(1) इन जनयमों को प्रेस और जनयतकाजलक पजत्रका रजिस्ट्रीकरण जनयम, 2024 कहा िाएगा। 137 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) य ेआजधकाटरक रािपत्र म ेंइसके प्रकािन की तारीख से प्रभावी होंगे। (3) इनका जवस्ट्तार सम्पूण ण भारत तक होगा। पटरभाषाएं 2. (1) इन जनयमों म,ें िब तक दक संिभण से अन्यथा अपेजित न हो,- (क) 'अजधजनयम' से प्रेस और जनयतकाजलक पजत्रका रजिस्ट्रीकरण अजधजनयम, 2023 अजभप्रेत ह;ै (ख) 'भारत कोष' से दकसी भी िुल्क/िुमाणने/अन्य धन को सरकारी खाते में िमा करने के जलए भारत सरकार की ऑनलाइन सेवा सवंडो अजभप्रेत ह;ै (ग) 'केंद्रीय संचार ब्यूरो' से संचार के जवजभन्न माध्यमों - ऑजडयो-जवज़ुअल, सप्रंट, इलेक्ट्रॉजनक, जडजिटल, प्रििणजनयों, बाहरी कायणकलापों का उपयोग करके जवज्ञापन और आउटरीच कायणकलापों के माध्यम से सरकारी नीजतयों और कायणक्रमों पर िानकारी के प्रसार के जलए केंद्र सरकार का संबद्ध कायाणलय अजभप्रेत ह;ै (घ) ‘जवत्तीय वषण’ से प्रत्येक वषण माचण के 31वें दिन समाप्त होन े वाली अवजध अजभप्रेत ह;ै (ङ) 'नेिनल ससंगल सवंडो जसस्ट्टम' (एनएसडब्ल्यूएस) से केंद्र सरकार का जडजिटल प्लेटफॉम ण (https://www.nsws.gov.in) अजभप्रेत ह ै िो जवजभन्न अनुमोिनों, अनुमजतयों और पंिीकरणों के जलए व्यजियों की पहचान करन ेऔर आवेिन करने म ेंमागणििणन करता ह;ै (च) 'मंत्रालय' से सूचना और प्रसारण मंत्रालय, भारत सरकार अजभप्रेत ह;ै (छ) 'प्रेस सूचना ब्यरू ो' से प्रेस जवज्ञजप्त, प्रेस नोट्स, फीचर लेख, बैकग्राउंडर, प्रेस ब्रीफफंग, सािात्कार, प्रेस कॉन्रेंस, प्रेस टूर सजहत जवजभन्न हस्ट्तिेपों और कायणकलापों के माध्यम से सरकारी नीजतयों, कायणक्रमों, पहलों और उपलजब्धयों पर सप्रंट, इलेक्ट्रॉजनक और सोिल मीजडया पर िानकारी प्रसाटरत करने के जलए केंद्र सरकार का संबद्ध कायाणलय अजभप्रते ह;ै (ि) 'प्रेस सेवा पोटणल' से प्रेस रजिस्ट्रार िनरल द्वारा अजधजनयम के तहत यथापेजित जवजभन्न आवेिन, सूचनाएं और ऐस े अन्य िस्ट्तावेि, फॉमण, जनयतकाजलक पजत्रका के रजिस्ट्रीकरण प्रमाण पत्र और वार्षणक जववरण के प्रारूप, जिसमें जनम्नजलजखत िाजमल ह,ैं प्राप्त करने के जलए जवकजसत ऑनलाइन पोटणल अजभप्रते ह;ै (i) दकसी जनयतकाजलक पजत्रका के मुद्रक द्वारा सूचना; (ii) दकसी जविेिी जनयतकाजलक पजत्रका के प्रजतकृजत संस्ट्करण का रजिस्ट्रीकरण; (iii) दकसी जनयतकाजलक पजत्रका के रजिस्ट्रीकरण का प्रमाण पत्र प्राप्त करने के जलए प्रकािक द्वारा आवेिन पत्र; (iv) रजिस्ट्रीकरण प्रमाणपत्र में संिोधन के जलए आवेिन पत्र; (v) रजिस्ट्रीकरण प्रमाणपत्र के स्ट्वाजमत्व के हस्ट्तांतरण के जलए आवेिन पत्र; (vi) दकसी जनयतकाजलक पजत्रका के रजिस्ट्रीकरण प्रमाणपत्र का प्रारूप; (vii) दकसी जनयतकाजलक पजत्रका के प्रकािक द्वारा वार्षणक जववरण प्रस्ट्तुत करने का प्रारूप; (viii) िीषणक आवंटन के जलए दििाजनिेि; (ix) दकसी जनयतकाजलक पजत्रका के प्रसार के सत्यापन के जलए डेस्ट्क ऑजडट की प्रदक्रया; (2) इन जनयमों में 'प्रपत्रों' के सभी संिभों को प्रेस सेवा पोटणल में जनधाणटरत प्रपत्रों के संिभ णके रूप म ेंमाना िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (3) यहां प्रयिु और पटरभाजषत नहीं दकए गए लेदकन अजधजनयम में पटरभाजषत अन्य सभी िब्िों और अजभव्यजियों के क्रमिः वही अथण होंगे िो उन्ह ेंअजधजनयम म ेंदिए गए ह।ैं भाग II - एक मद्रु क द्वारा सचू ना 3. (1) दकसी जनयतकाजलक पजत्रका का मुद्रक, दकसी जनयतकाजलक पजत्रका की सप्रंटटंग प्रसे िुरू करन े के पंद्रह दिनों के भीतर, प्रेस रजिस्ट्रार िनरल और जनर्िष्टण प्राजधकारी, जिसके अजधकार िेत्र में सप्रंटटंग प्रेस जस्ट्थत ह,ै को प्रेस सेवा पोटणल म ें जनर्िष्टण जववरण और िस्ट्तावेज िेते हुए प्रेस सेवा पोटणल पर एक सूचना भेिेगा। (2) िहा,ं उप-जनयम (1) के तहत सूचना भेिने के बाि, सूचना में उजल्लजखत जववरणों में कोई पटरवतणन होता ह,ै मुद्रक प्रेस रजिस्ट्रार िनरल और जनर्िष्टण प्राजधकारी को जववरणों के पटरवतणनों के बारे में सूजचत करेगा। (3) िहा ं जववरण म ें पटरवतणन सप्रंटटंग प्रेस के स्ट्थान म ें पटरवतणन से संबंजधत ह ै िो दकसी अन्य जनर्िष्टण प्राजधकारी के स्ट्थानीय अजधकार िेत्र के अतं गतण आता हो, मुद्रक प्रेस सेवा पोटणल पर प्रसे रजिस्ट्रार िनरल और अन्य जनर्िष्टण प्राजधकारी को एक नई सूचना ऑनलाइन भेिेगा और उस जनर्िष्टण प्राजधकारी को भी सूजचत करेगा जिसे मूल सूचना भेिी गई थी। भाग III - एक जविेिी जनयतकाजलक पजत्रका के प्रजतकृजत सस्ट्ं करण का रजिस्ट्रीकरण 4. (1) एक भारतीय इकाई भारत म ें एक जविेिी जनयतकाजलक पजत्रका के प्रजतकृजत संस्ट्करण को प्रकाजित करन े के जलए केंद्र सरकार से अनुमोिन प्राप्त करने के जलए मंत्रालय द्वारा इस उद्देश्य के जलए तैयार दकए गए और नेिनल ससंगल सवंडो जसस्ट्टम पर उपलब्ध दििाजनिेिों के अनुसार निे नल ससगं ल सवंडो जसस्ट्टम पर आवेिन करेगी। (2) मंत्रालय उप-जनयम (1) म ें जनर्िष्टण आवेिन पर कारणवाई करने के बाि, और आवेिन के संबंध में इकाई से दकसी भी अजतटरि िानकारी की मांग करने के बाि, प्रजतकृजत संस्ट्करण के प्रकािन के जलए अनुमोिन में जनर्िष्टण जनयमों और ितों के साथ इकाई को अनुमोिन िेगा और इसे निे नल ससंगल सवंडो जसस्ट्टम पर संप्रेजषत करेगा। (3) िहां मंत्रालय की राय ह ै दक अनुमोिन नहीं दिया िा सकता है, वह एक जलजखत आििे द्वारा अस्ट्वीकृजत के कारणों के साथ अपना जनणणय बताएगा, और उसे नेिनल ससंगल सवंडो जसस्ट्टम पर सूजचत दकया िाएगा। (4) भारतीय इकाई, उप-जनयम (2) के तहत मंिूरी जमलन े के पंद्रह दिनों के भीतर, भारत म ें जविेिी जनयतकाजलक पजत्रका, के प्रजतकृजत संस्ट्करण के प्रकािन के जलए रजिस्ट्रीकरण प्रमाण पत्र िेन े के जलए प्रेस सेवा पोटलण म ें जनर्िष्टण िस्ट्तावेिों के साथ संलग्न करके, और उसमें जनर्िष्टण भुगतान के दकसी भी तरीके से भारत कोष पर िस हिार रुपये की फीस का भुगतान कर प्रेस सेवा पोटणल पर प्रेस रजिस्ट्रार िनरल को आवेिन करेगी। (5) प्रेस रजिस्ट्रार िनरल आवेिन पर कारणवाई करेगा, और आवेिन की िुद्धता और पणू तण ा से संतुष्ट होने के बाि, और आवेिन को संसाजधत करने के जलए इकाई से प्राप्त होने वाली दकसी भी अजतटरि िानकारी या मंत्रालय से प्रेस सेवा पोटणल पर, प्राप्त टटप्पजणयों यदि कोई हों, पर जवचार करेगा और जविेिी जनयतकाजलक पजत्रका के प्रजतकृजत संस्ट्करण के भारत म ें प्रकािन के जलए इकाई को रजिस्ट्रीकरण का प्रमाण पत्र िारी कर सकता ह।