L.-33004/99 सी.जी.-डी.एल.-अ.-27082026-275815 CG-DxLx-xEG-I2D7H0x8x2x0 26-275815 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सं. 694] नई दिल्ली, मगं लवार, अगस्ट्त 25, 2026/भाद्र 3, 1948 No. 694] NEW DELHI, TUESDAY, AUGUST 25, 2026/BHADRA 3, 1948 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 21 अगस्ट् त, 2026 सा.का. जन. 760(अ).— केंद्रीय मोटर यान जनयमावली, 1989 म ें और संिोधन करन े के जलए जनम्न जलजखत कजतपय प्रारूप जनयम म,ें जिसे केंद्रीय सरकार मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रित्त िजियों का प्रयोग करते हुए और संिोधन करने का प्रस्ट्ताव करती ह,ै को इस अजधजनयम की धारा 212 की उप-धारा (1) के द्वारा यथा आवश्यक इसके द्वारा प्रभाजवत होन े की संभावना वाले सभी व्यजियों की िानकारी के जलए प्रकाजित दकया िाता ह;ै और एतिद्वारा नोरटस दिया िाता ह ैदक प्रारूप जनयमों को उस तारीख स े तीस दिन की अवजध समाप्त होने के बाि जवचाराथग स्ट्वीकार कर जलया िाएगा जिस तारीख स े सरकारी रािपत्र म ें यथा प्रकाजित इस अजधसूचना की प्रजतयां िनता के जलए उपलब्ध करायी िाती ह;ैं जवजनर्िगष्ट अवजध समाप्त होन े के पहल े उक्त प्रारूप जनयमों के संबंध म ें दकसी भी व्यजि स े प्राप्त होने वाल े आक्षेपों या सुझावों पर केंद्र सरकार द्वारा जवचार दकया िाएगा। इन प्रारूप जनयमों के प्रजत आक्षेपों एव ं सुझावों, यदि कोई हो, को अपर सजचव (एमवीएल, पररवहन और सड़क सुरक्षा), सड़क पररवहन और रािमागग मंत्रालय, पररवहन भवन, संसि मागग, नई दिल्ली-110001 या ईमेल: comments- morth@gov.in, के माध् यम स े भेिा िा सकता ह।ै 6607 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रारूप जनयम 1. सजं क्षप्त िीर्कग एव ं प्रारंभ - (1) इन जनयमों का संजक्षप् त नाम केन्द्द्रीय मोटर यान (........संिोधन) जनयमावली, 2026 ह।ै (2) परंत ु इन जनयमों म ेंअन्द् यथा यथा उपबंजधत के जसवाय, य ेदिनांक 01 अक् टूबर, 2026 स े प्रवृत्त होंगे। 2. केंद्रीय मोटर यान जनयमावली, 1989 (इसके बाि उि जनयमों के रूप म ें उजल्लजखत) के जनयम 2 म,ें उप-जनयम (यू) के स्ट् थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथागत्: “(यू) 'बैटरी चाजलत वाहन' स े सड़कों पर उपयोग के जलए अनकु ूजलत और जविेर् रूप स े एक इलेजक्रक मोटर द्वारा चाजलत कोई वाहन अजभप्रेत ह,ै जिसकी कर्गण (रैक्ि न) ऊिा ग की आपूर्त ग वाहन म ें जविेर् रूप स े संस्ट्थाजपत बैटरी द्वारा की िाती ह:ै बिते दक िो पजहयों वाल े बैटरी चाजलत वाहन को अजधजनयम के प्रयोिनों के जलए मोटर वाहन नहीं माना िाएगा, यदि जनयम 126 म ेंजनर्िगष्ट परीक्षण एिेंसी द्वारा जनम्नजलजखत सभी ितों को सत्याजपत और प्रमाजणत दकया िाता ह,ै अथागत:् - (क) वाहन म ें 0.6 केवी स े कम की तीस जमनट की िजि वाली इलेजक्रक मोटर लगी ह;ै (ख) वाहन की अजधकतम गजत 25 दकमी/घंटा या समय-समय पर यथासंिोजधत के अनुसार कम ह;ै (ग) वाहन उपयुि ब्रेक और रेरो-ररफ्लेजक्टव उपकरणों स े सुसजित ह,ै अथागत्, सामन े की ओर एक सफेि परावतगक और पीछ े की ओर एक लाल परावतगक; (घ) एक सहायक इलेजक्रक मोटर स े सुसजित दकसी पैडल-सहायता प्राप्त वाहन के मामले म,ें उपरोि ितों के अलावा, मोटर की तीस जमनट की िजि 0.6 केवी स े कम ह ै और मोटर का आउटपुट उत्तरोत्तर कम हो िाता ह ै और अतं म ें 25 दकमी/घंटा की या समय-समय पर यथासंिोजधत के अनसु ार की गजत तक पहुचं न े पर या साइदकल चालक पैडल चलाना बंि कर ि,े इससे पहले बंि हो (कट) िाता ह।ै स्ट्पष्टीकरण.-मोटर की तीस जमनट की िजि का वही तात् पयग होगा िो एआईएस-049 (संिोधन 1) म ें जनर्िगष्ट दकया गया ह ै और सत्यापन की जवजध एआईएस-041 (संिोधन 1), समय-समय पर यथासंिोजधत के अनुसार जनधागररत की िाएगी। उपरोि परंतुक म ें जनर्िष्टग सभी वाहन समय-समय पर यथा संिोजधत एआईएस-049 (संिोधन 1) के अनलु ग्नक-क म ें जनर्िगष्ट सुरक्षा आवश्यकताओं का अनुपालन करेंगे। 