I में ददए गए जिजवदा दस्ट्तावेज़ म ें स्ट्पष्ट रूप से रखी गई ह।ै इस ेएमएसटीसी की वेबसाइट पर दखे ा िा सकता ह।ै ii. जिजवदा प्रदिया के माध् यम से आवंटि के इस दसू रे चरण म ें आवंटि की कुल मात्रा 80 मीट्ररक टि तक सीजमत ह।ै iii. ददल्ली के माििीय उच्च न्यायालय ि े ददिांक 26-09-2025 के आदेि के माध्यम से उि याजचकाओं का जिपटाि कर ददया ह ै जििमें उत्तरदाताओं को जवत्त वषव 2025-26 के जलए टीआरक्यू आवंटि की िीघ्र समीक्षा करिे का जिदेि ददया गया था। माििीय उच्च न्यायालय के आदेि का ऑपरेट्रटव भाग िीचे पुि: प्रस्ट्तुत दकया गया ह ै “18. यह देखत ेहुए दक वतवमाि जवत्तीय वषव म ेंस ेछह महीि ेपहले ही बीत चुके ह,ैं उत्तरदाताओं को टीआरक्यू आवंटि की समीक्षा करि ेकी आवश्यकता होगी तादक वतवमाि जवत्तीय वषव के जलए कोटे का उपयोग दकया िा सके। 19. मामले के तथ्यों और पट्ररजस्ट्थजतयों को ध्याि म ेंरखत ेहुए, उत्तरदाताओं के जलए पवूोि समीक्षा को यथासंभव िीघ्रता स ेऔर अजधमाितः आि स ेचार सप्ताह की अवजध के अंदर करिा उजचत होगा। 20. समीक्षा करत ेसमय, संबंजधत प्राजधकारी वतवमाि याजचकाओं म ेंयाजचकाकतावओं द्वारा उिागर की गई जिकायतों/आिंकाओं को जवजधवत रूप स ेध्याि म ेंरखेंग,े जविेष रूप स ेयह पहलू दक आवंटि िीजत को एक ही व्यापक आधार बिाि ेऔर इस ेउि आवेदकों तक जवस्ट्ताट्ररत करिे की ददिा म ेंआग ेबढ़िा चाजहए जििके पास जपछले कुछ वषों का पयावप्त कारोबार का रैक ट्ररकॉडव िहीं ह ै(भल ेही उिके पास साथवक िेटवकव हो) के साथ-साथ पहली बार टीआरक्य ूआवंटि की मांग करिे वाल ेहों। 21. यदद उत्तरदाता याजचकाकतावओं के अिुरोध को स्ट्वीकार करिे के जलए इच्छुक ह,ैं तो डीिीएफटी तदिुसार टीआरक्य ूआवंट्रटत करि ेके जलए अजतट्ररि ित/ेंमािदडं िाजमल कर सकता ह।ै 22. उपयिुव जिदिे ों के साथ, याजचकाओं (लंजबत आवेदिों सजहत) का जिपटारा दकया िाता ह।ै” iv. न्यायालय के आदेि के अिुपालि म,ें आवंटि को व्यापक बिािे के जलए, पट्ररजिष्ट – 2क के अिलु ग्नक – IV म ें दी गई पात्रता ितों को पूरा करिे वाल े प्रजतभागी दसू रे चरण के जलए पात्र ह ैं और सूक्ष्म, लघु, मध् यम उद्यमों और अन् य इकाइयों के बोलीदाताओं को आवंटि के जलए अजधकतम पात्रता मात्रा िमिः 50 दकलोग्राम, 100 दकलोग्राम, 250 दकलोग्राम और 500 दकग्रा तक सीजमत ह।ै v. आवंटि के पहले चरण के प्रजतभागी इस दसू रे चरण के जलए भी पात्र ह।ैं इसके अजतट्ररक्त , उपयुवि (iv) म ेंजिधावट्ररत सीमा, यदद कोई हो, तो पहले चरण की आवंट्रटत मात्रा के अजतट्ररक्त होगी। vi. दसू रे चरण के आवंटि के सफल बोजलदाताओं को िारी दकए गए टीआक्य ,ू टीआक्य ू प्राजधकार पत्र िारी होिे की जतजथ स े 6 महीि े के जलए वैध ह।ैं vii. दकसी ददए गए आइईसी के जलए केवल एक पंिीकृत उपयोगकताव (एमएसटीसी वेबसाइट पर) को बोली प्रदिया म ें भाग लिे े की अिुमजत ह।ै इसके अजतट्ररक्त ,[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 3 क. यदद पंिीकृत उपयोगकता व का जववरण आइईसी म ें िाजमल ह ै (िैसे प्रोपराइटर, भागीदार, जिदेिक आदद), तो तकिीकी बोली के दौराि आइईसी की एक प्रजत एमएसटीसी पोटवल पर प्रस्ट् तुत करिी होगी। ख. यदद पंिीकृत उपयोगकता व का िाम बोली लगाि े वाल े के आइईसी जववरण म ें िहीं ह,ै तो जिस प्रोपराइटर/भागीदार/कता/वजिदिे क का िाम आइईसी जववरण म ें ह,ै उसके द्वारा जवजधवत हस्ट्ताक्षट्ररत दकया हुआ एक प्राजधकार पत्र तकिीकी बोली के दौराि एमएसटीसी पोटवल पर प्रस्ट् तुत करिा होगा। viii. जिजवदा प्रदिया का अिंजतम कायविम अिलु ग्नक-II म ें ददया गया ह ै । ix. कोई भी गलत िािकारी या गलत बयाि के पट्ररणामस्ट् वरूप जिजवदा िुरू स े ही रद्द कर दी िाएगी और लागू जियमों के साथ पट्रित एफटीडीआर अजधजियम के प्रासंजगक प्रावधािों और जिजवदा दस्ट्तावेि के प्रावधाि के तहत सज़ा हो सकती ह।ै इस साविव जिक सचू िा का प्रभाव: जवत्तीय वषव 2025-26 के जलए भारत-यूएई सीईपीए के अन् तगवत प्रिल्ु क िीष व 7108 के तहत आयात के जलए टीआरक्यू के आवंटि के दसू रे चरण हते ु प्रदिया और ददिाजिदिे अजधसूजचत दकए गए ह।ैं लव अग्रवाल, महाजिदिे क जवदिे व्यापार एव ं पदेि अपर सजचव अिलु ग्ि क-। जवदेि व्यापार महाजिदेिालय भारत सरकार भारत-यूएई - यूएई सीईपीए (इसके बाद "टीआरक्य"ू के रूप में संदर्भवत) के तहत सोिे के जलए प्रिुल्क दर कोटा के आवंटि के जलए ई-िीलामी करिे के इरादे से व्यापार सूचिा संख्या 16/2025-26 ददिांक 29.10.2025 के साथ पट्रित सावविजिक सूचिा संख्या 31/2025-26 के अिुसार िारी दकया गया ह।ै "इस जिजवदा दस्ट्तावेि में प्रदाि की गई सभी िािकारी को जवदेि व्यापार िीजत, 2023 (इसके बाद "एफटीपी" के रूप में संदर्भवत), प्रदकया पुस्ट्त क, 2023 (इसके बाद "एचबीपी" के रूप में संदर्भवत), सावविजिक सूचिा और जवदेि व्यापार महाजिदेिालय द्वारा िारी व्यापार सूचिा (इसके बाद "डीिीएफटी" के रूप में संदर्भवत) के साथ पढ़ा िािा चाजहए।" इस जिजवदा दस्ट्तावेि और एफटीपी या एचबीपी के प्रावधािों के बीच टकराव की जस्ट्थजत में, एफटीपी या एचपीबी (समय-समय पर यथासंिोजधत) के प्रावधाि, िैसा भी मामला हो, लागू होंगे। 1.2. एतद्द्वारा यह स्ट्पष्ट दकया िाता ह ै दक इसके प्रयोििों के जलए, टीआरक्यू के अंजतम आवंटि की घोषणा तक, केवल डीिीएफटी इसके तहत कोई भी सूचिा िारी करि े के जलए अजधकृत ह ैऔर डीिीएफटी[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 5 स े केवल जलजखत संचार, िो डीिीएफटी की वेबसाइट (www.dgft.gov.in) पर अपलोड दकए गए को ही आजधकाट्ररक सूचिा मािा िाएगा। "व्यापार की सुजवधा के जलए, एमएसटीसी जलजमटेड (इसके बाद "एमएसटीसी" के रूप म ें संदर्भवत) की ई-िीलामी वेबसाइट पर उि जलजखत संचार (डीिीएफटी द्वारा टीआरक्यू आवंटि की घोषणा तक) भी अपलोड दकया िाएगा।" 1.3. यह जिजवदा दस्ट्तावेि ि तो एक अिलु ग्नक ह ै और ि ही संभाजवत बोलीदाताओं या दकसी अन्य व्यजि को डीिीएफटी द्वारा एक प्रस्ट्ताव ह।ै इस जिजवदा दस्ट्तावेि का उद्देश्य इच्छुक पक्षों को ऐसी िािकारी प्रदाि करिा ह ै िो इस जिजवदा दस्ट्तावेि के अिुसार अपिी बोजलयां बिाि े म ें उिके जलए उपयोगी हो सकती ह।ै प्रत्येक बोलीदाता को अपिी स्ट्वय ं की िांच और जवश्लेषण करिा चाजहए और इस जिजवदा दस्ट्तावेि म ें जिजहत िािकारी की सटीकता, पयावप्तता, िुद्धता, जवश्वसिीयता और पणू वता की िांच करिी चाजहए और उपयुि स्रोतों स े स्ट्वतंत्र सलाह प्राप्त करिी चाजहए। 1.4. बोलीदाता (ओं) को इस जिजवदा दस्ट्तावेि म ें प्रदाि की गई िािकारी कई स्रोतों स े एकत्र की गई ह,ै जििम ें स े कुछ लागू कािूि की व्याख्या पर जिभवर हो सकती ह।ै दी गई िािकारी का उद्देश्य वैधाजिक आवश्यकताओं का एक संपूण व ब्यौरा िहीं ह ै और इस े पूण व िहीं मािा िािा चाजहए। डीिीएफटी इस जिजवदा दस्ट्तावेि म ें जिजहत दकसी भी बयाि के जलए सटीकता या कोई अन्य जिम्मेदारी स्ट्वीकार िहीं करता ह।ै 1.5. डीिीएफटी दकसी भी बोली दाता के इस जिजवदा दस्ट्तावेि म ें जिजहत कथिों के भरोसे पर दकसी भी प्रकार की कोई देयता स्ट्वीकार िहीं करता ह।ै 1.6. डीिीएफटी, अपि े पणू व जववेकाजधकार स,े लेदकि ऐसा करि े के जलए बाध्य हुए जबिा, इस जिजवदा दस्ट्तावेि म ें जिजहत िािकारी, आंकलि या मान्यताओं को अद्यति, संिोजधत या िोड़ सकता ह।ै 1.7. इस जिजवदा दस्ट्तावेि के िारी होिे का अथ व यह िहीं ह ै दक डीिीएफटी बोलीदाताओं का चयि करिे या टीआरक्यू के आवंटि के जलए पसंदीदा बोलीदाताओं को सफल बोलीदाताओं के रूप म ें जियुि करि े के जलए बाध्य ह ै और डीिीएफटी जबिा कोई कारण बताए सभी या दकसी भी बोलीदाता या बोजलयों को अस्ट्वीकार करि े का अजधकार सरु जक्षत रखता ह।ै 1.8. हर बोली लगािे वाले को बोली तैयार करिे और िमा करिे से िुड़े सभी व् यय वहि करिे होंग,े जिसम ें तैयारी, कॉपी करिा, डाक, जवतरण िल्ु क, दकसी भी प्रदिवि या प्रस्ट्तुजतयों स े िड़ु े खचव िाजमल ह,ैं जििकी डीिीएफटी/एमएसटीसी को आवश् यकता हो सकती ह,ै या उसकी बोली के संबंध में होिे वाले दसू रे व् यय भी िाजमल ह,ैं लेदकि ये इन्हीं तक सीजमत िहीं ह।ैं 1.9. यदद दकसी काय व के पूरा करिे की जियत जतजथ दकसी सावविजिक अवकाि के ददि पड़ती ह,ै तो काय व पूरा करिे की जतजथ अगल े काय व ददवस तक मािी िाएगी। "सावविजिक अवकाि" म ें िजिवार, रजववार और केंद्र सरकार द्वारा घोजषत कोई अन्य ददि िाजमल ह,ै िैसी भी पट्ररजस्ट्थजत हो। 1.10. प्रत्येक बोलीदाता उसकी और से िजित दकसी भी समस्ट्या के जलए जिम्मेदार होगा िैसे जबिली का िािा, इंटरिेट किेक्िि की समस्ट्य ा, बोलीदाता के कंप्यूटर के साथ कोई समस्ट्या आदद, जिससे बोलीदाता को ई-िीलामी म ेंबोली लगािे स े असुजवधा हो सकती ह ैया बोली िहीं लगा सकता ह।