(1) जनम्नजलजखत - (क) एक दिशिंग वैसल; (ख) एक प्रसंस्ट्करण पलांट; (ग) समुद्री उत्पािों के जलए भंडारण पररसर; 4164 GI/2026 (1)2 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (घ) समुद्री उत्पािों के पररवहन के जलए प्रयिु वाहन; (ड.) पीशलगं िडे ; (च) तािा, जचल्ड, िीजवत या सूखी मछली हडैं शलगं केंद्र; (छ) स्ट्वतंत्र या साझा आइस पलांट; (ि) अन्य खाद्य समुद्री उत्पाि हडैं शलगं केंद्र; या (झ) अन्य गरै -खाद्य समुद्री उत्पाि हडैं शलगं केंद्र, के पंिीकरण के जलए प्रत्येक आवेिन प्रपत्र I, प्रपत्र II, प्रपत्र III, प्रपत्र IV, प्रपत्र II (क), प्रपत्र II (ख), प्रपत्र II (ग), प्रपत्र II (घ), प्रपत्र II (ड़), प्रपत्र II (च) या प्रपत्र II (छ) म,ें िसै ा भी मामला हो, सजचव, समद्रु ी उत्पाि जनयाात जवकास प्राजधकरण को दकया िाएगा। (2) उप-जनयम (1) के अन्तगता प्रत्येक आवेिन के सार् जनम्नजलजखत ताजलका के कॉलम (2) म ें जवजनर्िाष्ट प्रपत्र के समि कॉलम (3) म ेंजवजनर्िाष्ट िुल्क अिा दकया िाएगा, अर्ाात्:- ताजलका क्र प्रपत्र िुल्क स.ं (1) (2) (3) I पंिीकरण के जलए ऑनलाइन आवेिन (1) प्रपत्र II, II(क), II (ख), II (ग), II (घ), II (ड़), II (च), II (छ), III, IV, IX, XI के जलए ₹ 200 (2) दिशिंग वैसल के जलए आवेिन (प्रपत्र I) के जलए ₹ 100 II जनयाातक का पंिीकरण (प्रपत्र X) (1) जनयाातक पंिीकरण िल्ु क ₹ 5000 III. डीलर का पंिीकरण (प्रपत्र XII) (1) डीलर पंिीकरण िल्ु क ₹ 5000 IV दिशिंग वैसल (प्रपत्र V) (1) 45 िीट तक लंबे दिशिगं वैसल का पंिीकरण ₹ 1000 (2) 45 िीट और उससे अजधक कुल लंबाई वाले दिशिंग वैसल का पंिीकरण ₹ 2000 के पंिीकरण प्रमाणपत्र म ेंजववरणों म ें पररवतान ₹ 250 XV दिशिंग वैसल, प्रसंस्ट्करण संयंत्र आदि के पंिीकरण प्रमाणपत्र म ें पररवतान (1) 20 मीटर कुल लंबाई तक दिशिंग वैसल के पंिीकरण प्रमाणपत्र संबंधी दकसी भी प्रकार का अनुमोिन ₹ 250 (2) प्रसंस्ट्करण संयंत्र का अनुमोिन या पंिीकरण ₹ 1000 (3) उत्पािन इकाइयों के स्ट्वाजमत्व पररवतान का अनुमोिन ₹ 1000 (4) 20 मीटर कुल लंबाई तक के दिशिंग वैसल को छोड़कर पंिीकरण प्रमाणपत्र म ेंिाजमल अन्य दकसी भी ₹ 1000 जववरण म ें पररवतान का अनुमोिन (5) 20 मीटर कुल लंबाई तक के दिशिंग वैसल को छोड़कर जवत्तीय संस्ट्र्ानों के मालबंधन/लीन नोटटंग म ें ₹ 1000 पररवतान (6) प्रसंस्ट्करण संयंत्र के पंिीकरण प्रमाणपत्र म ेंपट्टेिार का अनुमोिन ₹ 1000 (7) अन्य (खाद्य) समुद्री उत्पािों के 8 घंटे की जिफ्ट म ें 1 टन तक उत्पािन िमता वाले हडैं शलगं केंद्र का ₹ 1000 अनुमोिन (8) अन्य (खाद्य) समुद्री उत्पािों के 8 घंटे की जिफ्ट म ें 1 टन स ेज़्यािा उत्पािन िमता वाले हडैं शलगं केंद्र का ₹ 2000 अनुमोिन (9) अन्य (गरै -खाद्य) समुद्री उत्पािों के 8 घंटे की जिफ्ट में 1 टन तक की उत्पािन िमता वाल े हडैं शलंग केंद्र ₹ 1000 का अनुमोिन (10) 8 घंटे की जिफ्ट म ें 1 टन स ेज़्यािा उत्पािन िमता वाले अन्य (गरै -खाद्य) समुद्री उत्पािों के हडैं शलगं ₹ 2000 केंद्र का अनुमोिन (11) डीलर पंिीकरण प्रमाणपत्र म ेंअनुमोिन ₹ 1000 (12) अजतररि िमता का अनुमोिन ₹ 1000 (13) िमा/कंपनी की संरचना म ेंपररवतान का अनुमोिन ₹ 1000 (14) अन्य कोई अनुमोिन ₹ 1000”. 