3. जनयम 125-ढ म,ें i. परंतुक के मि (i) के स्ट्थ ान पर जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा: (i) वाहन एक इलेजक्रक मोटर स े सुसजित ह ैजिसम ें 0.6 दकलोवाट से कम तीस जमनट की िजि ह;ै (ii) मि (iv) का जवलोपन दकया िाएगा” [फा. स. ं आरटी-11036/23/2026-एमवीएल] महमूि अहमि, अपर सजचव नोटः मलू जनयम भारत के रािपत्र, असाधारण, भाग- II, खडं 3, उप धारा (i) म ें अजधसूचना संख्या सा.का.जन. 889(अ), दिनांक 16 जसतंबर, 2020 के माध् यम स े प्रकाजित दकए गए थ े और उन्द् ह ें जपछली बार अजधसूचना संख् या सा.का.जन...........(अ), दिनांक ........... द्वारा संिोजधत दकया गया।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New delhi, the 21st August, 2026 G.S.R. 760(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public; The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (MVL, Transport & Road Safety), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: comments-morth@gov.in; Draft Rules 1. Short title and commencement. - (1) These rules may be called the Central Motor Vehicles ....... Amendment) Rules, 2026. 2) Save as otherwise provided in these rules, they shall come into force on 01st October 2026. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 2, for sub-rule (u), the following shall be substituted, namely: "(u) 'Battery Operated Vehicle' means a vehicle adapted for use upon roads and powered exclusively by an electric motor whose traction energy is supplied exclusively by a traction battery installed in the vehicle: Provided that a two-wheeled battery-operated vehicle shall not be deemed to be a motor vehicle for the purposes of the Act, if all the following conditions are verified and certified by a testing agency specified in rule 126, namely:- (a) the vehicle is equipped with an electric motor having thirty-minute power of less than 0.6 kW; (b) the maximum speed of the vehicle is less than 25 km/h or as amended from time to time; (c) the vehicle is fitted with suitable brakes and retro-reflective devices, namely, one white reflector in the front and one red reflector at the rear; (d) in the case of a pedal-assisted vehicle equipped with an auxiliary electric motor, in addition to the above conditions, the thirty-minute power of the motor is less than 0.6 kW and the motor output is progressively4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] reduced and finally cut off as the vehicle reaches a speed of 25 km/h or as amended from time to time, or sooner if the cyclist stops pedalling. Explanation.-The thirty-minute power of the motor shall have the meaning assigned to it in AIS-049 (Rev.1), and the method of verification shall be as prescribed in AIS-041 (Rev.1), as amended from time to time. All vehicles specified in the above proviso shall comply with the safety requirements specified in Annex A of AIS-049 (Rev. 1), as amended from time to time." 3. In rule 125-N, i. The item (i) of the proviso shall be substituted by the following namely:- "(i) Vehicle is equipped with an electric motor having thirty minute power less than 0.6 kW;" ii.