ै 2. पट्ररभाषाए ं यहाँ प्रयुि िब्दों और अजभव्यजियाँ िो यहां पट्ररभाजषत िहीं दकए गए ह ैं उिका वही अथव होगा िो अजधजियम या उसके अधीि बिाए गए जियमों में ददया गया ह।ै िब तक दक संदभव अन्यथा अपेजक्षत ि हो, इस जिजवदा दस्ट्तावेि पर जिम्नजलजखत पट्ररभाषाएँ लाग ूहोती ह:ैं6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 2.1. "अजधजियम" का तातप् य व समय-समय पर यथा संिोजधत जवदेि व्यापार (जवकास एव ं जवजियमि) अजधजियम, 1992 स े ह।ै 2.2. "लाग ू काििू " का अथव होगा सभी लागू कािूि, कािूि, उप-कािूि, जियम, जवजियम, आदेि, अध्यादेि, प्रोटोकॉल, कोड, ददिाजिदेि, सूचिाए, जिदेि, जिणवय, जडिी या अन्य आवश् यकताएं या दकसी सरकारी प्राजधकरण या न्यायालय के आजधकाट्ररक जिदेि या अन्य कािूि, जियम या जवजियमि स े ह ै जिसे सरकार के संबंजधत सरकारी प्राजधकरण स,े सरकारी संकल्प, जिदेि या अन्य सरकारी प्रजतबंध या दकसी अन्य समाि प्रकार का जिणवय या जिधावरण द्वारा या दकसी जिववचि या न्याय जिणवय िो उजचत समय पर भारत म ें काििू द्वारा अिुमोददत दकया गया हो। 2.3. "बोलीदाता" का तात्पय व ऐस े व्यजि स े ह ै िो सोि े की टीआरक्य ू िीलामी म ें भाग लिे े के उद्दश्े य स े एमएसटीसी वेबसाइट (यूआरएल: https://www. mstcecommerce.com/eprocn/dgft) पर पंिीकृत ह,ै और बोलीदाताओं म ें ऐस े सभी व्यजि िाजमल होंगे। 2.4. "बोली की जियत जतजथ " स े तात्पयव उस जतजथ स े ह ै जिस ददि या उससे पूवव तकिीकी बोली तथा जवत् तीय बोली प्रस्ट्तुत करिा आवश्यक ह।ै 2.5. “बोली प्रजतभजू त” का अथ व इस दस्ट्तावेि के खडं 11 म ेंदी गई अजभव्यजि स े ह।ै 2.6. “डीिीएफटी वबे साइट” स े तात्पय व https://www.dgft.gov.in से ह।ै 2.7. "एजक्ज़म सजु वधा सजमजत" का अजभप्राय एजक्ज़म सुजवधा सजमजत (ईएफसी) स े ह ै िसै ा दक जवदेि व्यापार िीजत और प्रदिया पुस्ट् तक म ेंपट्ररभाजषत दकया गया ह।ै 2.8. "जवत्तीय बोली / मल्ू य बोली" का तात्पय व समेदकत प्रपत्र स े ह ै जिसमें प्रत्येक मूल्य श्रेणी के समक्ष आवश्यक मात्रा जिर्दवष्ट की िाती ह।ै 2.9. “जप्रफडव बोलीदाता” का अथ व ऐसे बोलीदाता स े ह ै जिसे ईएफसी िे टीआरक्यू की कोई मात्रा आवंट्रटत की ह,ै और ऐस े जप्रफडव बोलीदाता के जलए "कुल आवंट्रटत टीआरक्य"ू का अथ व ईएफसी द्वारा सभी मूल्य श्रणे ी म ें उस बोलीदाता को आवंट्रटत टीआरक्यू की कुल मात्रा से ह।ै 2.10. "प्राइस बकेट" से तात्पय व भारतीय रुपय े म ें प्रजत दकलोग्राम सोि े की उस जवजिष्ट कीमत से ह ै िो बोलीदाता उस बकेट में टीआरक्यू की आवंट्रटत मात्रा के जलए डीिीएफटी को भुगताि करि े को तैयार ह।ै सुजवधा के जलए, जिजवदा म ें 100000 स े 0 तक की 51 प्राइस बकेट ह,ैं जििमें स े प्रत् यके 2000 के चरणों म ें ह।ैं 2.11. "धारा" स ेतात्पय व अजधजियम की धारा स े ह ै। 2.12. "सफल बोलीदाताओं" स े तात्पय व उि जप्रफडव बोलीदाताओं स े ह ै िो इस दस्ट्तावेि के खंड 8 म ें दी गई ितों को पूरा करते ह।ैं 2.13. “तकिीकी बोली” का वही अथव होगा िो इस दस्ट्ताविे के खंड 7.2 म ें दी इस अजभव्यजि को ददया गया ह।ै 2.14. “तकिीकी रूप स े योग्य बोलीदाताओं” का अथव खडं 7.2 म ेंदी गई अजभव्यजि के अिसु ार होगा। 2.15. "जिजवदा दस्ट्ताविे " स े तात्पय व इस जिजवदा दस्ट्तावेि के साथ ही इसम ें उजल्लजखत अिुसूजचयां और दस्ट्तावेिों से ह ै जिसम ें सूचिा ज्ञापि और इस जिजवदा दस्ट्तावेि के कोई भी पट्ररजिष्ट िाजमल ह।ै[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 7 3. पट्ररचय 3.1. ददिांक 29.10.2025 की सावविजिक सूचिा संख्या 31/2025-26 में भारत-यूएई सीईपीए के अंतगवत सोिे के संबंध म ेंप्रजतस्ट्पधी बोली/जिजवदा प्रदिया के माध्यम स ेटीआरक्यू के आवंटि का प्रावधाि ह।ै 3.2. अजधजियम की धारा 5 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, डीिीएफटी ि े ददिांक 29.10.2025 की सावविजिक सूचिा संख्या 31/2025-26 और एफटीपी, 2023 के अन्य संबंजधत प्रावधािों और उसके तहत अजधसूजचत प्रदियाओं के माध्यम स े टीआरक्य ू के जलए आवेदि दायर करि े के जलए पात्रता मािदंड को अजधसूजचत दकया ह।ै बोलीदाताओं को इसके साथ खुद को पट्ररजचत करिे के जलए प्रोत्साजहत दकया िाता ह।ै 3.3. ई-िीलामी एफटीपी और एचबीपी के उपयिुव प्रावधािों और इस जिजवदा दस्ट्ताविे के अिुसार आयोजित की िाएगी। 3.4. बोलीदाताओं स े अपेक्षा की िाती ह ै दक वे अंतरराष्ट्रीय बािार म ें सोिे की प्रचजलत कीमतों के संबंध म ें उजचत िांच-पड़ताल करें और सोिे के आयात, उसकी भौजतक सुपुदवगी आदद स े संबंजधत सभी लागू कािूिों स े स्ट्वय ं को पट्ररजचत कराएं। 4. भारत-यएू ई सीईपीए के तहत सोि े का प्रिल्ु क दर कोटा। 4.1. भारत-यूएई व्यापक आर्थवक साझेदारी समझौता (सीईपीए), िो 1 मई 2022 को लागू हुआ, प्रिल्ु क दर कोटा (टीआरक्यू) तंत्र के तहत संयिु अरब अमीरात स े आयाजतत सोि े की जिर्दष्टव मात्रा के जलए तरिीही प्रिुल्क पहुचं प्रदाि करता ह।ै टीआरक्यू का उद्देश्य व्यापार को सुगम बिािा, आयात प्रवाह को पूवाविुमाजित करिा और जद्वपक्षीय आर्थवक सहयोग को मिबूत करिा ह।ै 4.2. सीईपीए प्रजतबद्धताओं के तहत, भारत िे संयुि अरब अमीरात स े सालािा आयाजतत सोिे की अजधसूजचत मात्रा पर ट्ररयायती मूल सीमा िुल्क (बीसीडी) का जवस्ट्तार दकया ह,ै िैसा दक पट्ररजिष्ट 2क के तहत ददया गया ह।ै 4.3. सोिे के जलए वार्षवक टीआरक्य ू मात्रा का आवंटि डीिीएफटी द्वारा पट्ररजिष्ट-2क के अिलु ग्नक-IV के अंतगतव अजधसूजचत ददिाजिदिे ों के अिुसार दकया िाता ह।ै डीिीएफटी के अंतगवत िारी टीआरक्य ू प्राजधकार पत्र आयातकों को सीमा िुल्क जिकासी के समय ट्ररयायती िुल्क दरों का लाभ उिािे म ें सक्षम बिाता ह।ै 5. पात्रता 5.1. ददिांक 29.10.2025 की सावविजिक सूचिा संख्या 31/2025-26 द्वारा संिोजधत पट्ररजिष्ट 2क के अिलु ग्नक IV के अिुसार, ई-िीलामी म ें भाग लेिे की पात्रता जिम्नािुसार होगी: 5.1.1. हॉलमार्किंग प्रमाण जचन्ह अंदकत करिे के जलए पात्र आवेदक को भारतीय मािक ब्यूरो (बीआइएस) के साथ पंिीकृत होिा चाजहए। 5.1.2. आवेदक भारत म ें लाग ू वस्ट्त ु एव ं सेवा कर (िीएसटी) अजधजियमों के तहत पंिीकृत व्यजि होिा चाजहए और उसके पास वैध िीएसटी पहचाि संख्या (िीएसटीआइएि) होिी चाजहए। 5.1.3. टीआरक्यू के अतं गतव गोल्ड डोरे का आयात मान्य िहीं होगा। 6. बोली-पवू वपरामि व 6.1. संभाजवत बोलीदाता इस जिजवदा दस्ट्तावेि के संबंध म ें स्ट्पष्टीकरण मागं सकते ह ैं या अजतट्ररि िािकारी का अिरु ोध कर सकते ह।ैं8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 6.2. इस जिजवदा दस्ट्तावेज़ के संबंध म ें दकसी भी प्रश्न या अजतट्ररि िािकारी के जलए अिुरोध डीिीएफटी वेबसाइट पर हल्े पडेस्ट्क अिुरोध के माध्यम से दकया िा सकता ह।ै 6.3. हल्े पडस्ट्े क अिरु ोध म ें जिम्नजलजखत जवषय पंजि स्ट्पष्ट रूप स े होिी चाजहए: “प्रश्न/अजतट्ररि िािकारी के जलए अिरु ोध: भारत-यूएई सीईपीए के तहत सोिे के जलए टीआरक्यू के ‘‘दसू रे चरण के आवटंि के जलए ’’ जिजवदा दस्ट्तावेि”। 6.4. प्रत्येक प्रश्न म ें प्रश्न स े संबंजधत तथ्यों, सूचिाओं और लागू कािूि का पूरा जववरण और प्रश्न पूछिे वाल े व्यजि का जववरण होिा चाजहए। डीिीएफटी दकसी भी प्रश्न का उत्तर ि दिे े का अजधकार सुरजक्षत रखता ह,ै जिसम ें अपूण व या अज्ञात प्रश्न भी िाजमल ह।ैं 6.5. प्रश्नों को बोली िरूु होि ेकी तारीख से 3 ददि पहल े ईमले द्वारा भेिा िािा चाजहए। 6.6. यह स्ट्पष्ट रूप स े स्ट्पष्ट दकया िाता ह ै दक ऊपर बताए अिुसार प्रश्नों को प्राप्त करिे की अंजतम जतजथ के बाद कोई प्रश्न प्रस्ट्ततु िहीं दकए िा सकते ह।ैं 6.7. डीिीएफटी 3 ददिों की अवजध के भीतर प्रश्नों का उत्तर दिे े का प्रयास करेगा। तथाजप, डीिीएफटी अपिे जववेकाजधकार पर दकसी भी प्रश्न का उत्तर ि दिे े या कोई स्ट्पष्टीकरण ि दिे े का अजधकार सुरजक्षत रखता ह,ै और इस जिजवदा दस्ट्तावेि म ें ऐसा कुछ भी िहीं ह ै जिसे डीिीएफटी को दकसी प्रश्न का उत्तर देि े या कोई स्ट्पष्टीकरण देि े के जलए बाध्य या आवश्यक मािा िाए। 6.8. संभाजवत बोलीदाताओं के पूवव-बोली परामि व व्यापार सूचिा म ें उजल्लजखत जिधावट्ररत जतजथ पर डीिीएफटी द्वारा जिर्दवष्ट समय और स्ट्थाि पर आयोजित दकए िाएंगे। डीिीएफटी अपिे जववेकाजधकार पर, बोली-पूवव परामिव को आभासी माध्यम (या आभासी और भौजतक माध्यमों के जमजश्रत रूप) के माध्यम स े आयोजित करिे का जवकल्प चिु सकता ह,ै िो दक डीिीएफटी द्वारा अलग स े अजधसूजचत की िािे वाली ितों के अधीि होगा। 6.9. प्रत्येक संभाजवत बोलीदाता के अजधकतम 1 प्रजतजिजध को भाग लिे े की अिुमजत होगी, बिते व े संभाजवत बोलीदाता द्वारा जवजधवत िारी दकया गया प्राजधकार पत्र और पहचाि दस्ट्तावेि प्रस्ट्तुत करें। डीिीएफटी जिष्पक्ष, पारदिी और प्रजतस्ट्पधी जिजवदा प्रदिया को सुगम बिािे के जलए, अपिे जववेकािुसार, उजचत समझे िािे वाल े स्ट्पष्टीकरण और अजतट्ररि िािकारी प्रदाि करि े का प्रयास करेगा। 