3. मूल जनयमावली में, जनयम 34 म ें उप-जनयम (3) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ाात:् - “(3) िहा ाँ पंिीकरण के जलए दकया गया आवेिन स्ट्वीकार कर जलया िाता ह,ै वहा ाँ उपयुि प्रपत्रों अर्ाात् प्रपत्र V, प्रपत्र VI, प्रपत्र VII, प्रपत्र VIII, प्रपत्र VI (क), VI (ख), VI (ग), VI (घ), VI (ड़), VI (च) या VI (छ), िैसा भी लागू हो, म ें पंिीकरण प्रमाणपत्र प्रिान दकया िाएगा और यह संबंजधत प्रमाणपत्र म ें जनर्िष्टा जनयमों एव ंितों के अध्यधीन होगा। 4. मूल जनयमावली में, जनयम 38 म,ें उप-जनयम (1) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ाात:् “38. पिं ीकृत इकाइयों के स्ट्वाजमत्व का हस्ट्तातं रण। – (1) िहााँ जनयम 33 के तहत पंिीकृत दकसी इकाई को जबक्री, जगरवी या दकसी अन्य माध्यम से हस्ट्तांतररत दकया िाता ह,ै वहााँ हस्ट्तांतरी ऐसे हस्ट्तातं रण की जतजर् से एक माह के भीतर, ऐस े हस्ट्तांतरण के प्रमाणस्ट्वरूप साधनों या िस्ट्तावेिों के सार्, हस्ट्तांतरण पंिीकरण के जलए सजचव, समुद्री उत्पाि जनयाात जवकास प्राजधकरण को आवेिन करेगा।”[भागII—खण् ड3(i)] भारत का रािपत्र : असाधारण 5 5. मूल जनयमावली में, जनयम 39 म,ें उप-जनयम (1) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ाात:् - “(1) िहा ाँ जनयम 33 के अंतगता दकसी इकाई का पंिीकरण प्रभावी अवजध म ें ह,ै उस अवजध के िौरान यदि उसका स्ट्वामी जनम्नजलजखत का इरािा रखता ह ै- (क) उस स्ट्र्ान को बिलना िहा ाँ इकाई जस्ट्र्त ह;ै (ख) प्राजधकरण द्वारा अनुमोदित नक्िे म ेंपररवतान करना; (ग) उसकी िमता म ें या अन्य दकसी प्रकार का पररवतना करना; या (घ) दिशिंग वैसल या पररवहन के संचालन स्ट्र्ान को बिलना, तो स्ट्वामी को ऐस े प्रस्ट्ताजवत पररवतान स े कम स े कम तीस दिन पूव ा सजचव, समुद्री उत्पाि जनयाात जवकास प्राजधकरण को आवेिन करना होगा। 6. मलू जनयमावली म,ें जनयम 41 म,ें- (i) उप-जनयम (1) के पश्चात जनम्नजलजखत अन्तर्नाजवष्ट दकया िाएगा, अर्ाात:् - “(1क) जनयाातक के अलावा समुद्री उत्पािों के डीलर के रूप म ें पंिीकरण के जलए प्रत्येक आवेिन, ऑनलाइन उपलब्ध प्रपत्र XI म,ें िो सौ रुपय े मात्र िुल्क के भगु तान पर सजचव, समुद्री उत्पाि जनयाात जवकास प्राजधकरण को प्रस्ट्तुत दकया िाएगा तर्ा इसके सार् आवेिक की जवत्तीय जस्ट्र्जत को ििााने वाला दकसी भी बैंक स े प्राप्त प्रमाण पत्र संलग्न दकया िाएगा।” (ii) उप-जनयम (2) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ाात:् - “(2) उप-जनयम (1) और (1क) के अंतगात पंिीकरण के जलए प्रत्येक आवेिन के सार् पांच हिार रुपय े मात्र का िुल्क अिा दकया िाएगा।” 7. मलू जनयमावली म,ें जनयम 42 म,ें उप-जनयम (3) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ाात:् - “(3) िहा ाँ पंिीकरण के जलए आवेिन स्ट्वीकार दकया िाता ह,ै सजचव, समुद्री उत्पाि जनयाात जवकास प्राजधकरण, िैसा भी मामला हो, प्रपत्र X या प्रपत्र XII म ें पंिीकरण प्रमाणपत्र प्रिान करेंगे, िो उसम ें जनर्िाष्ट ितों के अध्यधीन होगा।” 8. मूल जनयमावली म,ें जनयम 43 को तत्संबंधी उप-जनयम (1) के रूप म ें पनु ः क्रमांदकत दकया िाएगा तर्ा इस प्रकार पनु ः क्रमांदकत उप-जनयम (1) के पश्चात जनम्नजलजखत उप-जनयम अन्तर्नाजवष्ट दकए िाएगं े, अर्ाात्:— “(2) िहा ं सजचव, समुद्री उत्पाि जनयाात जवकास प्राजधकरण को जवश्वास हो दक दकसी व्यजि न े गलत सूचना िेकर पंिीकरण प्रमाणपत्र प्राप्त दकया ह ै अर्वा उसने इन जनयमों के प्रावधानों अर्वा पंिीकरण प्रमाणपत्र म ें उजल्लजखत ितों का उल्लंघन दकया ह,ै तो ऐसा व्यजि डीलर के रूप म ें काय ा करने के जलए अयोग्य हो िाएगा। (3) सजचव, समुद्री उत्पाि जनयाात जवकास प्राजधकरण, ऐसे व्यजि को सुनवाई का उजचत अवसर िने े के बाि, आिेि द्वारा, पंिीकरण रद्द कर सकत े ह ैंऔर ऐस े आिेि की एक प्रजत भेि सकते ह।