## Report on Amendment to National Highways Act, 1956 Notification Regarding Land Acquisition in Ananthapuramu District
**1. Executive Summary:**
This report analyzes an amendment to a notification under the National Highways Act, 1956, concerning land acquisition for highway projects. The amendment, published on May 17, 2022, addresses inaccuracies in the original notification (S.O. 761E, dated February 17, 2022) regarding the designated authority and district name. The key finding is that the amendment corrects the name of the Joint Collector and the district affected by the land acquisition. This is likely due to a district reorganization. This report aims to inform stakeholders, particularly those involved in highway projects and land acquisition in the affected region, about these changes.
**2. Introduction:**
This report provides an analysis of an amendment notification related to the National Highways Act, 1956, specifically focusing on changes pertaining to land acquisition in what was previously Ananthapuramu District. The analysis is based solely on the provided text of the amendment notification.
**3. Policy Overview:**
* **Original Policy Being Amended:** S.O. 761E, dated 17th February 2022, published in the Gazette of India, Extraordinary, Part II, Section 3, Subsection ii, dated 17th February 2022.
* **Core Objective(s) (as inferred from text):** The original policy likely pertains to the acquisition of land for National Highway development projects as authorized by the National Highways Act, 1956. The *amendment* aims to ensure the accuracy of details related to land acquisition.
**4. Background and Rationale:**
The amendment is likely necessitated by a district reorganization leading to a change in district name and the responsible local authority. The text explicitly mentions "Change in Name of the District due to the District Reorganisation." The original notification contained outdated information regarding the Joint Collector's title and the affected district's name, making the amendment necessary to ensure accurate record-keeping and proper legal execution of land acquisition proceedings.
**5. Key Provisions / Changes:**
This is an amendment to a previous notification. Therefore, the focus is on the changes introduced.
* **Specific Part of Original Policy Being Changed:** The Schedule to the original notification (S.O. 761E) is being amended, specifically against serial number 1, in column 2 and column 5.
* **New Rule/Provision:**
* In column 2 (likely referring to the designated authority for land acquisition - CALA): "Joint Collector, Sri Satya Sai" is substituted for "Joint Collector RB R."
* In column 5 (referring to the district name): "Sri Sathya Sai" is substituted for "Ananthapuram."
* **Difference/Effect of Change:** The amendment ensures that all records accurately reflect the current name of the responsible authority and the newly reorganized district. This is crucial for the legal validity of land acquisition processes and any subsequent legal challenges.
**6. Target Audience and Stakeholders:**
The direct target audience and stakeholders for this amendment include:
* **National Highways Authority of India (NHAI):** As the primary agency responsible for highway development.
* **Local Administration of Sri Sathya Sai District:** Including the Joint Collector, who is now the designated authority for land acquisition.
* **Landowners in Sri Sathya Sai District:** Whose land is subject to acquisition under the National Highways Act, 1956.
* **Legal Professionals:** Involved in land acquisition and related disputes.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:**
* The Ministry of Road Transport and Highways is the issuing authority.
* The NHAI is likely the implementing agency.
* The Joint Collector of Sri Sathya Sai District is the designated authority responsible for land acquisition processes in the district.
* **Timelines or Procedures:** No specific timelines or procedures are mentioned in the amendment text. However, it can be inferred that the amendment should be implemented immediately to ensure that all ongoing and future land acquisition processes adhere to the corrected information.
**8. Expected Outcomes / Impact of Changes:**
The intended outcome of this amendment is to:
* Rectify inaccuracies in the original notification, ensuring legal validity.
* Facilitate smooth and efficient land acquisition processes in Sri Sathya Sai District.
* Prevent potential legal challenges arising from incorrect information in official records.
* Ensure correct communication with the local authority.
**9. Conclusion:**
The amendment to the notification under the National Highways Act, 1956, regarding land acquisition in what was formerly Ananthapuramu District, is a necessary correction stemming from district reorganization. By updating the name of the designated authority (Joint Collector) and the district name, the amendment ensures accurate record-keeping, legal compliance, and smooth implementation of highway projects in the region. This correction is crucial for all stakeholders involved in land acquisition and highway development in Sri Sathya Sai District.