6.10. डीिीएफटी, यदद आवश्यक समझे तो, स्ट्वय ं ही सभी संभाजवत बोलीदाताओं को व्याख्याए ँ और स्ट्पष्टीकरण िारी कर सकता ह।ै डीिीएफटी द्वारा िारी सभी स्ट्पष्टीकरण और व्याख्याए ं जिजवदा दस्ट्तावेि का जहस्ट्सा मािी िाएंगी। 7. बोली प्रदिया 7.1. पिं ीकरण: 7.1.1. भारत-यूएई सीईपीए के तहत सोि े के जलए टीआरक्य ू के आवंटि हते ु बोजलयां प्रस्ट्त ुत करि े के जलए, बोलीदाता को एमएसटीसी पोटवल पर ऑिलाइि पंिीकरण करिा होगा। पंिीकरण के जलए, बोलीदाता को एमएसटीसी वेबसाइट यूआरएल - "https://www.mstcecommerce.com/eprocn/dgft" पर डीिीएफटी को समर्पवत पृष्ठ पर िािा चाजहए और "पंिीकरण" बटि पर जक्लक करिा चाजहए। 7.1.2. स्ट्िीि पर एक ऑिलाइि पंिीकरण फॉमव ददखाई देगा और बोलीदाता को इस े भरिा होगा। इस प्रदिया के दौराि, बोलीदाता को अपिा "यूिर आइडी" और "पासवडव" बिािा होगा और उसे िोट करके रखिा होगा। बोलीदाता को यह सुजिजित करिा चाजहए दक उसके यूिर आइडी और पासवडव की[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 9 गोपिीयता हर समय बिी रह े और यूिर आइडी और पासवडव के दकसी भी दरुु पयोग के जलए बोलीदाता ही पूरी तरह स े जिम्मेदार होगा। 7.1.3. उपयुवि पंिीकरण प्रदिया पूरी होि े पर, बोलीदाता एमएसटीसी की वेबसाइट पर लॉग इि कर सकेगा। ई-जिजवदा म ें बोली िमा करि े के जलए बोलीदाताओं के पास वैध क्लास III हस्ट्ताक्षर और एजन्िप्िि प्रकार का जडजिटल हस्ट्ताक्षर प्रमाणपत्र (डीएससी) होिा आवश्यक ह।ै 7.2. जिजवदा प्रदिया: 7.2.1. जिजवदा म ें “तकिीकी और जवत्तीय बोली” दोिों घटक िाजमल होंग,े जिन्ह ें जिधावट्ररत जियमों और ितों के अिुसार प्रस्ट्ततु दकया िािा चाजहए। 7.2.2. बोलीदाताओं को "बोली िमा करि े की जियत तारीख" को या उससे पहल े बोली िमा करिी होगी। 7.2.3. जिजवदा म ें तकिीकी बोली, पात्रता के जलए दस्ट्तावेज़ अपलोड और एक्सेल आधाट्ररत मूल्य बोली के साथ एक ही लॉट होगा। बोली लगािे वाले को दस्ट्तावेि अपलोड करिे और बोली प्रस्ट्त ुत करिे स े पहल े 5000 रुपय े का सहभाजगता िल्ु क िीएसटी सजहत और 1,00,000 रुपय े की बोली प्रजतभूजत राजि िमा करिी होगी। 7.2.4. तकिीकी बोली म ें तकिीकी योग्यता के जलए आवश्यक दस्ट्तावेिों का प्रस्ट्ततु ीकरण िाजमल ह,ै जिसम ें बोलीदाता का वैध िीएसटी पंिीकरण, बोलीदाता का वैध हॉलमाकव पंिीकरण, वैध आयात-जियावत कोड (आइईसी), वैध एमएसएमई प्रमाणपत्र (सूक्ष्म, लघ ु एव ं मध् यम उद्यमों के मामल े म)ें और प्रस्ट्ततु तकिीकी दस्ट्तावेिों म ें ट्रटप्पजणयां, यदद कोई हो, प्रस्ट्तुत करिा िाजमल ह।ै सभी आवश्यक तकिीकी दस्ट्तावेि बोलीदाता द्वारा जिजवदा की आवश्यकताओं के अिुसार ही अपलोड दकए िािे चाजहए। 7.2.5. एक बार िब बोलीदाता द्वारा दस्ट्तावेज़ अपलोड कर ददए गए हों और तकिीकी बोली िमा कर दी गई हो, तो बोलीदाता जवत्तीय/मूल्य बोली िमा करि े के जलए आग े बढ़ेगा। 7.2.6. एक्सेल आधाट्ररत मल्ू य बोली म ें 51 प्राइस बकेट िाजमल होंगी। बोलीदाता को उि प्राइस बकेट के जलए मात्रा बतािी होगी जििके जलए वह बोली लगािा चाहता ह ै (अथावत, भारतीय रुपये म ें प्रजत दकलोग्राम सोिे की जवजिर्दवष् ट कीमत, िो बोलीदाता उस बकेट म ें टीआरक्य ू की आवंट्रटत मात्रा के जलए डीिीएफटी को दिे े को तैयार ह)ै । बोली लगाि े वाल े अपिी पसंद के अिुसार दकसी भी प्राइस बकेट के जलए बोली लगा सकते ह।ैं सभी मात्राए ं केवल पूणव संख्याओं म ें ही दिव की िािी चाजहए िो 5 के गुणि म ें हों। एक्सेल आधाट्ररत मूल्य बोली का प्रारूप इस प्रकार ह:ै 7.2.7. बोलीदाता जवत्तीय बोली सेक्ि ि के अंतगवत उपलब्ध एक्सेल िीट डाउिलोड करेगा। बोलीदाता को इजच्छत प्राइस बकेट के सामि े आवश् यक मात्रा का जववरण जवजधवत भरिा होगा। प्रत् यके प्राइस बकेट का जववरण एक् सले िीट म ें ददया गया ह ै और जवत् तीय बोली सेक्ि ि म ें अपलोड करि े स े पूवव फाइल को उसी फाइल के िाम स े सेव करें। 7.2.8. एक्सले िीट अपलोड करिे के बाद, बोलीदाता एमएसटीसी पोटवल पर सफलतापूवकव बोली िमा करिे के जलए "फाईिल जबड सबजमिि" पर जक्लक करेगा। 7.3. तकिीकी रूप स े योग्य बोलीदाता वे ह ैं जिन्होंिे पात्रता ितों को परू ा दकया ह ै और तकिीकी बोली म ें इस े प्रमाजणत करि े वाले आवश्यक दस्ट्तावेि प्रस्ट्तुत दकए ह।ैं 7.4. जवत्तीय बोजलयां केवल उन्हीं बोलीदाताओं के जलए खोली िाएंगी िो डीिीएफटी द्वारा अजधसूजचत मौिूदा जियमों के अिुसार तकिीकी रूप स े योग्य ह।ैं10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 7.5. तकिीकी रूप स े योग्य बोलीदाता के रूप म ें अहतव ा प्राप्त करि े म ें जवफल रहि े वाल े बोलीदाताओं को अयोग्यता के संबंध म ें कोई स्ट्पष्टीकरण या व्याख्या प्रदाि करि ेके जलए डीिीएफटी बाध्य िहीं ह।ै 7.6. तकिीकी रूप स े योग्य बोलीदाताओं की जवत्तीय बोजलयों की सूची एजक्िम सुजवधा सजमजत (ईएफसी) को प्रस्ट्तुत की िाएगी। ईएफसी, बोली म ें जिधावट्ररत मात्राओं के बराबर या उससे कम मात्राओं का आवंटि उजचत समझे िािे वाली सीमाओं के अधीि करेगा। जिि बोलीदाताओं को ईएफसी द्वारा टीआरक्यू आवंट्रटत दकया गया ह,ै उन्ह ें जप्रफेडव बोलीदाता मािा िाएगा। 7.7. दकसी भी प्रश्न/स्ट्पष्टीकरण के जलए एमएसटीसी के जिम्नजलजखत अजधकाट्ररयों स े संपकव दकया िा एजन्िप्िि टाइप डीएससी के साथ केवल एक उपयोगकताव की आइडी मैप की िाएगी। क्लास III के हस्ट्ताक्षर और एजन्िप्िि टाइप के जडजिटल हस्ट्ताक्षर प्रमाणपत्र के पासवडव की गोपिीयता बिाए रखिे की पूरी जिम्मेदारी बोलीदाता की होगी। बोलीदाता क्लास III हस्ट्ताक्षर और एजन्िप्िि टाइप डीएससी के दकसी भी दरुु पयोग के जलए पूरी तरह से जिम्मेदार होगा और इस संबंध में दकसी भी स्ट्तर पर एमएसटीसी/डीिीएफटी द्वारा कोई जिकायत/अजभवेदि स्ट्वीकार िहीं दकया िाएगा। 8. सफल बोलीदाताओं की उद्घोषणा 8.1. जप्रफेड व बोलीदाताओं को जिम्नजलजखत कायों के पूरा होिे पर ही सफल बोलीदाता घोजषत दकया िाएगा: 8.1.1. एफटीपी, 2023 के पट्ररजिष्ट 2क के अिलु ग्नक-IV म ें जिर्दवष्ट ितों और डीिीएफटी द्वारा िारी सावविजिक सूचिा/व्यापार सूचिा म ें बाद म ें उजल्लजखत दकसी भी अन्य ितों को पूरा करें। 8.1.2. िीच े ददए गए ललंक को फॉलो करके डीिीएफटी वेबसाइट पर टीआरक्य ू आवेदि दाजखल करें- (https://dgft.gov.in)-->आयात प्रबंधि प्रणाली-->प्रिल्ु क दर कोटा (टीआरक्यू) 8.1.3. ईएफसी द्वारा डीिीएफटी को आवंट्रटत मात्रा के जलए बोली राजि का भगु ताि, डीिीएफटी वेबसाइट पर प्रस्ट्तुत टीआरक्य ू आवेदि के माध्यम स े ईएफसी बैिक के कायववृत्त म ें बताई गई अवजध के अंदर करिा होगा। 8.2. सफल बोलीदाता जिजवदा दस्ट्तावेि के खडं 11 म ें वर्णवत 4 सप्ताह की अवजध के भीतर तकिीकी बोली प्रदिया के दौराि उसके द्वारा िमा की गई बोली प्रजतभूजत की वापसी का हकदार ह।ै 8.3. यदद जप्रफेडव बोलीदाता उपयुवि अवजध के भीतर बोली राजि िमा करिे म ें जवफल रहता ह,ै तो डीिीएफटी जप्रफेडव बोलीदाता की बोली प्रजतभूजत को िब्त कर लगे ा; और वतवमाि और बाद के जवत्तीय वषव के दौराि आगे के आवंटि के जलए बोलीदाता को अयोग्य घोजषत कर दगे ा।[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 11 9. समयसारणी जिजवदा प्रदिया की समय साट्ररणी डीिीएफटी द्वारा िारी व् यापार सूचिा म ें दी िाएगी। डीिीएफटी द्वारा बाद के िुजद्धपत्र िारी करके समय साट्ररणी म ेंसंिोधि दकया िा सकता ह।ै 10. जिजवदा प्रदिया के सबं धं म ेंसामान्य ित ें 10.1. तकिीकी बोली िमा करिा 10.1.1. तकिीकी घटक म ें तकिीकी योग्यता के जलए आवश्यक दस्ट्तावेि प्रस्ट्ततु करिा िाजमल ह,ै जिसम ें बोलीदाता के वैध िीएसटी पिं ीकरण, बोलीदाता के वैध हॉलमाकव पंिीकरण, वैध आइईसी िंबर, वैध एमएसएमई प्रमाण पत्र (सूक्ष्म, लघ ु और मध् यम उद्यमों के मामले म)ें और तकिीकी व्यापाट्ररक जवजिदेि के संबंध म ें ट्रटप्पणी िमा करिा िाजमल ह।ै सभी आवश्यक तकिीकी दस्ट्तावेिों को बोलीदाता की जिजवदा आवश्यकताओं के अिुसार ही अपलोड करिा होगा। 10.1.2. एक बार िब दस्ट्तावेज़ अपलोड कर ददए िाते ह ैं और बोलीदाता द्वारा तकिीकी बोली प्रस्ट्तुत कर दी िाती ह,ै तो बोलीदाता जवत्तीय/मूल्य बोली िमा करिे के जलए आग े बढ़ेगा। 10.2. भाषा जिजवदा दस्ट्तावेि और बोली के संबंध म ें या उससे संबंजधत बोली और सभी संचार अग्रं ेिी भाषा म ें होि े चाजहए। 10.3. दस्ट्तावज़े और सचू िा जिजवदा दस्ट्तावेि और डीिीएफटी द्वारा प्रदाि दकए गए सभी संलग्न दस्ट्तावेि डीिीएफटी की संपजत्त ह ै और बि े रहगें े या बि िाएंग,े और इन्ह ें बोलीदाताओं को जसफव लाग ू कािूिों के अिुसार बोली तैयार करि े और प्रस्ट्तुत करिे के उद्दश्े य स े ददया िाता ह।