L.-33004/99 सी.जी.-डी.एल.-अ.-24082023-248296 xxxGIDHxxx CG-DL-E-24082023-248296 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 484] नई दिल्ली, बधु वार, अगस्ट्त , 23, 2023/भाद्र 1, 1945 No. 484] NEW DELHI, WEDNESDAY, AUGUST 23, 2023/BHADRA 1, 1945 वाजणज्य और उद्योग मत्रं ालय (उद्योग सवं धनध और आतं ररक व्यापार जवभाग) अजधसचू ना नई दिल्ली, 22 अगस्ट्त, 2023 सा.का.जन. 619(अ).—पेटेंट जनयम, 2003 में और संिोधन करन े के जलए, पेटेंट अजधजनयम, 1970 की धारा 159 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केंद्र सरकार जनम्नजलजखत मसौिा जनयम बनाने का प्रस्ट्ताव करती है, जिन्ह ें इसस े प्रभाजवत होने वाले सभी व्यजियों की िानकारी के जलए उि धारा की उप-धारा (3) की अपेक्षा के अनुसार, एतिद्वारा प्रकाजित दकया िाता ह ै और यह सूजचत दकया िाता ह ै दक उि मसौिा जनयमों पर, इस अजधसूचना को प्रकाजित करन े वाले भारत के रािपत्र, जिसमें यह अजधसूचना प्रकाजित ह,ै की प्रजतयां, आम लोगों को उपलब्ध कराए िाने की तारीख स े तीस दिनों की अवजध समाप्त होने के बाि, जवचार दकया िाएगा; आपजत्तयां या सुझाव, यदि कोई हों, सजचव, उद्योग संवधधन और आतं ररक व्यापार जवभाग, वाजणज्य और उद्योग मंत्रालय, भारत सरकार, वाजणज्य भवन, नई दिल्ली- 110001 को या bikram.87@nic.in और ipr-patents@gov.in पर ई- मेल द्वारा भेि दिए िाए;ं जनर्िधष्ट अवजध की समाजप्त से पहले, उि मसौिा जनयमों के संबंध में दकसी भी व्यजि से प्राप्त होने वाली आपजत्तयों और सुझावों पर केंद्र सरकार द्वारा जवचार दकया िाएगा। मसौिा जनयम 1. (i) इन जनयमों को ‘मसौिा पेटेंट (संिोधन) जनयम, 2023’ कहा िाएगा। 5401 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) ये जनयम आजधकाररक रािपत्र में इनके प्रकािन की तारीख से प्रभावी होंगे। 2. पेटेंट जनयम, 2003 म,ें जिसे इसके बाि ‘मूल जनयम’ कहा गया ह,ै के जनयम 12 म,ें (i) खंड (2) म,ें ‘ऐसी फाइललगं की तारीख से छ: माह’ िब् िों को ‘आपजत्त का प्रथम जववरण िारी दकए िाने की तारीख से िो माह’ िब् िों से प्रजतस्ट् थाजपत दकया िाएगा। (ii) खंड (3) म,ें जनम्न जलजखत खंडों को प्रजतस्ट् थाजपत दकया िाएगा, नामत:- “3. जनयंत्रक, भारत के बाहर दकसी िेि में आवेिन पर कायधवाही से संबंजधत िानकारी पर जवचार करेगा जिस तक सावधिजनक डाटाबेस का इस्ट् तेमाल करके पहुचं ा िा सकता ह।ै 4. जनयंत्रक, धारा 8 की उप-धारा (2) के तहत जलजखत म ें िि ध दकए िान े वाल े कारणों के जलए, जनयंत्रक द्वारा ऐसी सूचना मांगने की तारीख से िो माह के भीतर, आवेिक को प्रपत्र 3 में नया जववरण और घोषणापत्र प्रस्ट् तुत करन े का जनिेि ि े सकता ह।ै 5. उप-जनयम (1), (2) अथवा (3) म ें कुछ भी जनजहत होन े के बाविूि, जनयंत्रक प्रपत्र 4 म ें अनुरोध दकए िाने पर प्रपत्र 3 की फाइललगं में जवलंब को माफ कर सकता ह।ै ’ 3. मूल जनयम के जनयम 13 के उप-जनयम (2) के पश् चात्, जनम्न जलजखत को िाजमल दकया िाए, नामत: - ‘(2क) कोई पेटेंट आवेिक, यदि वह चाह े तो, अनंजतम जवजनिेि में उजल्लजखत आजवष्क ारों सजहत धारा 16 के तहत मंडलीय आवेिन िायर कर सकता ह।ै ’ 4. मूल जनयम के जनयम 24ख म,ें - क. उप-जनयम (1) म,ें ‘अड़तालीस’ िब् ि िहां भी आया हो, उसे ‘इकतीस’ िब् ि से प्रजतस्ट् थाजपत दकया िाएगा; ख. उप-जनयम (1) म,ें खंड (v) के बाि जनम्न जलजखत खंड को िाजमल दकया िाएगा, नामत: - ‘(vi) पेटेंट (संिोधन) जनयम, 2023 के लागू होन े से पहले िायर दकए गए आवेिन के संबंध में, इस उप-जनयम म ें कुछ भी जनजहत होने के बाविूि, धारा 11ख की उप-धारा (1) के तहत परीक्षण हते ु अनरु ोध पेटेंट (संिोधन) जनयम, 2006 में जनधाधररत समय-सीमा के भीतर िायर दकया िाएगा।’ ग. उप-जनयम (6) म,ें ‘उप-जनयम (5) में जवजनर्िधष् ट’ िब् िों, कोष्ठ कों और अंकों को ‘इस उप-जनयम म ें जवजनर्िधष् ट’ से प्रजतस्ट् थाजपत दकया िाएगा। 5. मूल जनयम के जनयम 24ग में, उप-जनयम (11) में, ‘उप-जनयम (10) में जवजनर्िधष्ट िब् िों, कोष्ठ कों और अंकों को ‘इस उप-जनयम म ेंजवजनर्िधष् ट’ से प्रजतस्ट् थाजपत दकया िाएगा। 