ैं ” 9. मलू जनयमों म,ें जनयम 45 के स्ट्र्ान पर जनम्नजलजखत जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ाात्:- “45. अजभलेखों का रखरखाव.- समुद्री उत्पाि जनयाात जवकास प्राजधकरण के सजचव सभी पंिीकृत संस्ट्र्ाओं के ऑनलाइन अजभलेखों का रखरखाव करेंग े जिनम ें पंिीकरण, संिोधन, हस्ट्तांतरण, रद्द करन े और उनस े िुड़ी ितों का जववरण िाजमल होगा । 10. मलू जनयमों म,ें प्रपत्र-II(घ) के पश्चात, जनम्नजलजखत प्रपत्र िोड़े िाएंग,े अर्ाात:् -6 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “प्रपत्र-II (ङ) समद्रु ी उत्पाि जनयाता ारण एव ंजनयाात के संबंध म ेंजनयमों एव ंजनिेिों का अनुपालन करना चाजहए। 3. उत्पािों के प्रसंस्ट्करण एव ं पैकेशिंग के िौरान स्ट्वामी को केवल अनुमोदित खाद्य-श्रेणी के रसायनों/परररिकों/योिकों (यदि आवश्यक हो) का ही उपयोग करना चाजहए। 4. इस स्ट्र्ापना के प्रसंस्ट्करण/पैककंग ित्रे म ें कोई भी रसायन, जडटिेंट या ररपले ेंट नहीं रखा िाना चाजहए। 5. इस संस्ट्र्ान एवं इसके पररसर को स्ट्वछछ, साि-सुर्रा तर्ा यदि आवश्यक हो का ही उपयोग करना चाजहए। 4. इस प्रजतष्ठान के प्रसंस्ट्करण/पैककंग ित्रे म ें दकसी भी प्रकार का रसायन, जडटिेंट या कीट-जवकषाक पिार् ा रखा या संग्रहीत नहीं दकया िाना चाजहए। 5. इस प्रजतष्ठान In the principal rules, in rule 34 for sub-rule (3), the following sub-rule shall be substituted, namely:- “(3) Where an application for registration is accepted, a certificate of registration shall be granted in appropriate forms, namely, Form V, Form VI, Form VII, Form VIII, Form VI (a), VI (b), VI (c), VI (d), VI (e), VI (f) or VI (g), as the case may be, and shall be subject to the terms and conditions specified in the respective certificate.”. 4. In the principal rules, in rule 38, for sub-rule (1), the following sub-rule shall be substituted, namely: “38. Transfer of ownership of registered entities. – (1) Where any entity registered under rule 33 is transferred by way of sale, mortgage or any other method, the transferee shall, within one month from the date of such transfer, apply to the Secretary, Marine Products Export Development Authority for registering the transfer, accompanied by the instruments or the document evidencing such transfer.”. 5. In the principal rules, in rule 39, for sub-rule (1), the following sub-rule shall be substituted, namely:- “(1) Where, during the period in which the registration of an entity under rule 33 is in force, the owner thereof intends- (a) to change place where the entity is located; (b) to alter the layout as approved by the Authority; (c) to effect any change in its capacity or otherwise; or (d) to change the place of operation of a fishing vessel or conveyance, the owner shall apply to the Secretary, Marine Products Export Development Authority at least thirty days in advance of such intended change.”. 