(1) These rules may be called the National Highways Fee (Determination of Rates and Collection) (Second Amendment) Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the National Highways Fee (Determination of Rates and Collection) Rules, 2008, in rule 4, for sub-rule (10), the following sub-rules shall be substituted, namely: – “(10) The rate of fee for use of a section of national highway comprising of structure or structures shall be calculated by adding ten times the length of structure or structures, to the length of the section of national highway excluding the length of structure or structures, or five times the total length of section of national highway, whichever is lesser. Explanation. – For the purposes of this sub-rule, “structure” means an independent bridge, tunnel or flyover or elevated highway. Illustration (i): If a section of national highway has a total length of 40 kilometers, comprising net road length of 10 kilometers and 30 kilometers length of structure, the minimum length shall be computed as follows: – 10 x 30 (i.e. ten times length of structure) + 10 (i.e. net road length excluding length of structure) = 310 kilometers or Five times the total length of the section of national highway = i.e. 5 x 40 = 200 kilometers User fee shall be calculated on the lesser length i.e. for 200 kilometers. illustration (ii): If a section of national highway has a total length of 40 kilometers, comprising net road length of 30 kilometers and 10 kilometers length of structure, the minimum length shall be computed as follows: – 10 x 10 (i.e. ten times length of structure) + 30 (i.e. net road length excluding length of structure) = 130 kilometers or Five times the total length of section of a national highway = i.e. 5 x 40 = 200 kilometers User fee shall be calculated on the lesser length i.e. for 130 kilometers. Illustration (iii): If a section of national highway has a total length of 40 kilometers, comprising of structure alone, the minimum length shall be computed as follows: – 10 x 40 (i.e. ten times length of structure) = 400 kilometers or Five times the total length of section of a national highway = i.e. 5 x 40 = 200 kilometers4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] User fee shall be calculated on the lesser length i.e. for 200 kilometers: Provided that the calculation of fee shall not apply to any structure or structures, forming part of national highway, if length of such structure is sixty meters or less and it shall be considered as part of normal length of the section of national highway. (10A) The provisions of sub-rule (10) shall apply to all fee plazas and shall take effect, – (a) from the date of next scheduled user fee revision in the case of existing public funded fee plazas; (b) upon expiry of concession agreements or transfer back to the executive authority for concessionaire- operated fee plazas; and (c) from the date of commencement of toll operations in the newly operated fee plazas.”.