6. मूल जनयम म,ें जनयम 29 के बाि, जनम्न जलजखत जनयम को िाजमल दकया िाएगा, नामत: - ‘29क. ररयायत अवजध – धारा 31 के तहत ररयायत अवजध प्राप् त करन े के जलए प्रपत्र 31 में आवेिन िायर दकया िाएगा।’ 7. मूल जनयमों म,ें जनयम 55 में: क. उप-जनयम (3) म ें ‘अभ्यावेिन’ िब्ि को ‘अभ्यावेिन, जनयंत्रक सबसे पहल े यह जनणधय लगे ा दक क्या अभ्यावेिन जवचार योग्य ह ैऔर तत्प श् चात्’ िब् िों स े प्रजतस्ट्थ ाजपत दकया िाएगा; ख. उप-जनयम (4) में िब्ि ‘तीन’ को िब्ि ‘िो’ से प्रजतस्ट्थाजपत दकया िाएगा; ग. उप-जनयम (5) के बाि जनम्न जलजखत को िाजमल दकया िाएगा, नामत: - ‘(6) अभ्यावेिन तथा सुनवाई, यदि इसका अनुरोध दकया गया हो, के िौरान दकए गए जनवेिन पर जवचार करने के बाि, जनयंत्रक अभ्यावेिन को अस्ट् वीकार करने और पेटेंट अनुिान करन े अथवा अभ्यावेिन को स्ट् वीकार करने तथा संबंजधत आवेिन पर पेटेंट अनुिान को अस्ट्वीकार करने संबंधी कारधवाई करेगा, यह कारधवाई सामान् यत: उपयुधक्त कायधवाही के पूरा होन े के तीन माह के भीतर की िाएगी।’ (7) जनयम 62 के उप-जनयम (2) से (4) और जनयम 63 में जवजनर्िधष् ट प्रदिया, िहां तक हो सके, इस जनयम के तहत सुनवाई की प्रदिया पर लागू होगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (8) ऐसा पेटेंट आवेिन, जिसके जलए आपजत्त का अभ्यावेिन िायर दकया गया ह ै तथा इसे जवचार योग् य पाया गया ह,ै उसका परीक्षण जनयम 24ग के अनुसार दकया िाएगा।‘ 8. मूल जनयम के जनयम 56 म,ें उप-जनयम (4) में ‘तीन’ िब् ि को ‘िो’ िब् ि स ेप्रजतस्ट्थ ाजपत कया िाएगा। 9. मूल जनयम के जनयम 80 म,ें उप-जनयम (3) को जनम्न जलजखत उप-जनयम स ेप्रजतस्ट्थ ाजपत दकया िाएगा, नामत: - ‘(3) िो वषध अथवा उससे अजधक की अवजध के संबंध में िेय वार्षधक नवीकरण िल्ु क का अजिम भुगतान दकया िा सकता ह,ै बित े दक िहा ं कम से कम 4 वष ध की अवजध के संबंध म ें ई-फाइललंग के िररए नवीकरण िुल् क के जलए अजिम भगु तान दकया िाएगा, वहां, ऐसे भगु तान पर िल्ु क में िस प्रजतित की कटौती लाग ू होगी।’ 10. मूल जनयम के जनयम 110 म,ें उप-जनयम (2) म,ें- क. ‘पेटेंट अजधजनयम और जनयम’ िब्ि ों को ‘पेटेंट अजधजनयम, 1970, पेटेंट जनयम, 2003, जडिाइन अजधजनयम, 2000 और जडिाइन जनयम, 2001’ से प्रजतस्ट्थ ाजपत दकया िाएगा। ख. ‘पेटेंट जवजनिेिों’ िब् िों को ‘पेटेंट जवजनिेिों, जडिाइन जवजनिेिों’ से प्रजतस्ट् थाजपत दकया िाएगा। 11. मूल जनयम के जनयम 131 में, उप-जनयम (2) को जनम्न जलजखत उप-जनयम से प्रजतस्ट्थ ाजपत दकया िाएगा, नामत: - ‘(2) उप-जनयम (1) में संिर्भतध जववरण तीन जवत् त वषों की प्रत् येक अवजध के संबंध में एक बार प्रस्ट्त ुत दकए िाएंगे, जिसकी िरुु आत उस जवत् त वषध के तरु ंत बाि िरूु होन े वाले जवत् त वष ध से होगी जिसम ें पेटेंट अनुिान दकया गया था, तथा य ेजववरण ऐसी प्रत् येक अवजध की समाजप्त के छ: माह के भीतर प्रस्ट् तुत दकए िाएंगे: बिते दक जनयंत्रक, प्रपत्र 4 म ें अनरु ोध दकए िाने पर ऐसे जववरण को िायर करने म ें हुए जवलंब को माफ कर सकता ह।ै ’ 12. मूल जनयम के जनयम 138 को जनम्नजलजखत जनयम स ेप्रजतस्ट्थाजपत दकया िाएगा, नामत: - ‘138. जनधाधररत समय-सीमा को बढाने की िजि- (1) इन जनयमों द्वारा दकसी काय ध को करने अथवा इनके तहत कोई कायधवाही करने के जलए जनधाधररत समय-सीमा को जनयंत्रक द्वारा 6 माह की अवजध तक बढाया िा सकता ह,ै यदि वह इस े उजचत समझता ह ैऔर ऐसा उसके द्वारा जनिेजित ितों के अनसु ार दकया िाएगा। (2) इस जनयम के तहत समय-सीमा बढाने का कोई भी अनरु ोध, उप-जनयम(1) म ें उजल्लजखत 6 माह तक की अवजध के समाप्त होने से पूवध प्रपत्र 4 में दकया िाएगा।’ 