Publication of E gazette Notification for Declaration of acquisition of land under Section 20E for land acquisition for Gauge Conversion of Pachora Jamner with Extension upto Malkapur 84.34 Kms
## Policy Analysis Report: Land Acquisition for Pachora-Jamner Railway Project (Amendment)
**1. Executive Summary:**
This report analyzes a notification from the Ministry of Railways regarding the acquisition of land for the Pachora-Jamner railway project with an extension to Malkapur. This notification serves as an amendment to a prior declaration (S.O. 4381 E dated 19th September 2022) regarding the intended land acquisition for this railway project. The key finding is the formal declaration of land acquisition, vesting the land in the Central Government, following objection hearings and a competent authority report. The report focuses on land acquisition changes as indicated in the land schedule within the provided text, and the implication of these changes.
**2. Introduction:**
This report aims to provide information regarding an amendment to the land acquisition policy for the Pachora-Jamner railway project with extension to Malkapur, based solely on the provided Government of India gazette notification. The analysis focuses on understanding the declaration of land acquisition and its implications for relevant stakeholders.
**3. Policy Overview:**
* This notification amends the prior declaration made in notification S.O 4381 E dated 19th September 2022, published in the Gazette of India, Extraordinary, Part II, section 3 Subsection ii, dated the 20th September 2022.
* **Core Objective (Inferred):** The core objective of the overall policy, as evidenced by the amendment notification, is to facilitate the execution, maintenance, management, and operation of the Special Railway Project, specifically the Pachora-Jamner railway line extension to Malkapur, by acquiring the necessary land.
**4. Background and Rationale:**
The provided text represents a final step in the land acquisition process. The amendment's rationale likely stems from the need to finalize land ownership for the railway project after the initial declaration of intent, consideration of objections, and submission of a competent authority report. The fact that objections were received indicates that the initial land acquisition plans likely faced resistance from affected parties, necessitating a formal resolution for the project to proceed. This amendment ensures the Central Government can proceed with construction by legally securing the necessary land.
**5. Key Provisions / Changes:**
This notification represents a formal declaration of land acquisition.
* **Specific Part of Original Policy Changed:** This notification finalizes the land acquisition process initiated by S.O. 4381 E. The core change lies in moving from an "intention to acquire" to an actual declaration of acquisition. The schedule of land in the notification is what defines the specific changes to which areas are now formally acquired.
* **New Rule/Provision:** The Central Government declares that the lands specified in the schedule annexed to the notification "shall be acquired" for the railway project and "shall vest absolutely in the Central government free from all encumbrances" upon publication of the notification in the official Gazette.
* **Difference/Effect of Change:** The initial notification represented an intention and initiated a process (including objection hearings). This amendment represents the culmination of that process, resulting in the transfer of land ownership to the Central Government. The "free from all encumbrances" clause means existing claims or liabilities on the land are cleared, allowing the project to proceed without legal obstacles related to land ownership. The schedule of land included, lists land Survey Number and Taluka Area to owners to show the affected individuals and the dimensions to which their land is being affected.
**6. Target Audience and Stakeholders:**
The direct target audience and stakeholders affected by this amendment are:
* **Landowners:** Specifically, the individuals and entities listed in the attached schedule, whose land is being acquired (e.g., Rajshree Sunil Lodha, Nikhil Sunil Lodha, Paresh Sunil Lodha, Shankar Kaduba Kakade and so on).
* **Occupiers:** Those occupying the land, whether owners or tenants, are affected by the acquisition.
* **Central Railway:** As the entity responsible for the railway project, the Central Railway benefits from secured land access.
* **Residents of Jalgaon District:** The project impacts the Jalgaon district.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** The Ministry of Railways (Central Railway) is the responsible body. The Competent Authority has a role in hearing objections and submitting reports.
* **Timeline:** The notification becomes effective upon its publication in the official Gazette. The land vests in the Central Government immediately upon publication.
* **Procedures:** The amendment refers to the Railway Act, 1989 and Railway Amendment Act, 2008, implying adherence to the procedures outlined in those acts for land acquisition and compensation.
**8. Expected Outcomes / Impact of Changes:**
The primary intended outcome of this amendment is to legally secure the land required for the Pachora-Jamner railway project with extension to Malkapur. This will enable the Central Railway to:
* Proceed with the construction and development of the railway line.
* Improve transportation infrastructure in the region.
* Stimulate economic activity through improved connectivity.
The negative impacts on landowners include:
* Displacement and loss of land ownership.
* Potential disruption of livelihoods.
**9. Conclusion:**
This notification represents a critical step in the Pachora-Jamner railway project with extension to Malkapur by finalizing the land acquisition process. It formally transfers land ownership to the Central Government, enabling project execution. While facilitating infrastructure development, the policy significantly impacts affected landowners and requires careful attention to compensation, resettlement, and livelihood restoration efforts. The notification's significance lies in legally clearing the way for the railway project to proceed, subject to the provisions of the Railway Act and related regulations.