ै बोलीदाता अपिी बोली तैयार करि े और प्रस्ट्तुत करि े के अजतट्ररि दकसी अन्य उद्देश्य के जलए इसका उपयोग िहीं करेंगे। इस खंड के प्रावधाि बोली के संबंध म ें बोलीदाताओं द्वारा प्रस्ट्तुत बोजलयों और अन्य सभी दस्ट्तावेिों पर भी लागू होंगे, और डीिीएफटी बोलीदाताओं को दकसी भी बोली, दस्ट्तावेि या उसके साथ प्रदाि की गई दकसी भी िािकारी को वापस िहीं करेगा। 10.4. बोली की लागत बोलीदाता अपिी बोजलयों की तैयारी और जिजवदा प्रदिया म ें उिकी भागीदारी स े िुड़ी सभी लागतों के जलए जिम्मेदार होंगे। डीिीएफटी जिजवदा प्रदिया के जिववहि या पट्ररणाम के बाविूद ऐसी लागतों के जलए दकसी भी तरह स े जिम्मेदार या उत्तरदायी िहीं होगा। 10.5. बोलीदाताओं द्वारा िािकारी का सत्यापि 10.5.1. यह मािा िाएगा दक बोली िमा करके, बोलीदाता ि:े (क) जिजवदा दस्ट्तावेि की पणू व और सावधािीपूववक िांच की और जबिा ित व और अपट्ररवतिव ीय रूप स े ितों को स्ट्वीकार कर जलया। (ख) डीिीएफटी द्वारा दी गई सभी संबंजधत िािकारी की समीक्षा की गई, िो िायद बोली स े संबंजधत हो सकती ह।ै (ग) जिजवदा दस्ट्तावेिों में दी गई िािकारी या डीिीएफटी द्वारा या उसकी ओर से ई-िीलामी प्रदिया से िुड़े दकसी भी मामले के बारे में दी गई िािकारी में कमी, गलती या चूक के िोजखम को स्ट्वीकार दकया।12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] (घ) इस जिजवदा दस्ट्तावेि के अिुसार, इिफॉमडव जबड लगाि े और अपिी सभी जज़म्मेदाट्ररयों को पूरा करिे के जलए, ई-िीलामी प्रदिया से िुड़ ेसभी मामलों के बारे में स्ट् वयं को संतष्टु कर जलया ह।ै (ड.) यह स्ट्वीकार दकया और सहमजत दी दक जिजवदा दस्ट्तावेि में दी गई िािकारी की अपयाप्तव ता, अधूरापि या गलत होिा, या ऊपर बताए गए ई-िीलामी प्रदिया से िुड़ े दकसी भी मामल े की िािकारी ि होिा, डीिीएफटी से मुआवज़े, हिाविे, अपिी जज़म्मेदाट्ररयों को पूरा करिे के जलए समय बढ़ािे, लाभ के िुकसाि आदद के दकसी भी दावे का आधार िहीं होगा। (च) इसके अंतगवत और इसके जियमों के अिुसार उसके द्वारा दी गई वचिबद्धता से बंध े रहि े पर सहमजत व्यि की। 10.5.2. डीिीएफटी, दी गई दकसी भी िािकारी के संबंध म ें दकसी भी चूक, गलती या त्रुट्रट के जलए या जिजवदा दस्ट्तावेि या जिजवदा प्रदिया स े संबंजधत दकसी भी मामले या चीज़ के कारण होि े वाली दकसी भी बात के जलए जज़म्मेदार िहीं होगा, जिसम ें डीिीएफटी द्वारा दी गई दकसी भी िािकारी या आँकड़ े म ें कोई गलती या चूक िाजमल ह।ै 10.6. डीिीएफटी द्वारा सत्यापि और प्रजतबधं डीिीएफटी के पास जिजवदा दस्ट्तावेि के िवाब म ें बोलीदाता द्वारा प्रस्ट्तुत सभी बयािों, सूचिाओं और दस्ट्तावेिों को सत्याजपत करि े का अजधकार सुरजक्षत ह ै और िब भी डीिीएफटी को आवश्यकता होगी, तो बोलीदाता ऐसी सभी िािकारी, साक्ष्य और दस्ट्तावेि उपलब्ध कराएगा िो इस तरह के सत्यापि के जलए आवश्यक हो सकत े ह।ैं डीिीएफटी द्वारा इस तरह के सत्यापि या इस तरह के सत्यापि की कमी बोलीदाता को इसके तहत अपि े दाजयत्वों या दिे दाट्ररयों स े मुि िहीं करेगी और ि ही इसके तहत डीिीएफटी के दकसी भी अजधकार को प्रभाजवत करेगी। 10.7. बोली दये जतजथ और जवस्ट्तार डीिीएफटी अपि े जववेकाजधकार म,ें डीिीएफटी वेबसाइट पर सभी बोलीदाताओं को उपलब्ध कराई गई व्यापार सूचिा िारी करके बोली दये जतजथ का जवस्ट्तार कर सकता ह।ै 10.8. बोजलयों म ेंसिं ोधि/प्रजतस्ट्थापि/वापसी बोलीदाता बोली प्रस्ट्तुत करिे के बाद, बोली दये जतजथ स े पहले, अपिी तकिीकी बोली को संिोजधत, स्ट्थािापन्न या वापस ले सकता ह।ै बोली दये जतजथ पर बोली प्रस्ट्तुत करिे के जलए जिधावट्ररत अजं तम समय के बाद बोलीदाता द्वारा कोई तकिीकी बोली संिोजधत, प्रजतस्ट्थाजपत या वापस िहीं ली िाएगी, िब तक दक डीिीएफटी द्वारा स्ट्पष्ट रूप स ेमांग िहीं की गई हो। 10.9. बोजलयों की अस्ट्वीकृजत 10.9.1. इस जिजवदा दस्ट्तावेि म ें जलखी दकसी भी बात के बाविूद, डीिीएफटी के पास जबिा दकसी उतरदाजयत्व या िवाबदेही के और जबिा कोई कारण बताए, दकसी भी समय सभी बोली को अस्ट्वीकार करिे/या जिजवदा प्रदिया को रद्द करिे का अजधकार सुरजक्षत ह,ै और इसके जलए उसे ऐसी स्ट् वीकृजत, अस्ट् वीकृजत या रद्द करिे के जलए कोई जिम् मदे ारी या रूप म,ें एमएसटीसी पोटवल पर 1,00,000/- रुपय े की राजि की प्रजतभूजत िमा करिी होगी। 11.2. जिजवदा दस्ट्तावेि म ें ददए गए प्रावधािों को छोड़कर, असफल बोली लगािे वालों की बोली प्रजतभूजत डीिीएफटी द्वारा, जबिा दकसी ब्याि के, जप्रफेडव बोलीदाता की उद्घोषणा की जतजथ या जिजवदा प्रदिया रद्द होिे की जतजथ से िो भी पहले हो, 4 (चार) सप्ताह के अंदर वापस कर दी िाएगी, 11.3. जप्रफेड व बोलीदाता की बोली प्रजतभूजत आवंट्रटत काय व या प्रजतबंधात्मक काय व म ें जहस्ट्सा जलया ह ै स े 3 (तीि) साल की अवजध के जलए डीिीएफटी द्वारा िारी की गई दकसी भी जिजवदा म ें भाग लिे े के योग्य िहीं होगा। 12.3. इस जिजवदा दस्ट्तावेि के उद्देश्यों के जलए, जिम्नजलजखत िब्दों का अथव वही होगा िो िीचे ददया गया ह:ै 12.3.1. “गलत कायकव लाप” का अथ व ह ैजिजवदा प्रदिया को प्रभाजवत करिे के जलए तथ्यों को गलत तरीके स े बतािा या जछपािा या तथ्यों को दबािा या अधूरी िािकारी दिे ा। 12.3.2. “प्रजतरोधी कायकव लाप” का अथव ह ै दकसी व्यजि या संपजत्त को सीधे या अप्रत्यक्ष रूप स े हाजि पहुचं ािा या हाजि पहुचं ाि े की धमकी देिा, तादक जिजवदा प्रदिया म ें दकसी व्यजि की भागीदारी या कारववाई पर असर डाला िा सके; और 12.3.3. “प्रजतबधं ात्मक कायकव लाप” का अथव ह ै जिजवदा प्रदिया म ें पूरी और जिष्पक्ष प्रजतयोजगता को सीजमत करिे या उसम ें हरे फेर करिे के उद्देश्य स े बोलीदाता के बीच उत्पादक संघ बिािा या कोई समझौता या व्यवस्ट्था करिा। 13. अन्य प्रावधाि 13.1. िासकीय काििू जिजवदा प्रदिया भारत के कािूिों द्वारा िाजसत और उसके अिसु ार लागू की िाएगी।[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 15 13.2. डीिीएफटी के अजधकार 13.2.1. डीिीएफटी, अपिे जववेकाजधकार म ें और जबिा दकसी दाजयत्व या जिम्मेदारी के, दकसी भी समय अजधकार सुरजक्षत रखता ह,ै दक: (क) जिजवदा प्रदिया को जिलंजबत प्रस्ट्तुजतयों या अन्य िािकारी और/या साक्ष्य को स्ट्वतंत्र रूप स े सत्याजपत, अयोग्य, अस्ट्वीकार और/या स्ट्वीकार करिा। 13.2.2. यह मािा िाएगा दक बोली िमा करके, बोलीदाता डीिीएफटी, उसके कमवचाट्ररयों को, जबिा दकसी ितव के, पूरी तरह और अंजतम रूप स,े दकसी भी दाव,े िुकसाि, क्षजत, लागत, खचव या देिदाट्ररयों के जलए सभी जिम्मेदाट्ररयों स े मुि करता ह,ै िो दकसी भी तरह स े यहाँ बताए गए दकसी भी अजधकार के प्रयोग No. 01/89/180/01/AM-22/PC-2[B]/Part-I/E-35248.—In exercise of the powers conferred under Paragraph 1.03 and 2.04 of the Foreign Trade Policy, 2023, as amended from time to time and in continuation of the Public Notice no. 31/2025-26 dated and Trade Notice no. 16/2025-26 dated 29.10.2025, wherein it was decided that the allocation of TRQ for Gold under India-UAE CEPA will be undertaken based on the competitive bidding/tender process. In view of that, the Director General of Foreign Trade hereby invites bids/tenders for the second round of allocation of Gold TRQ under tariff head 7108 under the India-UAE Comprehensive Economic Partnership Agreement (CEPA) for FY 2025-26 as under: i. The Process for inviting bids from the Trade and Industry is clearly laid out in the Tender Document given at Annexure – I. The same may be accessed on the MSTC website. ii. The Total Quantity of Allocation is restricted to 80 MT in this second round of Allocations through the tender process iii. The Hon’ble High Court of Delhi vide order dated 26.09.2025 has disposed of the petitions directing the respondents to expeditiously review the TRQ Allocation for the FY 2025-26. The operative part of the Hon’ble High Court order is reproduced below “18. Necessarily, given that six months out of the current financial year have already elapsed, the respondents would be required to undertake a review of the TRQ allocation so as to utilize the quota for the current financial year. 19. Considering the facts and circumstances of the case, it would be apposite for the respondents to conduct the aforesaid review as expeditiously as possible and preferably within a period of four weeks from today. 