13. मूल जनयमों म,ें पहली अनुसूची की सारणी 1 को जनम्नजलजखत सारणी से प्रजतस्ट्थाजपत दकया िाएगा, नामतः – प्रजवजष्ट जिस पर संिेय ह ै संबद्ध ई-फाइललंग के जलए वास्ट्तजवक रूप म ेंफाइल संख्या प्रपत्र करने के जलए संख्या व्यजि अन्य, अकेल े व्यजि अन्य, अकेल े (व्यजियों) (व्यजियों) या व्यजि या व्यजि अथवा स्ट्टाटधअप अथवा (व्यजियों) (व्यजियों) (अप्स ) अथवा स्ट्टाटधअप अथवा स्ट्टाटध- अथवा स्ट्टाटध- छोटी कंपनी (अप्स ) अप (अप्स ) अप (अप्स ) /(यों) अथवा अथवा छोटी अथवा छोटी अथवा छोटी िैजक्षक कंपनी /(यों) कंपनी /( यों) कंपनी /(यों) संस्ट्थान(नों) के अथवा अथवा अथवा जलए िैजक्षक िैजक्षक िैजक्षक संस्ट्थान(नों) संस्ट्थान(नों) संस्ट्थान(नों) के जलए के जलए के जलए4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1 2 3 4 5 6 7 रुपए रुपए रुपए रुपए 1. अनंजतम या पूण ध जवजनिेिों के साथ धारा 1 1600 8000 1750 8800 7, 54* और 135 और जनयम 20(1) के प्रत्येक अलग प्रत्येक अलग प्रत्येक अलग प्रत्येक अलग अधीन दकसी पेटेंट के जलए आवेिन पर - वरीयता के वरीयता के वरीयता के वरीयता के जलए 1600 के जलए 8000 जलए 1750 जलए 8800 गुणि में के गणु ि म ें के गणु ि म ें के गणु ि म ें (i) 30 के अजतररि प्रत्येक जवजनिेि पन्न े (i) 160 (i) 800 (i) 180 (i) 880 के जलए, जनयम (9) के उप जनयम (3) के अधीन न्यूजक्लयोटाइड और/या अमीनो अम्ल के अनुसूची िम को छोड़कर; Objections or suggestions, if any, may be addressed to the Secretary, Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Government of India, Vanijya Bhawan, New Delhi- 110001 or by e-mail at bikram.87@nic.in and ipr-patents@gov.in; The objections and suggestions, which may be received from any person with respect to the said draft rules before the expiry of the period so specified, will be considered by the Central Government. DRAFT RULES 1. (i) These rules may be called “The Draft Patents (Amendment), Rules, 2023”. (ii) They shall come into force on the date of their publication in the Official Gazette. 2. In the Patents Rules, 2003, hereinafter referred to as the ‘principal rules’, in rule 12: (i) in clause (2), for the words ‘six months from the date of such filing’, the words ‘two months from the date of issuance of first statement of objections’ shall be substituted; (ii) for clause (3), the following clause shall be substituted, namely,- “3. The Controller shall consider the information relating to processing of the application in a country outside India that is accessible using public databases. 4. The Controller may, under sub-section (2) of section 8, for reasons to be recorded in writing, direct the applicant to furnish a fresh statement and undertaking in Form 3 within two months from the date of such communication by the Controller. 5. Notwithstanding anything contained in the sub-rules (1), (2) or (3), the Controller may condone the delay in filing of Form 3 upon a request made in Form 4.” 3. After sub-rule (2) of rule 13 of the principal rules, the following shall be inserted, namely,- “(2A) A patent applicant may, if he so desires, file a divisional application under section 16, including in respect of an invention disclosed in the provisional specification.” 4. In rule 24B of the principal rules,- a. in sub-rule (1),for the words ‘forty-eight’, wherever they occur, the words ‘thirty-one’ shall be substituted; b. in sub-rule (1), after clause (v), the following clause shall be inserted, namely,- ‘(vi). Notwithstanding anything contained in this sub-rule, in respect of an application that was filed before the Patents (Amendment) Rules, 2023 came into force, the request for examination under sub-section (1) of section 11B shall be filed within the time prescribed in the Patents (Amendment) Rules, 2006.’ c. in sub-rule (6), for the words, brackets and figure ‘specified under sub-rule (5)’, the words ‘specified in this sub-rule’ shall be substituted. 