ै (6) इकाई उप-जनयम (5) के तहत प्रेस रजिस्ट्रार िनरल द्वारा रजिस्ट्रीकरण प्रमाणपत्र प्रिान करन े के बाि ही भारत म ें प्रजतकृजत संस्ट्करण का प्रकािन िुरू करेगी। बिते दक िहां कोई इकाई रजिस्ट्रीकरण प्रमाणपत्र िेन े स े पहले भारत म ें प्रजतकृजत संस्ट्करण का प्रकािन िरूु कर िे, प्रेस रजिस्ट्रार िनरल रजिस्ट्रीकरण प्रमाणपत्र िेन े से अस्ट्वीकृजत कर सकता ह ै और ऐसे प्रकािन के संबंध में मंत्रालय को भी सूजचत कर सकता ह।ै (7) िहां मंत्रालय उप-जनयम (5) के तहत रजिस्ट्रीकरण प्रमाणपत्र िेन े से पहले भारत में प्रजतकृजत संस्ट्करण के प्रकािन के संबंध में स्ट्वयं या प्रेस रजिस्ट्रार िनरल या दकसी अन्य प्राजधकारी से प्राप्त िानकारी के आधार पर, उप-जनयम (2) के तहत इसके द्वारा दिए गए अनुमोिन को जनलंजबत या रद्द कर सकता ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] भाग IV - रजिस्ट्रीकरण प्रमाणपत्र प्रिान करना धारा 7 के अतं गतण दकसी जनयतकाजलक पजत्रका के रजिस्ट्रीकरण का प्रमाण पत्र प्रिान करना 5. (1) एक जनयतकाजलक पजत्रका िुरू करने का इरािा रखने वाले प्रकािक को प्रेस सेवा पोटणल पर उपलब्ध प्रेस रजिस्ट्रार िनरल द्वारा िारी िीषणक आवंटन पर दििाजनिेिों का पालन सुजनजित करते हुए, प्रेस सेवा पोटणल पर जनर्िष्टण िस्ट्तावेिों के साथ प्रेस सेवा पोटणल पर ऑनलाइन आवेिन करना होगा और उसमें जनर्िष्टण भुगतान के दकसी भी तरीके से भारत कोष म ेंआवेिन के जलए एक हिार रुपये की फीस का भगु तान करना होगा। (2) उप-जनयम (1) में जनर्िष्टण आवेिन प्रेस रजिस्ट्रार िनरल को संबोजधत दकया िाएगा, और उस जनर्िष्टण प्राजधकारी को पृष्ांदकत दकया िाएगा जिसके स्ट्थानीय िेत्राजधकार के भीतर जनयतकाजलक पजत्रका प्रकाजित करन े का प्रस्ट्ताव है, और प्रेस सेवा पोटणल से प्रेस रजिस्ट्रार िनरल और जनर्िष्टण प्राजधकारी को ऑनलाइन भेिा िाएगा। (3) आवेिन के सफल अपलोसडंग पर, प्रेस सेवा पोटणल एक अजद्वतीय 10 अंकों वाल े अल्फान्यूमेटरक आवेिक संिभण संख्या (एआरएन) के साथ एक पावती सृजित करेगा, और प्रकािक और प्रेस रजिस्ट्रार िनरल भजवष्य के सभी पत्राचार और संिभों के जलए एआरएन का उपयोग करेंगे। (4) िहा ं प्रकािक इस प्रकार प्रस्ट्तुत आवेिन में कोई सुधार करना या कोई चूक या त्रुटट िरू करना चाहता ह,ै वह आवेिन प्रस्ट्तुत करन े के तीन दिनों के भीतर ऐसा कर सकता ह।ै (5) प्रेस रजिस्ट्रार िनरल आवेिन की पूणतण ा, अपेजित िुल्क के भुगतान और िस्ट्तावेिों को प्रस्ट्तुत करने, िीषणक आवंटन पर दििाजनिेिों के पालन और आवेिन पर कारणवाई के जलए आवश्यक अन्य जववरणों, के संबंध में सत्यापन करेगा और आवेिन की प्राजप्त के सात कायण दिवसों के भीतर और उप-जनयम (4) के तहत जनर्िष्टण अजतटरि समय में प्रकािक को ऑनलाइन संचार िारी करेगा, जिसमें प्रस्ट्तुत दकए गए आवेिन में कजमयों, यदि कोई हो, को जनर्िष्टण करते हुए, जिसमें संलग्न िस्ट्तावेि, भुगतान या ऐसी कोई कमी, िसै ा दक जनर्िष्टण दकया िा सकता ह,ै िाजमल होगी, जिसे आवेिन पर कारणवाई के जलए हटाया िाना आवश्यक माना िाता ह।ै (6) प्रकािक, उप-जनयम (5) म ें जनर्िष्टण संचार प्राप्त होन े के तीस दिनों की अवजध के भीतर, प्रेस सेवा पोटणल पर कजमयों को िरू करने के जलए सभी अपेजित जववरण और ब्यौरे प्रस्ट्तुत करेगा। बिते दक िहां प्रकािक प्रेस रजिस्ट्रार िनरल द्वारा कजमयों के बारे में सूजचत करने की तारीख से तीस दिनों की अवजध के भीतर कजमयों को िरू करने में जवफल रहता ह,ै तो प्रेस रजिस्ट्रार िनरल द्वारा आवेिन को अस्ट्वीकार कर दिया िा सकता ह।ै (7) प्रेस रजिस्ट्रार िनरल उप-जनयम (2) के तहत प्रस्ट्तुत जववरण सजहत आवेिन पर कारणवाई करेगा , और प्रेस सेवा पोटणल पर जनर्िष्टण प्राजधकारी से प्राप्त टटप्पजणयों, यदि कोई हों, िीषकण की स्ट्वीकायणता के संबंध म ें दििाजनिेिों, को ध्यान म ें रखत े हुए और इसस े संतुष्ट होन े पर, प्रेस सेवा पोटलण म ें जनर्िष्टण प्रारूप म ें प्रकािक को रजिस्ट्रीकरण प्रमाणपत्र िारी करेगा, और प्रेस सेवा पोटणल स ेजनर्िष्टण प्राजधकारी को एक प्रजत भी भेिेगा। (8) िहां जनर्िष्टण प्राजधकारी की टटप्पजणयों पर जवचार करन े के बाि, प्रेस रजिस्ट्रार िनरल की यह राय ह,ै या िहां आवेिन में कमी रह गई ह ै और जनर्िष्टण समय के भीतर प्रकािक द्वारा कजमयों को िरू नहीं दकया गया है, तो रजिस्ट्रीकरण की आवश्यकता नहीं ह,ै यह प्रकािक को इसके कारण बताते हुए एक ऑनलाइन संचार िारी करेगा और प्रेस सेवा पोटणल पर संचार का उत्तर प्रस्ट्तुत करने के जलए प्रकािक को िस दिन का समय िेगा। (9) प्रेस रजिस्ट्रार िनरल, उप-जनयम (8) म ें जनर्िष्टण प्रकािक के जलजखत उत्तर पर जवचार करन े के बाि, या तो रजिस्ट्रीकरण का प्रमाण पत्र ि ेसकता ह ैया जनयतकाजलक पजत्रका का रजिस्ट्रीकरण िेन े से इंकार कर सकता ह।ै बिते दक िहां प्रेस रजिस्ट्रार िनरल यह जनणणय लेता ह ै दक रजिस्ट्रीकरण नहीं दिया िाएगा, वह इसके जलए आधार और कारण जनर्िष्टण करते हुए एक मौजखक आिेि पाटरत करेगा और इसे प्रेस सेवा पोटणल पर प्रकािक को भेिेगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 धारा 8 के अतं गतण रजिस्ट्रीकरण प्रमाणपत्र के जववरण का सिं ोधन 6. (1) एक प्रकािक, जिसे धारा 7 के तहत दकसी जनयतकाजलक पजत्रका के जलए रजिस्ट्रीकरण का प्रमाण पत्र दिया गया ह,ै वह प्रेस सेवा पोटणल पर प्रेस रजिस्ट्रार िनरल को प्रेस सेवा पोटणल में जनर्िणष्ट िस्ट्तावेिों के साथ और उसमें जनर्िष्टण भुगतान के दकसी भी तरीके स े भारत कोष को एक हिार रुपये की फीस का भुगतान करन े पर प्रमाण पत्र के जववरण में संिोधन के जलए आवेिन कर सकता ह।