20. While conducting the review, the concerned authorities shall duly take into account the grievances / apprehensions highlighted by the petitioners in the present petitions, particularly the aspect that the allocation policy must veer towards making the same broad-based and extending it to those applicants who do not have a track record of substantial turnover over the preceding few years (even though they have significant network) as well as those seeking TRQ allocation for the first time. 21. In the event the respondents are inclined to accept the request of the petitioners, the DGFT may introduce additional conditions / criteria to allocate the TRQ accordingly. 22. This Tender Document has been issued pursuant to the Public Notice No. 31/2025-26 dated 29.10.2025 read along with Trade Notice No. 16/2025-26 dated 29.10.2025 with the intent to carry out e-auction for allocation of Tariff Rate Quota for Gold under India – UAE CEPA (hereafter referred to as “TRQ”). All information provided in this Tender Document should be read together with the Foreign Trade Policy, 2023 (hereafter referred to as “FTP”), Handbook of Procedures, 2023 (hereafter referred to as “HBP”), Public Notices, and the Trade Notices issued by Directorate General of Foreign Trade (hereafter referred to as “DGFT”) thereunder. In the event of a conflict between this Tender Document and the provisions of FTP or HBP, the provisions FTP or the HPB (as amended from time to time), as the case may be, shall prevail. 1.2. It is hereby clarified that for the purposes hereof, till the declaration of final allocations of TRQ, only DGFT is authorized to issue any communication hereunder and only written communication from the DGFT, uploaded on the DGFT Website (www.dgft.gov.in), shall be considered as an official communication. For facilitation of the trade, the said written communication will also be uploaded (till the declaration of TRQ allocations by DGFT) on the e-auction website of MSTC Limited (hereafter referred to as “MSTC”). 1.3. This Tender Document is neither an agreement nor an offer by the DGFT to the prospective Bidders or any other person. The purpose of this Tender Document is to provide interested parties with information that may be useful to them in making their bids pursuant to this Tender Document. In case the day of completion of any requirement is falling due, on a public holiday, the day of completion shall be deemed to be due on the next successive working day. The expression “public holiday” includes Saturday, Sunday and any other day declared to be a public holiday by the Central Government, as the case may be. 1.10. Each Bidder shall be responsible for any problem at the Bidder's end like failure of electricity, loss of internet connection, any trouble with Bidder's computer etc. which may cause inconvenience or prevent the Bidder from bidding in e-auction. 2. Definitions The words and expressions used herein but not defined herein shall have the same meaning as assigned to them in the Act or the Rules made thereunder. The following definitions apply to this Tender Document, unless the context otherwise requires: 2.1. “Act” means the Foreign Trade (Development and Regulation) Act, 1992 as amended from time to time. 2.2. “Applicable Law” shall mean all applicable statutes, laws, by-laws, rules, regulations, orders, ordinances, protocols, codes, guidelines, notices, directions, judgments, decrees or other requirements or official directive of any governmental authority or court or other law, rule or regulation approval from the relevant governmental authority, government resolution, directive, or other government restriction or any similar form of decision of, or determination by, or any interpretation or adjudication having the force of law in India at the relevant point in time. 2.3. “Bidder” means a person who is registered on the MSTC Website (URL: https://www.mstcecommerce.com/eprocn/dgft) for the purpose of participating in the Gold TRQ Auction, and the expression Bidders shall include all such persons. 2.4. “Bid Due Date” shall mean the date on or before which the Technical Bid and the price bid is required to be submitted in accordance with. 2.5. “Bid Security” shall have the meaning given to such expression in Clause 11 of this document. 2.6. “DGFT website” shall mean https://www.dgft.gov.in . 2.7. “Exim Facilitation Committee” shall mean Exim Facilitation Committee (EFC) as defined in the Foreign Trade Policy read along with Handbook of Procedures. 2.8. “Financial Bid/ Price Bid” shall mean the consolidated form in which the required quantities are specified against each Price Bucket. 2.9. “Preferred Bidders” shall mean a Bidder to whom the EFC has allocated any quantity of TRQ, and "Total Allocated TRQ" for such Preferred Bidder means the aggregate quantity of TRQ allocated by the EFC to that Bidder across all Price Buckets. 2.10. “Price Bucket” shall mean the specific price per KG of Gold, in INR, that Bidder is willing to pay to DGFT for the allocated quantity of TRQ in that bucket. For sake of ease, the Tender consists of 51 Price buckets ranging from 100000 to 0 in steps of 2000 each. 2.11. “Section” means Section of the Act. 2.12. “Successful Bidders” shall mean those preferred bidders who satisfy the conditions in Clause 8 of this document. 2.13. “Technical Bid” shall have the meaning given to such expression in Clause 7.2 of this document. 2.14. “Technically Qualified Bidders” shall have the meaning given to such expression in Clause 7.2 2.15. “Tender Document” means this tender document together with the schedules and documents referred to herein, including the Information Memorandum and any addenda to this Tender Document.[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 21 3. Introduction 3.1. The Public Notice no. 31/2025-26 dated 29.10.2025 stipulates for allocation of TRQ through competitive bidding/tender process in respect of Gold under India – UAE CEPA 3.2. In exercise of powers conferred by Section 5 of the Act, the DGFT has notified the eligibility criteria for filing an application for TRQ vide Public Notice no. 31/2025-26 dated 29.10.2025 and other relevant provisions of FTP, 2023 and the procedures notified there under. The Bidders are encouraged to acquaint themselves with the same. 3.3. The e-auction would be conducted in accordance with the above-mentioned provisions of FTP and HBP and this Tender Document. 3.4. The Bidders are expected to conduct due diligence regarding the prevailing prices of Gold in the international market and familiarize themselves with all applicable Laws relating to import of Gold, its physical delivery etc. 4. The Tariff Rate Quota of Gold under India – UAE CEPA 4.1. The India–UAE Comprehensive Economic Partnership Agreement (CEPA), which came into force on 01 May 2022, provides preferential tariff access for specified quantities of gold imported from the United Arab Emirates under the Tariff Rate Quota (TRQ) mechanism. The TRQ aims to promote trade facilitation, ensure predictable import flows, and strengthen bilateral economic engagement. 