5. In rule 24C of the principal rules, in sub-rule (11), for the words, brackets and figure ‘specified under sub-rule (10)’, the words ‘specified in this sub-rule’ shall be substituted. 6. In the principal rules, after rule 29, the following rule shall be inserted, namely,- “29A. Grace period.- An application to avail the grace period under section 31 shall be filed in Form 31. ” 7. In the principal rules, in rule 55:24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] in sub-rule (3), for the word ‘representation’, the words ‘representation, the Controller shall first decide the maintainability of the representation and thereafter’ shall be substituted; in sub-rule (4), for the word ‘three’, the word ‘two’ shall be substituted; after sub-rule (5), the following shall be inserted namely,- “(6) After considering the representation and submission made during the hearing if so requested, the Controller shall proceed to either reject the representation and granting the patent or accepting the representation and refusing the grant of patent on that application, ordinarily within three months from completion of above proceedings. (7) The procedure specified in sub-rules (2) to (4) of rule 62, and rule 63, shall, so far as may be, apply to the procedure for hearing under this rule. (8) An application for a patent, in which a representation for opposition has been filed and found maintainable, shall be examined in accordance with rule 24C.” 8. In rule 56 of the principal rules, in sub-rule (4), for the word ‘three’, the word ‘two’ shall be substituted. 9. In rule 80 of the principal rules, for sub-rule (3), the following sub-rule shall be substituted, namely,- “(3) The annual renewal fees payable in respect of two or more years may be paid in advance: Provided that where the renewal fees is paid in advance via e-filing in respect of a period of at least 4 years, a ten per cent reduction in fee shall be applicable upon such a payment.” 10. In rule 110 of the principal rules, in sub-rule (2),- a. for the words ‘Patents Act and Rules’, the words ‘Patents Act, 1970, Patents Rules, 2003, Designs Act, 2000 and Designs Rules, 2001’ shall be substituted; b. for the words ‘patent specifications’, the words ‘patent specifications, design specifications’ shall be substituted. 11. In rule 131 of the principal rules, for sub-rule (2), the following sub-rule shall be substituted, namely,- (2) The statements referred to in sub-rule (1) shall be furnished once in respect of every period of three financial years, starting from the financial year commencing immediately after the financial year in which the patent was granted, and shall be furnished within six months from the expiry of each such period: Provided that the Controller may condone the delay in filing of such a statement upon a request made in Form 4.” 12. Rule 138 of the principal rules shall be substituted by the following rule, namely,- "138. Power to extend time prescribed.- (1) The time prescribed by these Rules for the doing of any act or the taking of any proceeding thereunder may be extended by the Controller for a period of up to six months, if he thinks it fit to do so and upon such terms as he may direct. (2) Any request for extension of time under this rule shall be made in Form 4 before the expiry of the period of up to six months mentioned in sub-rule (1).” 13.
