L.-33004/99 सी.जी.-डी.एल.-अ.-25082026-275745 CG-DxLx-xEG-I2D5H0x8x2x0 26-275745 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4515] नई दिल्ली, सोमवार, अगस्ट्त 24, 2026/भाद्र 2, 1948 No. 4515] NEW DELHI, MONDAY, AUGUST 24, 2026/BHADRA 2, 1948 सड़क पररवहन और रािमाग गमत्रं ालय िजु ि-पत्र नई दिल्ली, 24 अगस्ट् त, 2026 का.आ. 4700(अ).— च ंदक, केंद्र सरकार ने राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया है) की धारा 3घ (3D) की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (ii) में दिनांक 17.10.2025 की अजधस चना का.आ. 4753 (अ)प्रकाजित की थी, जिसमें यह घोषणा की गई थी दक उक्त अजधसच ना से संलग्न अनुस ची में जवजनर्दिष्ट भ जम, राज्य के जिला उत्तर प्रििे में राष्ट्रीय रािमागग संख्या 233 के दकमी 121.800 से दकमी 180.420 तक के भ खंड के जनमाणग (चौड़ीकरण/चार लेन आदि), अनुरक्षण, प्रबंधन और संचालन के जलए सभी प्रकार के भारों से मुक्त होकर प णग रूप से केंद्र सरकार में जनजहत होगी। और च ंदक, माननीय उच्च न्यायालय इलाहाबाि ने ररट याजचका सख्ं या 4240 वष ग 2026, जिसका िीषगक कामता प्रसाि ससह बनाम सक्षम अजधकारी भा.रा.रा.प्रा./ अपर जिला मजिस्ट्रेट अम्बडे करनगर व 02 अन्य ह,ै में पाररत अपने दिनांक 17.10.2025 के अंजतम जनणगय के माध्यम से, याजचकाकतागओं के स्ट्वाजमत्व वाले जवजिष्ट भ खंड/ सवेक्षण संख्या के संबंध म ें प वोक्त धारा 3घ (3D) की अजधस चना को रद्द / अपास्ट्त कर दिया ह।ै अतः, अब, माननीय उच्च न्यायालय के प वोक्त आििे के अनुपालन में, केंद्र सरकार एतद्द्वारा दिनांक 17.10.2025 की उक्त अजधस चना का.आ.4753 (अ) में संिोधन करती है, और यह जनििे िते ी ह ै दक नीचे िी गई अनुसच ी में जवजनर्दिष्ट भ खंड को म ल अजधस चना से संलग्न अनुस ची से हटाया / गैर-अजधस जचत हुआ माना िाएगा। 6543 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अनसु च ी राज्य उत्तर प्रििे म ेंराष्ट्रीय रािमागग संख्या 233 के दकमी 121.800 से दकमी 180.420 तक के भ खंड के जलए म ल 3D अजधस चना से हटाई िान ेवाली / गैर-अजधस जचत की िान ेवाली भ जम का संजक्षप्त जववरण। राज्य: उत्तर प्रििे | जिला: अम्बेडकरनगर | तहसील:टाण्डा क्र. स.ं ग्राम का नाम सवक्षे ण / प्लॉट सख्ं या भज म का प्रकार (जनिी/सरकारी) हटाई िान ेवाली भ जम का क्षत्रे फल (हेक्टेयर म)ें मुिाजहिपुर 28 जनिी 0.0414 [फा. स.ं NHAI/11013/01/2010/LA-Notif/BOT/UP-Varanasi/3D] िेख अमीनखान, जनिेिक MINISTRY OF ROAD TRANSPORT AND HIGHWAYS CORRIGENDUM New Delhi, the 24th August, 2026 S.O. 4700(E).— Whereas, the Central Government, in exercise of the powers conferred by sub-section (1) of section 3D of the National Highways Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), published a notification in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide S.O. 4753 (E) dated the 17.10.2025, declaring that the land specified in the Schedule annexed to the said notification shall vest absolutely in the Central Government, free from all encumbrances, for the building (widening/four-laning etc.), maintenance, management and operation of National Highway No. 233 on the stretch of land from Km 121.800 to Km 180.420 in the district of Ambedkarnagar in the State of Uttar Pradesh. And whereas, the Hon`ble High Court of Allahabad, vide its final judgment dated 06.05.2026 passed in WRIT - C No. - 4240 of 2026 titled Kamta Prasad Singh Vs Competent Officer N.H.A.I. Addl. Distt. Magistrate Ambedkar Nagar And 2 Others, has quashed/set aside the aforementioned Section 3D notification in respect of the specific land parcel/ survey number owned by the petitioners.