4.2. Under the CEPA commitments, India has extended concessional Basic Customs Duty (BCD) on a notified quantity of gold imported annually from the UAE as given under Appendix 2A. 4.3. The annual TRQ quantity for gold is allocated as per guidelines notified by DGFT under Annexure-IV of Appendix-2A. The TRQ Authorisation issued under DGFT enable importers to avail concessional duty rates at the time of customs clearance. 5. Eligibility 5.1. Pursuant to the Annexure IV to the Appendix 2A amended vide Public Notice No. -31/2025- 26 dated 29.10.2025; the eligibility for participating in the e- auction shall be as follows: 5.1.1. The eligible applicant must be registered with the Bureau of Indian standards (BIS) for hallmarking. 5.1.2. The applicant shall be a person registered under the applicable Goods and Services Tax (GST) enactments in India and shall hold a valid GST Identification Number (GSTIN). 5.1.3. Import of Gold Dore under TRQ shall not be considered. 6. Pre-bid Conference 6.1. Potential bidders may seek clarifications or request further information regarding this Tender Document. 6.2. Any queries or requests for additional information concerning this Tender Document may be raised through a Helpdesk request on the DGFT website. 6.3. The Helpdesk request should clearly bear the following subject line: “Queries/Request for Additional Information: Tender Document for “Second round of Allocation for TRQ for Gold under India-UAE CEPA”. 6.4. Each query should contain complete details of facts, information and Applicable Law relevant to the query and the particulars of the person posing the query. The DGFT reserves the right to not answer any query, including any query which is incomplete or anonymous. 6.5. The queries should be emailed on or before 3 days prior to the start date of the Bid. 6.6. It is expressly clarified that no queries may be submitted beyond the last date for receipt of queries as indicated above. 6.7. The DGFT shall endeavor to respond to the queries within the period of 3 days. However, the DGFT reserves the right to not respond to any question or provide any clarification, in its sole discretion, and nothing in this Tender Document shall be taken or read as compelling or requiring the DGFT to respond to any question or to provide any clarification. 6.8. Pre-bid conference(s) of the potential bidders shall be convened on the designated date as mentioned in the Trade Notice at a time and place specified by the DGFT. The DGFT may, at its sole22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] discretion, choose to convene the pre-bid conference through virtual mode (or a hybrid of virtual and physical modes) subject to such conditions as may be notified separately by the DGFT. 6.9. A maximum of 1 representative of each potential bidder shall be allowed to participate, on submission of a letter, duly issued authority from the potential bidder and identity documents. The DGFT shall endeavor to provide clarifications and such further information, as it may consider, in its sole discretion, appropriate for facilitating a fair, transparent and competitive tender process. 6.10. The DGFT may also, on its own motion, if deemed necessary, issue interpretations and clarifications to all potential bidders. All clarifications and interpretations issued by the DGFT shall be deemed to be part of the Tender Document. 7. Bidding Process 7.1. Registration: 7.1.1. In order to submit the bids for allocation of TRQ for Gold under India – UAE CEPA, a bidder would be required to register online on MSTC portal. For registration, the Bidder should visit the page dedicated to DGFT on MSTC website URL - “https://www.mstcecommerce.com/eprocn/dgft” and click on the button “Registration”. 7.1.2. An online Registration Form will appear on screen and Bidder will be required to fill the same. During this process, Bidder would be required to create its “user id” and “password” and keep note of the same. Bidder should ensure that the secrecy of its user id and password is maintained at all time and Bidder shall alone be responsible for any misuse of the user id and password. 7.1.3. On completion of the above stated registration process, a Bidder shall be able to log in to MSTC’s website. The bidders shall have a valid Class III Signing and Encryption type Digital Signature Certificate (DSC) for submission of bid in the e-tender. 7.2. Tender Process: 7.2.1. The tender will comprise both “Technical and Financial Bid” components, which must be submitted as per the stipulated terms and conditions. 7.2.2. The Bidders shall be required to submit the bid on or prior to “Bid Due Date”. 7.2.3. The tender will contain a single lot with technical bid, document upload for qualification and excel based price bid. The bidder has to submit participation fee of Rs 5000/- plus GST and bid security of Rs. 1,00,000/- before uploading of documents and submission of bid. 7.2.4. The Technical Bid comprises the submission of documents required for technical qualification showing valid GST Registration of the bidder, valid hallmark registration of the bidder, valid Import Export Code (IEC), valid MSME certificate (in case of Micro, Small and Medium Enterprises) and submission of remarks against submitted technical documents, if any. All requisite technical documents must be uploaded by the bidder strictly in accordance with the tender requirements. 7.2.5. Once the documents have been uploaded and technical bid submitted by the bidder, the bidder shall proceed to submit the financial/price bid. 7.2.6. The Excel-based Price Bid shall comprise 51 price buckets. The bidder is required to indicate the quantity he intends to bid against interested price buckets (the specific price per KG of Gold, in INR, that Bidder is willing to pay to DGFT for the allocated quantity of TRQ in that bucket). Bidders may choose to quote for any number of price buckets, as per their preference. All quantities must be entered only in whole numbers that are multiples of 5. The format of the excel based price bid is as follows: 7.2.7. The bidder shall download the Excel sheet available under the Financial Bid section. The bidder must duly fill in the required quantity details against interested price buckets (Each price bucket mentions the in the Excel sheet and save the file with the same filename before uploading it under the Financial Bid section. 7.2.8. After uploading the Excel sheet, the bidder shall click on “Final Bid Submission” to successfully submit the bid on the MSTC portal. 7.3. The Technically qualified bidders are those who have fulfilled the eligibility conditions and submitted the required documents evidencing the same in the technical bid. 7.4. The financial bids shall be opened only for those bidders who are technically qualified as per the extant rules notified by DGFT.[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 23 7.5. DGFT is not obliged to provide any explanation or clarification on the disqualification to Bidders who fail to qualify as Technically Qualified Bidders. 7.6. The List of the Financial Bids of the technically qualified bidders will be submitted to the Exim Facilitation Committee (EFC). The EFC will further allocate the Quantities, less than or equal to the bid Quantities subject to such limits as deemed fit. Such bidders to whom the EFC has allocated the TRQ are considered as Preferred Bidders. 