ै (2) जिन जववरणों के जलए प्रमाणपत्र म ें संिोधन के जलए आवेिन दकया िा सकता ह ै उनमें जनम्नजलजखत िाजमल हो सकते ह:ैं (क) जनयतकाजलक पजत्रका की भाषा; (ख) िीषणक आवंटन पर दििाजनिेिों के अनुसार जनयतकाजलक पजत्रका का िीषणक; (ग) जनयतकाजलक पजत्रका के सपं ािक; (घ) जनयतकाजलक पजत्रका का सप्रंटटंग प्रेस; (ङ) राज्य/संघ राज्य िेत्र के भीतर जनयतकाजलक पजत्रका के प्रकािन का स्ट्थान; (च) जनयतकाजलक पजत्रका की आवजधकता। (3) प्रेस रजिस्ट्रार िनरल, उप-जनयम (1) में जनर्िष्टण आवेिन पर कारणवाई करन े के बाि, और , उप-जनयम (2) के खंड (ङ) म ें जनर्िष्टण प्रकािन के स्ट्थान म ें पटरवतणन के कारण जनर्िष्टण प्राजधकारी में पटरवतणन की जस्ट्थजत म ें जनर्िष्टण प्राजधकारी की टटप्पजणयााँ प्राप्त करने के बाि, जिसके अजधकार िेत्र में प्रकािन का नया स्ट्थान जस्ट्थत ह,ै साठ दिनों की अवजध के भीतर, और आवेिन और उसके साथ संलग्न िस्ट्तावेिों की िुद्धता संबंधी जववरण स े संतुष्ट होन े के बाि, अजधमानतः पंद्रह काय ण दिवसों के भीतर जनयतकाजलक पजत्रका के संबंध में रजिस्ट्रीकरण का एक संिोजधत प्रमाण पत्र िारी करेगा और जनर्िष्टण प्राजधकारी को एक प्रजत भी भेिेगा। बिते दक पंद्रह कायण दिवसों में आवेिन की िुद्धता और पणू णता की पुजष्ट करन े के जलए आवेिक से प्रेस रजिस्ट्रार िनरल द्वारा प्राप्त जनर्िष्टण प्राजधकारी की टटप्पजणयां और जववरण, यदि कोई हो, प्राप्त करने म ें लगन े वाला साठ दिन का समय िाजमल नहीं होगा। (4) िहां दकसी जनयतकाजलक पजत्रका का स्ट्वामी, जिसे जनयम 5 के तहत रजिस्ट्रीकरण का प्रमाण पत्र दिया गया ह,ै प्रकािक को बिलने का इरािा रखता ह,ै नए प्रकािक को रजिस्ट्रीकरण के संिोजधत प्रमाण पत्र के जलए आवेिन करना होगा और जनयम 5 के सभी प्रावधान लागू होंगे . धारा 9 के तहत जनयतकाजलक पजत्रका के स्ट्वाजमत्व का हस्ट्तातं रण 7. (1) िहां दकसी जनयतकाजलक पजत्रका का स्ट्वामी, जिसके संबंध म ें जनयम 5 के तहत रजिस्ट्रीकरण प्रमाणपत्र प्रिान दकया गया ह,ै उस जनयतकाजलक पजत्रका के स्ट्वाजमत्व को दकसी अन्य व्यजि या इकाई को हस्ट्तांतटरत करन े का इरािा रखता ह,ै तो ऐसा व्यजि या इकाई अंतटरती के रूप में पटरवतणन के जलए प्रेस सेवा पोटणल पर प्रेस रजिस्ट्रार िनरल को आवेिन करके, प्रेस सेवा पोटलण में जनर्िष्टण िस्ट्तावेिों को सलं ग्न करके, और जनर्िष्टण भुगतान के दकसी भी तरीके से भारत कोष में एक हिार रुपये की फीस का भुगतान करके जनयतकाजलक पजत्रका का स्ट्वाजमत्व प्राप्त करने के जलए आवेिन कर सकता ह।ै (2) आवेिन को अंतटरती द्वारा उस जनर्िष्टण प्राजधकारी को भी पृष्ांदकत दकया िाएगा जिसके स्ट्थानीय िेत्राजधकार के भीतर अंतटरती के व्यवसाय का मुख्य स्ट्थान जस्ट्थत ह,ै और प्रेस सेवा पोटणल से जनर्िष्टण प्राजधकारी को ऑनलाइन भेिा िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) प्रेस रजिस्ट्रार िनरल आविे न पर कारणवाई करेगा और साठ दिनों की अवजध के भीतर उप-जनयम (2) में जनर्िष्टण जनर्िष्टण प्राजधकारी से प्राप्त टटप्पजणयों, यदि कोई हों, पर जवचार करने के बाि, और इसकी िुद्धता और पूणतण ा स े संतुष्ट होन े के बाि। स्ट्वामी द्वारा प्रस्ट्ततु िस्ट्तावेज, जनयतकाजलक पजत्रका के स्ट्वाजमत्व में पटरवतनण की अनुमजत प्रिान करते ह।ैं (4) जनर्िष्टण प्राजधकारी की टटप्पजणयों और अन्य कारकों पर जवचार करन े के बाि, िहां प्रेस रजिस्ट्रार िनरल की राय है, दक स्ट्वाजमत्व में बिलाव की अनुमजत नहीं िी िानी चाजहए, वह स्ट्वामी को इसके कारण बतात े हुए एक ऑनलाइन संचार िारी करेगा और स्ट्वामी को संचार का जलजखत उत्तर प्रस्ट्तुत करन े के जलए िस दिन का समय िेगा। (5) प्रेस रजिस्ट्रार िनरल, उप-जनयम (4) में जनर्िष्टण स्ट्वामी के जलजखत उत्तर पर जवचार करने के बाि या तो स्ट्वाजमत्व म ें बिलाव की अनुमजत ि े सकता ह ै और प्रेस सेवा पोटणल पर बिलाव के जलए जलजखत अनमु जत िारी कर सकता ह,ै या स्ट्वाजमत्व में पटरवतणन की अनुमजत प्रिान करन े से अस्ट्वीकृजत कर सकता ह।ै बिते दक िहां प्रेस रजिस्ट्रार िनरल यह जनणणय लेता ह ैदक स्ट्वाजमत्व पटरवतणन की अनुमजत नहीं िी िाएगी, वह इसके जलए आधार और कारण जनर्िष्टण करते हुए एक स्ट्पष्ट आििे पाटरत करेगा और इसे प्रेस सेवा पोटणल पर जनयतकाजलक पजत्रका के स्ट्वामी को भेिेगा। (6) िहां रजिस्ट्रीकरण प्रमाणपत्र के जववरण में पटरवतणन केवल जनयतकाजलक पजत्रका के स्ट्वाजमत्व में पटरवतणन तक सीजमत ह,ै प्रेस रजिस्ट्रार रजिस्ट्रीकरण का संिोजधत प्रमाणपत्र प्रिान करेगा। बिते दक िहां स्ट्वाजमत्व में पटरवतणन में जनयतकाजलक पजत्रका के अन्य जववरणों में पटरवतनण िाजमल हो, प्रकािक या नया प्रकािक, िैसा भी मामला हो, उप-जनयम (5) के तहत उजल्लजखत जलजखत अनुमजत की प्राजप्त के तीस दिनों के भीतर जनयम 5 के प्रावधानों के अनुसार रजिस्ट्रीकरण प्रिान करने के जलए आवेिन करेगा। (7) िहां दकसी जनयतकाजलक पजत्रका का स्ट्वामी कंपनी अजधजनयम, 2013 के तहत पंिीकृत कंपनी ह,ै और धारा 7 के तहत जनयतकाजलक पजत्रका के रजिस्ट्रीकरण प्रमाण पत्र प्रिान करने के समय कंपनी के िेयरधाटरता पैटनण में िेयरधाटरता पैटनण स े कोई बिलाव होता ह,ै कंपनी में अजधकृत व्यजि प्रेस सेवा पोटणल पर प्रेस रजिस्ट्रार िनरल को दकए गए पटरवतणनों के बारे म ें सूजचत करेगा, जिसमें प्रेस सेवा पोटणल म ें जनर्िष्टण अन्य िस्ट्तावेिों के साथ नए िेयरधारकों के नाम, पते और अन्य जववरणों का पूरा जववरण दिया िाएगा। धारा 10 के अतं गतण दकसी जनयतकाजलक पजत्रका को बिं करना 8. िहां दकसी जनयतकाजलक पजत्रका का स्ट्वामी, जिसे धारा 7 के तहत रजिस्ट्रीकरण का प्रमाण पत्र दिया गया ह,ै जनयतकाजलक पजत्रका का प्रकािन बंि करने का जनणणय लेता है, तो उससे ऐसे बंि होने के छह महीन े के भीतर, प्रेस रजिस्ट्रार िनरल और जनर्िष्टण प्राजधकारी को इस तरह की समाजप्त के संबंध में प्रेस सेवा पोटणल पर ऑनलाइन सूचना भेिनी होगी। भाग V - जवजवध धारा 12 के तहत प्रस्ट्ततु दकया िान ेवाला वार्षकण जववरण 9. (1) एक प्रकािक जिसे धारा 7 के तहत रजिस्ट्रीकरण का प्रमाण पत्र दिया गया ह,ै उसे जपछले जवत्तीय वषण के संबंध में एक कैलेंडर वषण के 31 मई तक प्रेस सेवा पोटणल पर एक वार्षणक जववरण प्रस्ट्तुत करना होगा, जिसमें इस उद्देश्य के जलए प्रेस सेवा पोटलण म ेंउजल्लजखत और जनर्िष्टण जववरण और िस्ट्तावेज िाजमल होंगे। (2) िहां प्रकािक अपन े जनयंत्रण स े परे पटरजस्ट्थजतयों के कारण उप-जनयम (1) में उजल्लजखत जनधाणटरत जतजथ तक वार्षणक जववरण प्रस्ट्तुत करन े में असमथण ह,ै तो वह प्रेस रजिस्ट्रार िनरल के पूव ण अनुमोिन से वार्षकण जववरण प्रस्ट्तुत करन े म ें िरे ी की पटरजस्ट्थजतयों को ध्यान म ें रखते हुए प्रेस रजिस्ट्रार िनरल द्वारा यथा अनुमत जवस्ट्ताटरत अवजध के भीतर वार्षणक जववरण प्रस्ट्तुत कर सकता ह।ै बिते दक जवस्ट्ताटरत अवजध कैलेंडर वष ण के 31 दिसंबर से अजधक नहीं होगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 धारा 12 के अतं गतण जनयतकाजलक पजत्रका का जवतरण 10. (1) प्रकािक, समाचार पत्र के प्रकािन के 48 घंटों के भीतर, समाचार पत्र का इलेक्ट्रॉजनक संस्ट्करण प्रेस सेवा पोटणल पर अपलोड करेगा। (2) दकसी राज्य/संघ राज्य िेत्र म ें प्रकािक को समाचार पत्र की भौजतक प्रजत, हर महीन,े उन सभी दिनों के जलए, जिनके जलए अखबार जपछले महीन े के िौरान प्रकाजित होता ह,ै के पाचं वें दिन उस राज्य/संघ राज्य िेत्र में जस्ट्थत प्रेस सूचना ब्यरू ो के कायाणलय में पहुचं ानी होगी। बिते दक प्रकािक अपनी सुजवधानुसार समाचार पत्र की एक प्रजत प्रेस सूचना ब्यूरो के कायाणलय में अजधक बार पहुचं ा सकता ह।