(1) इन जनर्मों का संजक्षप् त नाम ई-अपजिष्ट (प्रबंधन) संिोधन जनर्म, 2024 ह।ै (2) र्े जनर्म रािपत्र में उनके प्रकािन की तारीख से प्रभावी होंगे। 2. ई-अपजिष्ट (प्रबंधन) जनर्म, 2022 (जिसे इसम ें इसके पश् चात उक्त जनर्म कहा गर्ा ह)ै म ें जनर्म 3, खंड (च) के स्ट् थान पर जनम्न जलजखत खंड को रखा िाएगा, अथाात :- ‘‘ ‘(च)’ “भंिनकता’ा से इस संबधं म ें केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा के दििा-जनिेिों के अनुसार प्रर्ुक्त इलेजक्रकल और इलक्े र ोजनक उपकरणों और पुिों के भंिन के कार् ामें संलग्न कोई व् र्जि र्ा संस्ट्थ ा अजभप्रेत ह;ै ’’ 3. उक्त जनर्मों के जनर्म 9 के पश्च ात, जनम्न जलजखत जनर्म को अंत:स्ट् थाजपत दकर्ा िाएगा, अथाात :- ‘‘9क जववरणी फाइल करन े सबं धं ी समर्ावजध म ें छूट.- केंद्रीर् सरकार, र्दि इस बात स े संतुष्ट ह ै दक िनजहत म ें र्ा इन जनर्मों के प्रभावी कार्ाान् वर्न के जलए ऐसा करना आवश् र्क ह,ै तो आिेि द्वारा इन जनर्मों के अधीन इलेजक्रकल और इलेक्र ॉजनक उपकरणों और उनके पुिों र्ा उपभोज्र् वस्ट् तुओं र्ा जहस्ट्स ों र्ा टुकडों के दकसी 1680 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] जवजनमााता, उत् पािक, नवीकरणकताा र्ा पनु चाक्रणकता ा द्वारा दकसी ऐसी अवजध जिसके भीतर जववरजणर्ां र्ा ररपोटा फाइल करनी ह,ै में आग ेकी अवजध, िो नौ माह स ेअजधक न हो, तक के जलए छूट ि े सकती ह।ै ’’ 4. उक्त जनर्मों के जनर्म 15 म ें उप-जनर्म (6) के पश् चात, जनम्न जलजखत उप-जनर्म अतं :स्ट्थ ाजपत दकए िाएंग,े अथाात :- ‘‘(7) केंद्रीर् सरकार के अनुमोिन स े केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी दििाजनिेिों के अनुसार केंद्रीर् सरकार आििे द्वारा, जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाण-पत्रों के जवजनमर् र्ा अंतरण के जलए एक र्ा इसस े अजधक मंच स्ट् थाजपत कर सकती ह।ै (8) उप-जनर्म (7) के अधीन स्ट् थाजपत मंच का संचालन, केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा की अनुिंसा के आधार पर केंद्रीर् सरकार द्वारा तैर्ार दकए गए दििाजनिेिों के अनुसार सचं ाजलत और जवजनर्जमत दकर्ा िाएगा। (9) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा, जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाण-पत्रों के जवजनमर् के जलए उच् चतम और न् र्ूनतम मल्ू र् जनधााररत करेगा िो जनर्म 22 के अधीन जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व संबंधी िाजर्त् व को पूरा न करन े पर पर्ाावरणीर् प्रजतकर के क्रमि: सौ प्रजतित और तीस प्रजतित के बराबर होगा। (10) पोटाल के माध् र्म से रजिस्ट् री संस्ट् थाओं के बीच जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाण-पत्र का जवजनमर् मूल् र्, उपजनर्म (9) में संिर्भात, उच् चतम और न् र्नू तम मल्ू र्ों के बीच का होगा।’’ [फा. सं. 12/136/2021-एचएसएमडी] नरेि पाल गगं वार, अपर सजचव रटप्प ण : मलू जनर्म भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में सा.का.जन. 801(अ), तारीख 02 नवम् बर, 2022 के द्वारा प्रकाजित दकर्ा गर्ा था और सा.का.जन. 534(अ), तारीख 24 िुलाई, 2023 के द्वारा अंजतम रूप से संिोजधत दकर्ा गर्ा था। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 8th March, 2024 G.S.R. 164(E).—In exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following rules further to amend the E-Waste (Management) Rules, 2022, namely: - 1. (1) These rules may be called the E-Waste (Management) Amendment Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the E-Waste (Management) Rules, 2022 (hereinafter referred to as the said rules), in rule 3 for, clause (f) the following clause shall be substituted, namely: - ‘(f) ‘‘dismantler'’ means any person or entity engaged in dismantling of used electrical and electronic equipment and components thereof in accordance with the guidelines of the Central Pollution Control Board made in this regard.’. 3. After rule 9 of the said rules, the following rule shall be inserted, namely: - “9A. Relaxation of timelines for filing of returns. – The Central Government may, if it is satisfied that it is necessary so to do in the public interest or for effective implementation of these rules, by order, relax any period within which any return or report is to be filed under these rules by a manufacture, producer, refurbisher or recycler of electrical and electronic equipment and components or consumables or parts or spares thereof, for a further period not exceeding nine months.”. 4. In rule 15 of the said rules, after sub-rule (6), the following sub-rules shall be inserted, namely: - “ (7) The Central Government may by, order, establish one or more platform for exchange or transfer of extended producer responsibility certificates in accordance with the guidelines issued by the Central Pollution Control Board with the approval of the Central Government.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (8) The operation of the platform, established under sub-rule (7) shall be operated and regulated in accordance with guidelines made by the Central Government on the recommendation of the Central Pollution Control Board. (9) The Central Pollution Control Board shall fix the highest and lowest price for exchange of extended producer responsibility certificates which shall be equal to hundred per cent and thirty per cent, respectively of the environmental compensation for non-fulfilment of extended producer responsibility obligation under rule 22. (10) The exchange price of extended producer responsibility certificate between registered entities through the portal shall be between the highest and lowest prices referred to in sub-rule (9).''.