6. In the principal rules, in rule 41,- (i) after sub-rule (1), the following shall be inserted, namely:- “(1A) Every application for registration as a dealer of marine products, other than an exporter, shall be made to the Secretary, Marine Products Export Development Authority in Form XI available online, on payment of fee of rupees two hundred only and shall be accompanied by a certificate showing the financial status of the applicant from any bank.”; (ii) for sub-rule (2), the following sub-rule shall be substituted, namely:- “(2) Every application for registration under sub-rules (1) and (1A) shall be accompanied by fee of rupees five thousand only.”. 7. In the principal rules, in rule 42, for sub- rule (3), the following sub- rule shall be substituted, namely:- “(3) Where an application for registration is accepted, the Secretary, Marine Products Export Development Authority shall grant a certificate of registration in Form X or Form XII, as the case may be, subject to conditions specified therein.”. 8. In the principal rules, rule 43 shall be renumbered as sub-rule (1) thereof and after sub-rule (1) as so renumbered the following sub-rules shall be inserted, namely:- “(2) Where the Secretary, Marine Products Export Development Authority is satisfied that any person has obtained a certificate of registration by furnishing false information or has contravened any of the provisions of these rules or conditions mentioned in the certificate of registration, such person thereby becomes disqualified to continue as a dealer. (3) The Secretary, Marine Products Export Development Authority may, after giving such person a reasonable opportunity of being heard, by order, cancel the registration and communicate a copy of such order.”. 9. This certificate of registration is granted subject to the provisions of the Marine Products Export Development Authority Rules, 1972, as amended from time to time. 2. The holder will abide by the Guidelines dated 23/07/2004 of Marine Products Export Development Authority for issue of Certificate of Registration as a dealer, as amended from time to time. 3. The dealer shall ensure that the quality of the marine products supplied by him conform to the specifications recognized by the Central Government under section 6 of the Export (Quality Control and Inspection) Act 1963 (21 of 1963) and Rules, regulations and instructions there under, as amended from time to time. 4. The dealer shall conform to the rules, regulations and instructions issued by the Export Inspection Council of India, Export Inspection Agency and the Authority from time to time in respect of procurement, packing, transportation, sanitary and other hygienic requirements. 5. The certificate is liable to be cancelled for any act of omission or commission by the holder, either in respect or quality issues or for trade related issues, including cheating, whether the complaint can be attributed to the dealer. 6.