ै बिते दक दकसी राज्य/संघ राज्य िेत्र में िहां पीआईबी का कोई कायाणलय नहीं है, प्रेस रजिस्ट्रार िनरल प्रकािक से समाचार पत्र प्राप्त करने के जलए उस राज्य/सघं राज्य िेत्र म ेंमंत्रालय के तहत एक अजधकारी को अजधकृत करेगा। (3) दकसी राज्य/सघं राज्य ित्रे में प्रकािक अखबार की भौजतक प्रजत, हर महीन,े उन सभी दिनों के जलए, जिनके जलए अखबार जपछले महीने के िौरान प्रकाजित होता ह,ै के पांचवें दिन राज्य सरकार/संघ राज्य िेत्र प्रिासन के ऐसे कायाणलय को जवतटरत करेगा, जिसे राज्य सरकार/संघ राज्य िेत्र प्रिासन द्वारा इस उद्देश्य के जलए अजधकृत दकया िा सकता ह।ै बिते दक प्रकािक अपनी सुजवधानुसार समाचार पत्र की एक प्रजत इस प्रकार अजधकृत कायाणलय में अजधक बार पहुचं ा सकता ह।ै (4) यह सुजनजित करन े के जलए दक क्ट्या समाचार पत्र लगातार प्रकाजित हो रहा है, धारा 11 की उपधारा (1) के खडं (ख) म ें जनर्िष्टण जनयम (1) से (3) के अनुपालन पर जवचार दकया िाएगा। धारा 6 के तहत प्रेस रजिस्ट्रार िनरल द्वारा जनयतकाजलक पजत्रका के पटरचालन संबंधी आंकडों का सत्यापन। 11. (1) प्रेस रजिस्ट्रार िनरल जनम्नजलजखत वगों और श्रेणी के संबधं में, इस जनयम के तहत जनधाटण रत तरीके से, दकसी जनयतकाजलक पजत्रका के पटरचालन संबंधी आंकडों को सत्याजपत कर सकता ह:ै (क) एक िैजनक समाचार पत्र, जिसकी जपछल े िो जवत्तीय वषों में धारा 12 की उप-धारा (1) के तहत प्रस्ट्ततु वार्षणक जववरण में टरपोट णदकया गया ह,ै प्रत्येक दिन औसतन पच्चीस हिार प्रजतयां या उससे अजधक का पटरचालन होता ह,ै और केंद्र सरकार के जवज्ञापन प्राप्त करने के उद्देश्य से केंद्रीय संचार ब्यूरो के साथ सूचीबद्ध है; (ख) एक िैजनक समाचार पत्र, जिसकी जपछले िो जवत्तीय वषों में धारा 12 की उप-धारा (1) के तहत प्रस्ट्तुत वार्षणक जववरण में टरपोट णदकया गया ह,ै प्रत्येक दिन औसतन पच्चीस हिार प्रजतयां या उससे अजधक का पटरचालन होता ह,ै और केंद्र सरकार के जवज्ञापन प्राप्त करने के उद्देश्य से केंद्रीय संचार ब्यूरो के साथ सूचीबद्ध होन े का इरािा रखता है; और (ग) कोई भी अन्य जनयतकाजलक पजत्रका, जिसे प्रेस रजिस्ट्रार िनरल की राय में, और कारणों को जलजखत रूप में ििण करन े के जलए, उस जनयतकाजलक पजत्रका के संबंध में प्राप्त दकसी भी िानकारी, संिभण या जिकायत को ध्यान में रखते हुए, ऐस े सत्यापन की आवश्यकता होती ह।ै (2) उप-जनयम (1) में जनर्िष्टण दकसी जनयतकाजलक पजत्रका के प्रसार को सत्याजपत करन े के उद्देश्य से, प्रेस रजिस्ट्रार िनरल या उसके द्वारा अजधकृत केंद्र सरकार का कोई भी अजधकारी, प्रेस सेवा पोटणल म ें जनधाणटरत प्रदक्रया के अनुसार नवीनतम वार्षणक जववरण में प्रकािक, द्वारा िी गई िानकारी का डेस्ट्क ऑजडट कर सकता ह ै और पटरचालन संबंधी आंकडे जनधाणटरत कर सकता ह।ै बिते दक प्रेस रजिस्ट्रार िनरल या इस प्रकार अजधकृत अजधकारी, डेस्ट्क ऑजडट करन े के जलए, इलेक्ट्रॉजनक मोड के माध्यम से ऐसी िानकारी या िस्ट्ताविे ों के जलए कह सकता ह ै िो आवश्यक समझे िाएं, और प्रकािक ऐसी िानकारी या िस्ट्तावेिों को इलक्ट्े रॉजनक रूप से प्रिान करेगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बिते यह भी दक डेस्ट्क ऑजडट फेसलेस तरीके से दकया िाएगा, तादक प्रकािक और प्रेस रजिस्ट्रार िनरल या डेस्ट्क ऑजडट करने के जलए अजधकृत अजधकाटरयों के बीच कोई भौजतक इंटरफेस न हो। स्ट्पष्टीकरण : उप-जनयम (2) के प्रयोिन के जलए, नवीनतम वार्षणक जववरण एकिम पूवणवती जवत्तीय वषण या उससे ठीक पहले के वष,ण िो भी नवीनतम हो, के जलए प्रस्ट्तुत जनयतकाजलक पजत्रका जववरण होगा। (3) प्रेस रजिस्ट्रार िनरल धारा 6 के खंड(ख) के प्रावधानों के अनुसार प्रकािक और सप्रंटटंग प्रसे के व्यावसाजयक पटरसर में िस्ट्तावेिों और अन्य िानकारी और टरकॉड ण के भौजतक जनरीिण के माध्यम से पटरचालन का सत्यापन केवल जनम्नजलजखत जस्ट्थजतयों म,ें कर सकता ह ैअथातण : (क) िहा ंप्रकािक जनयजमत रूप से धारा 12 के तहत आवश्यक वार्षणक जववरण प्रस्ट्तुत नहीं कर रहा है; (ख) िहां उप-जनयम (2) के तहत दकए गए डेस्ट्क ऑजडट में असाधारण पटरजस्ट्थजतयों के कारण ऐसी कारणवाई की जसफाटरि की िाती ह,ै और प्रेस रजिस्ट्रार िनरल ऐसी जसफाटरिों से संतष्टु ह;ैं (ग) िहां, प्रेस रजिस्ट्रार िनरल की राय म,ें और जलजखत रूप म ें िि ण दकए िान े वाल े कारणों से, उस जनयतकाजलक पजत्रका के संबंध में प्राप्त दकसी भी िानकारी, संिभण या जिकायत को ध्यान में रखते हुए ऐसा सत्यापन आवश्यक ह।ै [फा. सं. एम-25013/1/2024-एमयूसी-I] जवक्रम सहाय, संयक्ट्ु त सजचव MINISTRY OF INFORMATION AND BROADCASTING NOTIFICATION New Delhi, the 5th January, 2024 S.O. 73(E).— The Central Government proposes to issue the Press and Registration of Periodicals Rules, 2024 under the powers conferred under Section 19 of the Press and Registration of Periodicals Act, 2023 notified on 29.12.2023 to carry out the provisions of the Act. The following Draft Press and Registration of Periodicals Rules, 2024 , is proposed to be notified by the Central Government for this purpose. DRAFT NOTIFICATION The Press and Registration of Periodicals Rules, 2024 PART I – PRELIMINARY Short title, extent and commencement 1. (1) These Rules may be called the Press and Registration of Periodicals Rules, 2024 (2) They shall come into effect on the date of its publication in the Official Gazette. (3) They shall extend to the whole of India Definitions 2 (1) In these rules, unless the context otherwise requires,- (a) ‘Act’ means the Press and Registration of Periodicals Act, 2023; (b) ‘Bharat Kosh’ means the online service window of the Government of India to deposit any fees/fine/other money into the Government Account. (c) ‘Central Bureau of Communication’ means the attached office of the Central Government for dissemination of information on Government policies and programmes through advertising and outreach activities using various vehicles of communication – audio-visual, print, electronic, digital, exhibitions, outdoor activities.