सा.का.जन. 437(अ).—केन्द्रीय सरकार, राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 9 द्वारा प्रित्त
िजियों का प्रयोग करत े हुए, राष्ट्रीय रािमाग ग फीस (िरों का अवधारण और सग्रं हण) जनयम, 2008 का और संिोधन करन े
के जलए जनम्नजलजखत जनयम बनाती ह,ै अर्ागत:् -
1. (1) इन जनयमों का संजिप्त नाम राष्ट्रीय रािमागग फीस (िरों का अवधारण और सग्रं हण) (िसू रा संिोधन) जनयम,
2025 ह।ै
(2) य ेरािपत्र में प्रकािन की तारीख को प्रवृत्त होंगे।
2. राष्ट्रीय रािमाग ग फीस (िरों का अवधारण और संग्रहण) जनयम, 2008 के जनयम 4 के उपजनयम (10) के स्ट्र्ान पर
जनम्नजलजखत उपजनयम रखा िायेगा, अर्ातग ्:-
“(10) संरचना या संरचनाओं से युि राष्ट्रीय रािमाग ग के दकसी सेक्िन के उपयोग के जलए फीस की िर की गणना संरचना
या संरचनाओं की लंबाई के जसवाय राष्ट्रीय रािमाग ग के सेक्िन की लंबाई म ें संरचना या सरं चनाओं की लंबाई का िस गनु ा
िोड़कर या राष्ट्रीय रािमागग के सेक्िन की कुल लंबाई का पांच गुना, िो भी कम हो, करके की िाएगी।
स्ट्पष्टीकरण.- इस उपजनयम के प्रयोिनों के जलए, "संरचना" स ेकोई स्ट्वतंत्र पुल, सरु ंग या फ्लाईओवर या उत्र्ाजपत रािमाग ग
से अजभप्रेत ह।ै

उिाहरण (i):
यदि दकसी राष्ट्रीय रािमागग के दकसी सेक्िन की कुल लंबाई 40 दकलोमीटर ह,ै जिसमें 10 दकलोमीटर की िुद्ध सड़क लंबाई
और 30 दकलोमीटर संरचना की लंबाई सजममजलत है, तो न्द्यूनतम लंबाई की गणना जनम्नानुसार की िाएगी: -
10 x 30 (अर्ागत संरचना की लंबाई का िस गुना) + 10 (अर्ागत संरचना की लंबाई के जसवाय िुद्ध सड़क की लंबाई)
= 310 दकलोमीटर
या
राष्ट्रीय रािमागग के सेक्िन की कुल लंबाई का पांच गुना = अर्ागत 5 x 40 = 200 दकलोमीटर
उपयोिा फीस की गणना कम लंबाई अर्ागत 200 दकलोमीटर के जलए की िाएगी।
उिाहरण (ii):
यदि राष्ट्रीय रािमागग के दकसी सेक्िन की कुल लंबाई 40 दकलोमीटर है, जिसमें 30 दकलोमीटर की िुद्ध सड़क लंबाई और
10 दकलोमीटर संरचना की लंबाई सजममजलत है, तो न्द्यूनतम लबं ाई की गणना जनम्नानुसार की िाएगी: -
10 x 10 (अर्ागत संरचना की लंबाई का िस गुना) + 30 (अर्ागत संरचना की लंबाई के जसवाय िुद्ध सड़क की लंबाई)
= 130 दकलोमीटर
या
राष्ट्रीय रािमागग के सेक्िन की कुल लंबाई का पांच गुना = अर्ागत 5 x 40 = 200 दकलोमीटर
उपयोिा फीस की गणना कम लंबाई अर्ागत 130 दकलोमीटर के जलए की िाएगी।
उिाहरण (iii):
यदि राष्ट्रीय रािमागग के दकसी सेक्िन की कुल लंबाई 40 दकलोमीटर ह,ै जिसमें केवल सरं चना सजममजलत है, तो न्द्यूनतम
लंबाई की गणना जनम्न प्रकार की िाएगी: -
10 x 40 (अर्ागत संरचना की लंबाई का िस गुना) = 400 दकलोमीटर
या
राष्ट्रीय रािमागग के दकसी सेक्िन की कुल लंबाई का पााँच गुना = अर्ागत 5 x 40 = 200 दकलोमीटर
उपयोिा फीस की गणना कम लमबाई अर्ागत 200 दकलोमीटर के जलए की िाएगी:
परंत ुयह फीस की गणना राष्ट्रीय रािमाग गके भाग के रूप में दकसी संरचना या सरं चनाओं पर लाग ूनहीं होगी, यदि
ऐसी संरचना की लंबाई साठ मीटर या उससे कम ह ैऔर इसे राष्ट्रीय रािमागग के सेक्िन की सामान्द्य लंबाई के भाग के रूप
में माना िाएगा।
(10 क) उप-जनयम (10) के उपबंध सभी फीस प्लािाओं पर लागू होंग ेऔर य ेजनम्न तारीख से लाग ूहोंगे,:-
(क) जवद्यमान लोक जवत्तपोजषत फीस प्लािाओं की ििा में अजग्रम अनुसूजचत उपयोिा फीस पुनरीिण की तारीख
स;े
(ख) ररयायत करारों की समाजप्त पर या ररयायतग्राही द्वारा सचं ाजलत फीस प्लािाओं के जलए कायगकारी प्राजधकारी
को वापस अंतरण पर; तर्ा
(ग) नए संचाजलत फीस प्लािा में टोल संचालन प्रारंभ होन े की तारीख से।

