्रार के समन्िय से या स्ट्ियं यूआईडीएआई रजजस्ट्रार बनकर सुजिधाजनक स्ट्थानों पर आधार नामांकन सुजिधाएं प्रदान करेगा: परंतु दक जब तक व्यजि को आधार नहीं ददया जाता है, तब तक स्ट्कीम के अधीन फायदा ऐसे व्यजक्तयों को ददया जाएगा, जो जनम्नजलजखत दस्ट्तािेजों के उ्पादन के अधीन हैं, अथावत्:- (क) (i) यदद फायदाग्राही को पांच िषव की आयु के बाद (बायोमेररक संग्रह के साथ) नामांदकत दकया गया था, तो उसकी आधार नामांकन पहचान पची, या बायो-मेररक अपडेट पहचान पची, या; (ii) फायदाग्राही द्वारा आधार नामांकन के जलए दकए गए अनुरोध की एक प्रजत; और (ख) फायदाग्राही के जनम्नजलजखत पहचान दस्ट्तािेजों में से कोई एक, अथावत्: (i) जन्म प्रमाणपत्र; या उपयुक्त अजधकारी द्वारा जारी जन्म का ररकॉडव; या (ii) माता-जपता के नाम िाले स्ट्कूल के प्रधानाचायव द्वारा जिजधित हस्ट्ताक्षररत स्ट्कूल पहचान पत्र; और (ग) जिद्यमान स्ट्कीम ददिाजनदेिों के अनुसार माता-जपता या जिजधक अजभभािक के साथ फायदाग्राही के संबंध के प्रमाण के रूप में जनम्नजलजखत दस्ट्तािेजों में से कोई एक: (i) जन्म प्रमाणपत्र; या उपयुक्त प्राजधकारी द्वारा जारी जन्म का ररकॉडव; या (ii) रािन काडव, या (iii) भूतपूिव सैजनक अंिदायी स्ट्िास्ट््य स्ट्कीम (ईसीएचएस) काडव; या कमवचारी राज्य बीमा जनगम (ईएसआईसी) काडव; या केंद्रीय सरकार स्ट्िास्ट््य स्ट्कीम (सीजीएचएस) काडव; या (iv) पेंिन काडव, या (v) सेना कैंटीन काडव; या (vi) कोई भी सरकारी पररिार पात्रता काडव; या (vii) मंत्रालय/जिभाग द्वारा जनर्ददि कोई अन्य दस्ट्तािेज:[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 परंतु यह और दक उपरोक्त दस्ट्तािेजों की जांच मंत्रालय/जिभाग द्वारा जििेष रूप से इस उद्देश्य के जलए नाजमत अजधकारी द्वारा की जाएगी। 2. स्ट्कीम के अधीन फायदाग्राजहयों को आसानी से फायदा प्रदान करने के जलए, मंत्रालय/जिभाग अपनी कायावन्ियन अजभकरण के माध्यम से यह सुजनजश्चत करने के जलए सभी अपेजक्षत व्यिस्ट्थाएं करेगा दक फायदाग्राजहयों को आधार की स्ट्कीम के अधीन अपेक्षा के बारे में जागरूक करने के जलए मीजडया के माध्यम से व्यापक प्रचार दकया जाएगा। 3. जहां फायदाग्राजहयों के खराब बायोमेररक्स के कारण या दकसी अन्य कारण से आधार प्रमाणीकरण जिफल हो जाता ह,ै जनम्नजलजखत उपचारा्मक तंत्र को अपनाया जाएगा, अथावत्: (क) खराब उंगजलयों के जनिान गुणििा के मामल े में, प्रमाणीकरण के जलए आईररस स्ट्कैन या चेहरा अजधप्रमाणन सुजिधा को अपनाया जाएगा, और जिभाग अपनी कायावन्ियन अजभकरण के माध्यम से आईररस स्ट्कैनर या चेहरा अजधप्रमाणन के साथ-साथ उंगजलयों के जनिान प्रमाणीकरण के जलए उपबंध करेगा जजससे जनबावध रूप से फायदा ददया जा सके। (ख) उंगजलयों के जनिान या आईररस स्ट्कैन या चेहरे के प्रमाणीकरण के माध्यम स े बायोमेररक प्रमाणीकरण सफल नहीं होने की जस्ट्थजत म,ें जहां भी संभि हो, यथाजस्ट्थजत, आधार िन टाइम पासिडव या टाइम-आधाररत िन-टाइम पासिडव द्वारा सीजमत समय िैधता के साथ प्रमाणीकरण, प्रस्ट्ताजित की जाएगी ; (ग) अन्य सभी मामलों म ें जहां बायोमेररक या आधार िन टाइम पासिडव या टाइम-बेस्ट्ड िन-टाइम पासिड व अजधप्रमाणीकरण संभि नहीं ह,ै स्ट्कीम के अधीन भौजतक आधार पत्र के आधार पर फायदा ददया जा सकता है, जजसकी अजधप्रामाजणकता ्िररत प्रजतदिया आधार पत्र पर मुदद्रत कोड के माध्यम स े स्याजपत की जा सकती ह ै और ्िररत प्रजतदिया कोड रीडर की आिश्यक व्यिस्ट्था जिभाग द्वारा अपनी दियान्ियन अजभकरण के माध्यम स े सुजिधाजनक स्ट्थानों पर उपलब्ध करायी जायेगी। 4. यहां ऊपर अन्तर्शिि की गई दकसी भी बात के होते हुए, दकसी भी बालक को स्ट्कीम के अधीन फायदा से िंजचत नहीं दकया जाएगा, अगर िह प्रमाणीकरण करिाकर अपनी पहचान स्ट्थाजपत करने में जिफल रहता है, या आधार संयाया होने का प्रमाण प्रस्ट्तुत करता है, या ऐसे बालक के मामले में, जजसे नामांकन के जलए एक आिेदन प्रस्ट्तुत करते समय नामांदकत आधार संयाया नहीं दी गई ह ै उसे पैरा 1 के उप- पैरा (3) के परंतुक के खंड (ख) और (ग) में उजल्लजखत अन्य दस्ट्तािेजों के आधार पर उसकी पहचान की पुजि करके फायदा ददया जाएगा और जहां ऐसे अन्य दस्ट्तािेजों के आधार पर फायदा ददया जाता है, िहां एक अलग रजजस्ट्टर होगा इसे ररकॉडव करने के जलए बनाए रखा जाएगा, जजसका पुनर्शिलोकन और ऑजडट मंत्रालय/जिभाग के अपने कायावन्ियन अजभकरण के माध्यम से दकया जाएगा। 5. यह अजधसूचना सभी राज्यों और संघ राज्यक्षत्रे में राजपत्र में इसके प्रकािन की तारीख से प्रभािी होगी। [फा. सं. 14017/9/2023-डीबीटी] कल्याणी चड्ढा, संयुक्त सजचि MINISTRY OF SOCIAL JUSTICE AND EMPOWERMENT (Department of Social Justice and Empowerment) NOTIFICATION New Delhi, the 23rd June, 2023 S.O. 2763(E).