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (d) ‘financial year’ means the period ending on the 31st day of March every year (e) ‘National Single Window System’ (NSWS) is the digital platform of the Central Government (https://www.nsws.gov.in) to guide persons in identifying and applying for various approvals, permissions and registrations (f) ‘Ministry’ means the Ministry of Information and Broadcasting, Government of India (g) ‘Press Information Bureau’ means the attached office of the Central Government to disseminate information to print, electronic and social media on Government policies, programmes, initiatives and achievements, through various interventions and activities including press releases, press notes, feature articles, backgrounders, press briefings, interviews, press conferences, press tours. (h) ‘Press Sewa Portal’ means the online portal developed by the Press Registrar General for receiving various applications, intimations, and such other documents, forms as may be required under the Act, formats of certificate of registration of a periodical and of annual statement, including the following : (i) Intimation by printer of a periodical; (ii) Registration of facsimile edition of a foreign periodical; (iii) Application form by a publisher for obtaining a certificate of registration of a periodical (iv) Application form for revision of certificate of registration; (v) Application form for transfer of ownership of certificate of registration; (vi) Format of certificate of registration of a periodical; (vii) Format of furnishing annual statement by the publisher of a periodical. (viii) Guidelines for title allotment (ix) Procedure for desk audit for verification of circulation of a periodical (2) All references to ‘forms’ in these rules shall be construed as references to forms set out in the Press Sewa Portal. (3) All other words and expressions used herein and not defined but defined in the Act shall have the same meanings respectively assigned to them in the Act. PART II – INTIMATION BY A PRINTER 3. (1) A printer of a periodical shall, within fifteen days of starting a printing press of a periodical, send an intimation to the Press Registrar General and the specified authority within whose jurisdiction the printing press is situated, on the Press Sewa Portal furnishing the particulars and the documents specified in the Press Sewa Portal. (2) Where, after sending the intimation under sub-rule (1), any changes take place in the particulars mentioned in the intimation, the printer shall inform the Press Registrar General and the specified authority of the changes of the particulars. (3) Where the change in particulars involves change in location of the printing press falling under the local jurisdiction of another specified authority, the printer shall send a fresh intimation online on the Press Sewa Portal to the Press Registrar General and the other specified authority, and also inform the specified authority to whom the original intimation was sent. PART III – REGISTRATION OF FACSIMILE EDITION OF A FOREIGN PERIODICAL 4 (1) An Indian entity shall apply on the National Single Window System for obtaining approval from the Central Government for publishing a facsimile edition of a foreign periodical in India in accordance with Guidelines formulated for the purpose by the Ministry and available on the National Single Window System. (2) The Ministry shall after processing the application referred to in sub-rule (1), and after seeking any additional information it may require from the entity in respect of the application, grant approval to the entity for publication of the facsimile edition, along with such terms and conditions as specified in the approval and communicate it on the National Single Window System. (3) Where the Ministry is of the opinion that approval cannot be granted, it shall by a written order convey its decision, along with reasons for refusal, and the same shall be communicated on the National Single Window System. (4) The Indian entity shall, within fifteen days of grant of approval under sub-rule (2), make an application to the Press Registrar General on the Press Sewa Portal for grant of certificate of registration for publication of the facsimile10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] edition of the foreign periodical in India, attaching along with the documents specified in the Press Sewa Portal, and on payment of a fees of rupees ten thousand on Bharat Kosh by any of the modes of payment specified therein. (5) The Press Registrar General shall process the application, and after satisfying itself of the correctness and completeness of the application, and taking into consideration any additional information it may obtain from the entity for processing the application or comments if any obtained from the Ministry on the Press Sewa Portal, may issue a certificate of registration to the entity for the publication in India of the facsimile edition of the foreign periodical. (6) The entity shall commence publication of the facsimile edition in India only after grant of certificate of registration by the Press Registrar General under sub-rule (5). Provided that where an entity