7.7. The Bidder may note that only one user id will be mapped with a given Class III Signing and Encryption type DSC. It will be the sole responsibility of the Bidder to maintain the secrecy of the password for the Class III Signing and Encryption type Digital Signature Certificate. The Bidder shall be solely responsible for any misuse of the Class III Signing and Encryption type DSC and no complaint / representation in this regard shall be entertained at any stage by MSTC/ DGFT. 8. Declaration of Successful Bidders 8.1. The Preferred Bidders will be declared as successful Bidders only on completion of the following actions: 8.1.1. Satisfy the conditions specified in Annexure-IV to the Appendix 2A of the FTP, 2023 and any other conditions subsequently mentioned in the Public Notice/ Trade Notice issued by DGFT. 8.1.2. File a TRQ Application on the DGFT website by following the link below- (https://dgft.gov.in) --> Import Management System -->Tariff Rate Quota (TRQ) 8.1.3. Payment of bid amount for the quantity allocated by EFC to DGFT, through TRQ Application filed on DGFT Website, within a period prescribed in the Minutes of EFC Meeting. 8.2. The Successful Bidder is entitled to refund of the Bid Security deposited by him during the Technical Bid process within a period of 4 weeks as detailed at Clause 11 of the Tender document. 8.3. In case the Preferred Bidder fails to submit the bid amount within the period mentioned above, the DGFT shall forfeit the Bid Security of the Preferred Bidder; and disqualify the bidder for further allocations during the current and the subsequent financial year. 9. Timetable The timetable of the tender process will be given in the Trade Notice issued by DGFT. The timetable may be amended by the DGFT through issuance of a subsequent Corrigendum. 10. General Conditions Regarding Tender Process 10.1. Submission of Technical Bid 10.1.1. The Technical component comprises the submission of documents required for technical qualification showing valid GST Registration of the bidder, valid hallmark registration of the bidder, valid IEC Number, valid MSME certificate (in case of Micro, Small and Medium Enterprises) and submission of remarks against technical commercial specifications. All requisite technical documents must be uploaded by the bidder strictly in accordance with the tender requirements. 10.1.2. Once the documents have been uploaded and technical bid submitted by the bidder, the bidder shall proceed to submit the financial/price bid. 10.2. Language The Bid and all communications in relation to or concerning the Tender Document and the Bid are required to be in the English language.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 10.3. Documents and information The documents including this Tender Document and all attached documents, provided by the DGFT are and shall remain or become the properties of the DGFT and are transmitted to the Bidders solely for the purpose of preparation and the submission of a bid in accordance with applicable laws. Bidders shall not use it for any purpose other than for preparation and submission of their bid. The provisions of this Clause shall also apply to bids and all other documents submitted by the Bidders in relation to the bid, and the DGFT will not return to the Bidders any bid, document or any information provided along therewith. 10.4. Cost of bidding The Bidders shall be responsible for all the costs associated with the preparation of their bids and their participation in the tender process. The DGFT will not be responsible or in any way liable for such costs, regardless of the conduct or outcome of the tender process. 10.5. Verification of information by the Bidders 10.5.1. It shall be deemed that by submitting a bid, the Bidder has: (a) Made a complete and careful examination of the Tender Document and unconditionally and irrevocably accepted the terms thereof. (b) reviewed all relevant information provided by the DGFT, as maybe relevant to the bid. (c) accepted the risk of inadequacy, error or mistake in the information provided in the Tender Document or furnished by or on behalf of the DGFT relating to any of the matters related to the e-auction process. (d) Satisfied itself about all matters regarding the e-auction process for submitting an informed bid, in accordance with this Tender Document and performance of all its obligations. (e) Acknowledged and agreed that inadequacy, lack of completeness or incorrectness of information provided in the Tender Document or ignorance of any of the matters related to the e-auction process hereinabove shall not be a basis for any claim for compensation, damages, extension of time for performance of its obligations, loss of profits etc. from the DGFT. (f) Agreed to be bound by the undertakings provided by it under and in terms hereof. 10.5.2. The DGFT shall not be liable for any omission, mistake or error in respect of any of the information provided or on account of any matter or thing arising out of or concerning or relating to the Tender Document or the tender process, including any error or mistake therein or in any information or data given by the DGFT. 10.6. Verification by the DGFT and debarment The DGFT reserves the right to verify all statements, information and documents submitted by the Bidder in response to the Tender Document and the Bidder shall, when so required by the DGFT, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification by the DGFT shall not relieve the Bidder of its obligations or liabilities hereunder nor will it affect any rights of the DGFT there under. 10.7. Bid Due Date and extension The DGFT may, in its sole discretion, extend the Bid Due Date by issuing a Trade Notice that is made available to all Bidders on the DGFT website. 10.8. Modifications/substitution/withdrawal of bids The Bidder may modify, substitute or withdraw its Technical Bid after submission, prior to the Bid Due Date. No Technical Bid shall be modified, substituted or withdrawn by the Bidder after the scheduled closing time for Bid submission on the Bid Due Date, unless the same has been expressly sought by the DGFT. 10.9. Rejection of bids 10.9.1. Notwithstanding anything contained in this Tender Document, the DGFT reserves the right to reject any bid and/or to annul the tender process and reject all bids at any time without any liability or any obligation for such acceptance, rejection or annulment, and without assigning any reasons thereof.[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 25 10.9.2. Incase such cancellation is pursuant to non-compliance by the relevant Bidders vis-à-vis submissions of bid then the DGFT reserves the right to appropriate the relevant Bid Security submitted by such non-compliant Bidders. 10.9.3. The DGFT reserves the right not to proceed with the tender process at any time, without notice or liability, and to reject any bid without assigning any reasons. 10.9.4. Without prejudice to the generality of the foregoing, the DGFT reserves the right to reject any bid on any criteria specified in this Tender Document, including without limitation, such bids that: (a) have not been submitted with all the information and details listed in this Tender Document. (b) are not conforming to the terms of this Tender Document. (c) Bids have been submitted without Bid Security or period of validity. (d) Bids have otherwise not been submitted in accordance with the Tender Document. 