—Whereas, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly to them in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one’s identity; And whereas, the Department of Social Justice and Empowerment in the Ministry of Social Justice and Empowerment, Government of India, is administering the Pre-Matric Scholarship for Scheduled Castes & Others (hereinafter referred to as the Scheme). The objective of this Centrally Sponsored Scheme is to support through financial assistance parents of children belonging to Schedule Caste and other disadvantaged categories for education of their wards studying at Pre-Matric stage so that their participation improves, the incidence of drop out – especially4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] in the transition from the primary to the next level and elementary to the secondary stage – is minimized, they perform better and have better chance of progressing to the Post-Matric stage of education., which is being implemented through National Scholarship Portal (NSP) and States/Union Territories (hereinafter referred to as the Implementing Agencies); And whereas, under the Scheme, Scholarship (hereinafter referred to as the benefit) is given to the Schedule Caste Students and Others (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the Scheme and extant guidelines issued thereunder; And whereas, the implementation of the Scheme involves recurring expenditure incurred from the Consolidated Fund of India; Now, therefore, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Central Government hereby notifies the following, namely:- 1. (1) a child desirous of availing the benefit under the Scheme shall be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication. (2) any child desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent of his parents or guardians, before registering for the Scheme provided he is entitled to obtain Aadhaar as per section 3 of the said Act and such children shall visit any Aadhaar enrolment centre (list available at Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar. (3) as per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Ministry/Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Ministry/Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming UIDAI Registrar themselves: Provided that till the time Aadhaar is assigned to the individual, the benefit under the Scheme shall be given to such individuals, subject to production of the following documents, namely:- (a) (i) if the beneficiary was enrolled after the age of five years (with biometrics collection), his Aadhaar Enrolment Identification slip, or of bio-metric update identification slip, or; (ii) a copy of the request made for Aadhaar enrolment by the beneficiary; and (b) any one of the following identity documents of the beneficiary, namely:- (i) Birth Certificate; or Record of birth issued by the appropriate authority; or (ii) School identity card, duly signed by the Principal of the school, containing parents names; and (c) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely:– (i) Birth Certificate; or Record of birth issued by the appropriate authority; or (ii) Ration Card; or (iii) Ex-Servicemen Contributory Health Scheme (ECHS) Card; or Employees' State Insurance Corporation (ESIC) Card; or Central Government Health Scheme (CGHS) Card; or (iv) Pension Card; or (v) Army Canteen Card; or (vi) any Government Family Entitlement Card; or (vii) any other document as specified by the Ministry/Department: Provided further that the above documents shall be checked by an officer specifically designated by the Ministry/Department for that purpose. 2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Ministry/Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through media shall be given to the beneficiaries to make them aware of the requirement of Aadhaar under the Scheme.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 5 3. Where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:- (a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication and the Ministry/Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger print authentication for delivery of benefits in seamless manner; (b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time- based One-Time Password with limited time validity, as the case may be, shall be offered; (c) in all other cases where biometric or Aadhaar One Time Password or Time-based One-Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Ministry/Department through its Implementing Agency. 4. Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment, the benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses (b) and (c) of the proviso of sub-paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Ministry/Department through its Implementing Agency. 5.