commences publication of the Facsimile edition in India before grant of certificate of registration, the Press Registrar General may refuse to grant a certificate of registration and also inform the Ministry regarding such publication. (7) Where the Ministry on its own or based on information received from the Press Registrar General or any other authority regarding publication of the facsimile edition in India before grant of certificate of registration under sub-rule (5), it may suspend or cancel the approval granted by it under sub-rule (2). PART IV – GRANT OF CERTIFICATE OF REGISTRATION Grant of certificate of registration of a periodical under section 7 5 (1) A publisher intending to start a periodical shall make an application online on the Press Sewa Portal, attaching along with such documents as specified on the Press Sewa Portal and on payment of fees of rupees one thousand for the application to Bharat Kosh by any of the modes of payment specified therein, while ensuring adherence to the Guidelines on title allotment issued by the Press Registrar General available on the Press Sewa Portal. (2) The application referred to in sub-rule (1) shall be addressed to the Press Registrar General, and endorsed to the specified authority within whose local jurisdiction the periodical is proposed to be published, and sent online from the Press Sewa Portal to the Press Registrar General and the specified authority. (3) On successful uploading of the application, the Press Sewa Portal shall generate an acknowledgement along with a unique 10 digit alphanumeric Applicant Reference Number (ARN), and the publisher and Press Registration General shall use the ARN for all future correspondences and references. (4) Where the publisher intends to make any corrections or remove any omissions or error in the application so furnished, he may do so within three days of furnishing the application. (5) The Press Registrar General shall verify the application regarding its completeness, payment of requisite fees and submission of the documents, adherence to the Guidelines on title allotment, and such other particulars which are necessary for processing the application, and within seven working days of receipt of the application, and the further time specified under sub-rule (4), issue on online communication to the publisher specifying the deficiencies, if any, in the application so furnished, including the documents attached, payment made or any such deficiency as may be specified, which is considered necessary to be removed for processing the application. (6) The publisher shall, within a period not exceeding thirty days of receiving the communication referred to in sub-rule (5), submit on the Press Sewa Portal all the requisite details and particulars for removing the deficiencies. Provided that where the publisher fails to remove the deficiencies within a period of thirty days from the date of the communication of the deficiencies by the Press Registrar General, the application is liable to be rejected by the Press Registrar General. (7) The Press Registrar General shall process the application, including the details furnished under sub-rule (2), and after taking into consideration comments if any received from the specified authority on the Press Sewa Portal, the guidelines regarding admissibility of the title, and on being so satisfied, issue a Certificate of Registration to the publisher in the format specified in the Press Sewa Portal, and also send a copy to the specified authority from the Press Sewa Portal. (8) Where the Press Registrar General is of the opinion, after taking into consideration the comments of the specified authority, or where the application remains deficient and the deficiencies have not been removed by the publisher within the specified time, that registration need not be granted, it shall issue an online communication to the publisher providing the reasons for the same and afford ten days time to the publisher to submit a reply to the communication on the Press Sewa Portal. (9) The Press Registrar General may, after taking into consideration the written reply of the publisher referred to in sub-rule (8) either grant certificate of registration or refuse to grant registration of the periodical.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 Provided that where the Press Registrar General decides that registration be not granted, he shall pass a speaking order specifying the grounds and reasons for the same and send it to the publisher on the Press Sewa Portal. Revision of particulars of the certificate of registration under section 8 6 (1) A publisher, who has been granted a certificate of registration for a periodical under section 7 may make an application on the Press Sewa Portal to the Press Registrar General for revision of particulars of the certificate, along with documents specified in the Press Sewa Portal, and on payment of a fees of rupees one thousand to Bharat Kosh by any of the modes of payment specified therein. (2) The particulars for which an application for revision of the certificate can be made may include the following: (a) Language of the periodical; (b) Title of the periodical, in accordance with the Guidelines on title allotment; (c) editor of the periodical; (d) printing press of the periodical; (e) place of publication of the periodical within the