NOTIFICATION
New Delhi, the 1st July, 2025
G.S.R. 437(E).— In exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of
1956), the Central Government hereby makes the following rules further to amend the National Highways Fee
(Determination of Rates and Collection) Rules, 2008, namely: –
1. (1) These rules may be called the National Highways Fee (Determination of Rates and Collection) (Second
Amendment) Rules, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the National Highways Fee (Determination of Rates and Collection) Rules, 2008, in rule 4, for sub-rule (10),
the following sub-rules shall be substituted, namely: –
“(10) The rate of fee for use of a section of national highway comprising of structure or structures shall be calculated
by adding ten times the length of structure or structures, to the length of the section of national highway excluding the
length of structure or structures, or five times the total length of section of national highway, whichever is lesser.
Explanation. – For the purposes of this sub-rule, “structure” means an independent bridge, tunnel or flyover
or elevated highway.
Illustration (i):
If a section of national highway has a total length of 40 kilometers, comprising net road length of 10 kilometers
and 30 kilometers length of structure, the minimum length shall be computed as follows: –
10 x 30 (i.e. ten times length of structure) + 10 (i.e. net road length excluding length of structure) = 310
kilometers
or
Five times the total length of the section of national highway = i.e. 5 x 40 = 200 kilometers
User fee shall be calculated on the lesser length i.e. for 200 kilometers.
illustration (ii):
If a section of national highway has a total length of 40 kilometers, comprising net road length of 30 kilometers
and 10 kilometers length of structure, the minimum length shall be computed as follows: –
10 x 10 (i.e. ten times length of structure) + 30 (i.e. net road length excluding length of structure) = 130
kilometers
or
Five times the total length of section of a national highway = i.e. 5 x 40 = 200 kilometers
User fee shall be calculated on the lesser length i.e. for 130 kilometers.
Illustration (iii):
If a section of national highway has a total length of 40 kilometers, comprising of structure alone, the minimum
length shall be computed as follows: –
10 x 40 (i.e. ten times length of structure) = 400 kilometers
or

User fee shall be calculated on the lesser length i.e. for 200 kilometers:
Provided that the calculation of fee shall not apply to any structure or structures, forming part of national
highway, if length of such structure is sixty meters or less and it shall be considered as part of normal length of the
section of national highway.
(10A) The provisions of sub-rule (10) shall apply to all fee plazas and shall take effect, –
(a) from the date of next scheduled user fee revision in the case of existing public funded fee plazas;
(b) upon expiry of concession agreements or transfer back to the executive authority for concessionaire-
operated fee plazas; and
(c) from the date of commencement of toll operations in the newly operated fee plazas.”.
