(1) इन जनयमों का संजिप्त नाम राष्ट्रीय रािमागग फीस (िरों का अवधारण और सग्रं हण) जनयम, 2024 ह ै। (2) ये इनके रािपत्र में प्रकािन की तारीख को प्रवृत्त होंगे । 2. राष्ट्रीय रािमाग ग फीस (िरों का अवधारण और सग्रं हण) जनयम, 2008 (जिसे इसमें इसके पश्चात् उि जनयम कहा गया ह)ै के जनयम 2 के उपजनयम (1) म,ें- (i) खंड (घक) में, “फीस उद्गृहीत की िाती ह”ै िब्िों के पश्चात ्जनम्नजलजखत अतं ःस्ट्र्ाजपत दकया िाएगा, अर्ागत:् - “और ग्लोबल नेजवगेिन सेटेलाइट जसस्ट्टम आनबोड ग यूजनट या दकसी ऐसी जडवाइस या आटोमेटटक नंबर प्लेट टरकागजनिन जडवाइस या फास्ट्टैग या उनके दकसी संयोिन के माध्यम से सग्रं जहत की िाती है”; (ii) खंड (चघ) म,ें “उपयोजगता फीस के इलेक्ट्राजनक सग्रं हण” िब्िों के पश्चात ् जनम्नजलजखत अतं ःस्ट्र्ाजपत दकया िाएगा, अर्ागत:् - 5780 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] “और ग्लोबल नेजवगेिन सेटेलाइट जसस्ट्टम आनबोड ग यूजनट या दकसी ऐसी जडवाइस या आटोमेटटक नंबर प्लेट टरकागजनिन जडवाइस या फास्ट्टैग या उनके दकसी संयोिन के माध्यम से सग्रं हण”; (iii) खंड (चघ) के पश्चात् जनम्नजलजखत खंड अतं ःस्ट्र्ाजपत दकया िाएगा, अर्ातग ्:- ‘(चङ) “ग्लोबल नेजवगिे न सटे ेलाइट जसस्ट्टम आनबोड ग यूजनट” से ग्लोबल नेजवगेिन सेटेलाइट जसस्ट्टम आनबोडग यूजनट से यिु यान में गैर-अंतरणीय और िढ़ृ ता से दफट की गई जडवाइस अजभप्रेत ह;ै’; 3. उि जनयमों के जनयम 6 के उपजनयम (3) के िसू रे परंतुक के पश्चात् जनम्नजलजखत परंतुक अंतःस्ट्र्ाजपत दकया िाएगा, अर्ागत:् - “परंत ु यह और दक ग्लोबल नेजवगेिन सेटेलाइट जसस्ट्टम आनबोडग यूजनट स े युि यान के जलए अनन्य लने जचजननत की िा सकेगी और यदि ऐसी लेन में कोई यान जवजधमान्य आनबोडग यूजनट के जबना प्रवेि करता है, तो उस फीस प्लािा पर लागू उपयोजगता फीस के िो गुना के समतुल्य फीस संित्त करेगा:”। 4. उि जनयमों के जनयम 9 के उपजनयम (4) के पश्चात ्जनम्नजलजखत उपजनयम अतं ःस्ट्र्ाजपत दकया िाएगा, अर्ागत:् - “(5) राष्ट्रीय अनुज्ञा यान से जभन्न यांजत्रक यान का ड्राइवर, स्ट्वामी या भारसाधक व्यजि, िो, यर्ाजस्ट्र्जत, राष्ट्रीय रािमागग के उसी खंड, स्ट्र्ाई पुल, बाइपास या सुरंग का प्रयोग करता है, उससे ग्लोबल नेजवगेिन सेटेलाइट जसस्ट्टम पर आधाटरत उपयोजगता फीस संग्रहण प्रणाली के अधीन एक दिन में प्रत्येक दििा में बीस दकलोमीटर तक की यात्रा के जलए िन्ू य उपयोजगता फीस उद्ग्रजहत की िाएगी और यदि तय की गई यात्रा बीस दकलोमीटर स े अजधक ह,ै तब यात्रा की वास्ट्तजवक िरू ी के जलए फीस प्रभाटरत की िाएगी ।”। [फा. सं. एच-25016/01/2023-टोल] सुमन प्रसाि ससंह, संयिु सजचव टटप्पण: मूल जनयम भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में अजधसूचना सं. सा.का.जन. 838(अ), तारीख 5 दिसंबर, 2008 द्वारा प्रकाजित की गई र्ी और अजधसूचना सं. सा.का.जन. 725(अ), तारीख 6 अिूबर, 2023 द्वारा अंजतम संिोधन दकया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 9th September, 2024 S.O. 3856(E).—In exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956), the Central Government hereby makes the following rules further to amend the National Highways Fee (Determination of Rates and Collection) Rules, 2008, namely:- 1. (1) These rules may be called the National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the said rules), in sub-rule (1) of rule 2,- (i) in clause (da) after the words “highway or expressway”, the following shall be inserted, namely:- “and collected through Global Navigation Satellite System On-Board Unit or any such device or Automatic Number Plate Recognition Device or FASTag or any combination thereof”; (ii) in clause (hd), after the words “user fees”, the following shall be inserted, namely:- “through Global Navigation Satellite System On-Board Unit or Automatic Number Plate Recognition Device or FASTag or any combination thereof”; (iii) after clause (hd), the following clause shall be inserted, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 ‘(he) “Global Navigation Satellite System On-Board Unit” means a non-transferable and firmly fitted device in a vehicle linked to Global Navigation Satellite System based user fee collection;’; 3. In rule 6 of the said rules, in sub-rule (3), after the second proviso, the following proviso shall be inserted, namely:- “Provided also that exclusive lane can be earmarked for Global Navigation Satellite System On-Board Unit fitted vehicle and in case vehicle enters such lane, without a valid, functional Global Navigation Satellite System On-Board Unit, shall pay a fee equivalent to two times of the user fee applicable at that fee plaza:”. 4. In rule 9 of the said rules, after sub-rule (4), the following sub-rule shall be inserted, namely:- “(5) A driver, owner or person in-charge of a mechanical vehicle other than National Permit vehicle who makes use of the same section of national highway, permanent bridge, bypass or tunnel, as the case may be, shall be levied a zero-user fee upto twenty kilometers of journey in each direction in a day under Global Navigation Satellite System based user fee collection system and if the distance travelled is more than twenty kilometers, then fee will be charged for actual distance travelled.”.