State/UT; (f) periodicity of the periodical (3) The Press Registrar General shall, after processing the application referred to in sub-rule (1), and, in the event of change in the specified authority due to change in place of publication referred to in clause (e) of sub-rule (2), after obtaining comments of the specified authority, under whose jurisdiction the new place of publication is located, within a period of sixty days, and after satisfying itself of the correctness particulars of the application and the documents attached therewith, issue a revised certificate of registration in respect of the periodical preferably within fifteen working days, and also send a copy to the specified authority. Provided that the fifteen working days would exclude the sixty days period being the time taken in obtaining comments of the specified authority, and details, if any, obtained by the Press Registrar General from the applicant for verifying the correctness and completeness of the application. (4) Where the owner of a periodical, which has been granted certificate of registration under rule 5 intends to change the publisher, the new publisher shall have to make an application for a revised certificate of registration and all the provisions of rule 5 shall apply. Transfer of ownership of the periodical under section 9 7 (1) Where the owner of a periodical in respect of which certificate of registration has been granted under rule 5 intends to transfer the ownership of that periodical to any other person or entity, such person or entity being the transferee may apply for change of ownership of the periodical by making an application to the Press Registrar General on the Press Sewa Portal, attaching the documents specified in the Press Sewa Portal, and on payment of a fees of rupees one thousand to Bharat Kosh by any of the modes of payment specified therein. (2) The application shall be endorsed by the transferee also to the specified authority within whose local jurisdiction the principal place of business of the transferee is situated, and sent online to the specified authority from the Press Sewa Portal. (3) The Press Registrar General shall process the application and, after taking into consideration comments if any received from the specified authority referred to in sub-rule (2) within a period of sixty days, and after satisfying itself of the correctness and completeness of the documents furnished by the owner, grant permission for change of ownership of the periodical. (4) Where the Press Registrar General is of the opinion, after taking into consideration the comments of the specified authority and other factors, that permission for change of ownership need not be granted, it shall issue an online communication to the owner providing the reasons for the same and afford ten days time to the owner to submit a written reply to the communication. (5) The Press Registrar General may, after taking into consideration the written reply of the owner referred to in sub-rule (4) either permit the change in ownershipand issue a written permission for the change on the Press Sewa Portal, or refuse to grant permission for change in ownership. Provided that where the Press Registrar General decides that permission for change of ownership be not granted, he shall pass a speaking order specifying the grounds and reasons for the same and send it to the owner of the periodical on the Press Sewa Portal. (6) Where the change in the particulars of the certificate of registration is limited only to change in ownership of the periodical, the Press Registrar shall grant a revised certificate of registration.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided where the change in ownership involves changes in other particulars of the periodical, the publisher or the new publisher, as the case may be, shall make an application for grant of registration in accordance with the provisions of rule 5within thirty days of the receipt of the written permission referred to under sub-rule (5). (7) Where the owner of a periodical is a company registered under the Companies Act, 2013, and the shareholding pattern of the company undergoes any change from the shareholding pattern at the time of grant of certificate of registration of the periodical under section 7, the authorised person in the company shall intimate the Press Registrar General on the Press Sewa Portal the changes made, giving full details of the names, address and other particulars of the new shareholders, along with such other documents as specified in the Press Sewa Portal. Discontinuation of a periodical under section 10 8. Where an owner of a periodical, which has been granted a certificate of registration under section 7, decides to discontinue the publication of the periodical, it shall, within six months of such discontinuation, send an intimation online on the Press Sewa Portal regarding such discontinuation to the Press Registrar General and the specified authority. PART V – MISCELLANEOUS Annual Statement to be furnished under section 12 9. (1) A publisher who has been granted a certificate of registration under section 7 shall furnish an annual statement, by the 31st May of a calendar year, in respect of the preceding financial year, on the Press Sewa Portal, containing the particulars and documents mentioned and specified in the Press Sewa Portal for the