10.10. Validity of bids The price bid given in the bid is valid till the final allocation of TRQ by the EFC or annulment/cancellation of Tender Process whichever is later. 10.11. Change affecting the Bidder Upon submission of the Technical Bid, any change affecting the Bidder regarding compliance with the eligibility conditions shall result in disqualification of the Bidder. Any change in any information submitted by the Bidder must be immediately communicated to the DGFT. 10.12. Minor deviations The DGFT may permit minor deviations from the requirements of this Tender Documents. It is clarified that such minor deviation would not be permitted in matters related to eligibility and shall be permitted only with respect to procedural requirements. The decision of the DGFT regarding what constitutes minor deviation shall be final and binding. 11. Bid Security 11.1. The Bidder shall furnish as part of its Technical Bid, a security of an amount of INR 1,00,000/- on MSTC portal. 11.2. Save and except as provided in this Tender Document, the Bid Security of Unsuccessful Bidders will be returned by the DGFT, without any interest, within a period of 4 (four) weeks from the date of declaration of the Preferred Bidder or annulment of the tender process as per the provisions of the Tender Document, whichever is earlier. 11.3. The Preferred Bidder’s Bid Security will be returned to the bidder within a period of Four weeks from the successful payment of Bid amount to DGFT for issuance of TRQ Certificate for the allocated Quantity. 11.4. The DGFT shall be entitled to forfeit and appropriate Bid Security as damages, if the preferred bidder fails to deposit the bid amount, along with the TRQ application to DGFT, within the prescribed time. No relaxation of any kind on Bid Security shall be given to any Bidder. 11.5. The Bid Security shall be forfeited as damages without prejudice to any other right or remedy that may be available to the DGFT under the Tender Document and/, or otherwise, under, inter alia, if a Bidder engages in a Fraudulent Practice, Coercive Practice or Restrictive Practice as specified in Clause 12 of this Tender Document. 12. Fraud Practices 12.1. The Bidders and their respective officers, employees, agents and advisers shall observe the highest standard of ethics during the tender process. Notwithstanding anything to the contrary contained herein, the DGFT may reject a bid, as the case may be, without being liable in any manner what so ever to the Bidder, Technically Qualified Bidder, Preferred Bidder, or the Successful Bidder, as the case may be, if the DGFT determines that the Bidder, Technically Qualified Bidder, Preferred Bidder, or Successful Bidder, as the case may be, has, directly or indirectly or through an agent, engaged in Fraudulent Practice, Coercive Practice or Restrictive Practice in the tender process. In such an event, the DGFT shall be entitled to forfeit and appropriate the entire Bid Security, as damages, without prejudice to any other right or remedy that may be available under the Tender Document and/ or otherwise.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 12.2. If a Bidder, Technically qualified Bidder, Preferred Bidder or Successful Bidder, as the case maybe, is found by the DGFT to have directly or indirectly or through an agent, engaged or indulged in any Fraudulent Practice, Coercive Practice or Restrictive Practice during the tender process, such Bidder or Successful Bidder shall be put in Denied Entity List (DEL) maintained by DGFT and will not be eligible to participate in any tender issued by the DGFT for a period of 3 (three) years from the date such Bidder or Successful Bidder, as the case maybe, found by the DGFT to have directly or indirectly or through an agent, engaged or indulged in any Fraudulent Practice, Coercive Practice or Restrictive Practices, as the case maybe. 12.3. For the purposes of this Tender Document, the following terms shall have the meaning hereinafter, respectively assigned to them: 12.3.1. “Fraudulent Practice” means a misrepresentation or omission of facts or suppression of facts or disclosure of incomplete facts, in order to influence the tender process. 12.3.2. “Coercive Practice” means impairing or harming, or threatening to impair or harm, directly or indirectly, any person or property to influence any person’s participation or action in the tender process; and 12.3.3. “Restrictive Practice” means forming a cartel or arriving at any understanding or arrangement among Bidders with the objective of restricting or manipulating a full and fair competition in the tender process. 13. Other Provisions 13.1. Governing law The Tender process shall be governed by, and construed in accordance with, the laws of India. 13.2. Right of DGFT 13.2.1. The DGFT, in its sole discretion and without incurring any obligation or liability, reserves the right, at any time, to: (a) Suspend and/ or cancel the tender process and/ or amend and/ or supplement the tender process or modify the dates or other terms and conditions relating thereto; (b) Consult with any Bidder in order to receive clarification or further information; (c) Retain any information and/or evidence submitted to the DGFT by, on behalf of, and/or in relation to any Bidder; and/ or (d) Independently verify, disqualify, reject and/ or accept any and all submissions or other information and/or evidence submitted by or on behalf of any Bidder. 13.2.2. It shall be deemed that by submitting the bid, the Bidder agrees and releases the DGFT, its employees, irrevocably, unconditionally, fully and finally from any and all liability for claims, losses, damages, costs, expenses or liabilities in any way related to or arising from the exercise of any rights and/ or performance of any obligations hereunder, pursuant hereto and/ or in connection with the tender process and waives, to the fullest extent permitted by Applicable Law, any and all rights and/or claims it may have in this respect, whether actual or contingent, whether present or in future. 13.3. Proprietary data All documents and other information supplied by a Bidder to the DGFT/MSTC shall remain with the DGFT/MSTC. 13.4. Digital Signature Certificate 13.4.1. A Bidder shall be required to possess a valid Class III Signing and Encryption Digital Signature Certificate (DSC) of signing and encryption combo type to be able to submit its Bid and to participate in the electronic auction on MSTC website. For this purpose, Bidders shall be required to procure a class III DSC of signing and encryption type from any Certifying Authority or their authorized agencies in India. The Bidder may note that only one user id will be mapped with a given Class III Signing and Encryption DSC. The Class III Signing and Encryption Digital Signature Certificate will be used to digitally sign the Bids that the Bidder will submit online. 13.4.2. It will be the sole responsibility of the Bidder to maintain the secrecy of the password for the Class III Signing and Encryption Digital Signature Certificate.