purpose. (2) Where the publisher is due to circumstances beyond his control, unable to furnish the annual statement by the stipulated date mentioned in sub-rule (1), it may with prior approval of the Press Registrar General furnish the annual statement within such extended period as the Press Registrar General may permit, having regard to the circumstances for the delay in furnishing the annual statement. Provided that the extended period shall not be beyond 31st December of the calendar year. Delivery of periodical under section 12 10. (1) The publisher shall, within 48 hours of publication of a newspaper, upload the electronic version of the newspaper on the Press Sewa Portal. (2) The publisher in a State/UT shall deliver the physical copy of the newspaper to the office of the Press Information Bureau located in the State/UT in which the paper is being published by the fifth day of every month for the all the days for which the newspaper is published during the preceding month. Provided that the publisher may at its convenience deliver a copy of the newspaper to the office of the Press Information Bureau at a more frequent interval. Provided further that in a State/UT where there is no office of PIB, the Press Registrar General shall authorise an officer under the Ministry in that State/UT for receiving the newspaper from the publisher. (3) The publisher in a State/UT shall deliver the physical copy of the newspaper to such office of the State Government/UT Administration, as may be so authorised for the purpose by the State Government/UT Administration, by the fifth day of every month for the all the days for which the newspaper is published during the preceding month. Provided that the publisher may at its convenience deliver a copy of the newspaper to the office of the office so authorised at a more frequent interval. (4) Compliance to rules (1) to (3) shall be taken into consideration for the purpose of ascertaining whether the newspaper is being published continuously, referred to in clause (b) of sub-section (1) of section 11. Verification of circulation figure of a periodical by the Press Registrar General under section 6. 11. (1) The Press Registrar General may verify the circulation figure of a periodical, in the manner laid down under this rule, in respect of the following classes and category : (a) A daily newspaper, having an average circulation of twenty five thousand copies or more each day, as reported in the Annual Statement furnished by it under sub-section (1) of section 12 in the preceding two financial years, and is empanelled with the Central Bureau of Communication for the purpose of obtaining advertisements of the Central Government; (b) A daily newspaper, having an average circulation of twenty five thousand copies or more each day, as reported in the Annual Statement furnished by it under sub-section (1) of section 12 in the preceding two financial years, and intends to be empanelled with the Central Bureau of Communication for the purpose of obtaining advertisements of the Central Government; and[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13 (c) Any other periodical which, in the opinion of the Press Registrar General, and for reasons to be recorded in writing, requires such verification, having regard to any information, reference or complaint received by it in respect of that periodical. (2) For the purpose of verifying the circulation of a periodical referred to in sub-rule (1), the Press Registrar General or any officer of the Central Government so authorised by him, may undertake a desk audit of the information furnished by the publisher in the latest Annual Statement in accordance with a procedure laid down in the Press Sewa Portal, and determine the circulation figure. Provided that the Press Registrar General or the officer so authorised, may for undertaking the desk audit, call through an electronic mode for such information or documents as may be considered necessary, and the publisher shall provide such information or documents electronically. Provided further that the desk audit shall be undertaken in a faceless manner, such that there is no physical interface between the publisher and the Press Registrar General or the officer(s) authorized for undertaking the desk audit. Explanation : For the purpose of sub-rule (2), latest Annual Statement would be the Annual Statement of the periodical furnished for the immediately preceding financial year or the year immediately before that, whichever is latest. (3) The Press Registrar General may undertake verification of the circulation by way of a physical inspection of the documents and other information and records at the business premise of the publisher and the printing press in accordance with the provisions of clause (b) of section 6 only under the following situations, namely : (a) where the publisher is not regularly furnishing the Annual Statement as required under section 12; (b) where in the desk audit undertaken under sub-rule (2) recommends such action due to exceptional circumstances, and the Press Registrar General is satisfied with such recommendations; (c) where, in the opinion of the Press Registrar General, and for reasons to be recorded in writing, such verification is necessary, having regard to any information, reference or complaint received by it in respect of that periodical.
