करते हुए, राष्ट्रीय होम्योपैथी आयोग (सिस्ट्यों की जनयुजि और नामांकन की रीजत, उनका वते न, भत्त े तथा सेवा की जनबंधन

जनयम बनाती ह,ै अथायत:् –
1. 1) इन जनयमों को राष्ट्रीय होम्योपैथी आयोग (सिस्ट्यों की जनयुजि और नामांकन की रीजत, उनका वेतन, भत्त े
तथा सेवा की जनबंधन एव ं ित ें और संपजत्त की घोषणा, व्यावसाजयक और वाजणजययक कायय) संिोधन जनयम, 2026 कहा
िाएगा।
(2) य ेजनयम रािपत्र म ें उनके प्रकािन की तारीख स े प्रवृत्त होंगे।
2. राष्ट्रीय होम्योपैथी आयोग (सिस्ट्यों की जनयुजि और नामांकन की रीजत, उनका वेतन, भत्त े तथा सेवा की
जनबंधन एव ंितें और संपजत्त की घोषणा, व्यावसाजयक और वाजणजययक काय)य जनयम, 2020 म,ें
(क) जनयम 5 के उप-जनयम (2) म ें जनम्नजलजखत स्ट्पष्टीकरण अतं : स्ट्थाजपत दकया िाएगा, अथातय ्:-
“स्ट्पष्टीकरण: - इस उप-जनयम के प्रयोिनों के जलए, यह स्ट्पष्ट दकया िाता ह ै दक िहा ं अध्यक्ष केंद्रीय सरकार या
रायय सरकार या संघ राययक्षेत्र प्रिासन की सेवा म ेंह,ै आयोग म ें उसकी जनयुजि प्रजतजनयुजि पर मानी िाएगी”;

(ख) जनयम 10 म,ें उप-जनयम (1) के स्ट्थान पर जनम्नजलजखत उप-जनयम रखा िाएगा, अथायत:् -
“(1) आयोग के अध्यक्ष अंििायी भजवष्य जनजध जनयम (भारत), 1962 या कमयचारी भजवष्य जनजध और प्रकीण य
उपबंध अजधजनयम, 1952 (1952 का 19) के उपबंधों, िैसा भी मामला हो, द्वारा िाजसत होंग,े िहां सामान्य भजवष्य
जनजध (केंद्रीय सेवा) जनयम, 1960 के अधीन ग्राहक बनन े का कोई जवकल्प उपलब्ध नहीं ह।ै ”
(ग) जनयम 13 के उप-जनयम (2) म ेंजनम्नजलजखत स्ट्पष्टीकरण अतं : स्ट्थाजपत दकया िाएगा, अथायत्:-
“स्ट्पष्टीकरण:- इस उप-जनयम के प्रयोिनों के जलए यह स्ट्पष्ट दकया िाता ह ै दक िहां अध्यक्ष या सिस्ट्य केंद्रीय
सरकार या रायय सरकार अथवा संघ राययक्षेत्र प्रिासन की सेवा म ें ह,ैं वहा ं स्ट्वायत्त बोडों म ें उनकी जनयुजि प्रजतजनयुजि
पर मानी िाएगी।”
(घ) जनयम 18 म,ें उप-जनयम (1) के स्ट्थान पर जनम्नजलजखत उप-जनयम रखे िाएंग,े अथायत्:-
“(1) स्ट्वायत्त बोडों के अध्यक्ष और सिस्ट्य अंििायी भजवष्य जनजध जनयम (भारत), 1962 या कमयचारी भजवष्य
जनजध और प्रकीण य उपबंध अजधजनयम, 1952 (1952 का 19) के उपबंधों, िैसा भी मामला हो, द्वारा िाजसत होंग,े िहा ं
सामान्य भजवष्य जनजध (केंद्रीय सेवा) जनयम, 1960 के अधीन ग्राहक बनन े का कोई जवकल्प उपलब्ध नहीं ह।ै ”
(ङ) जनयम 20 म,ें-
(i) उप-जनयम (1) के स्ट्थान पर जनम्नजलजखत उप-जनयम अंतःस्ट्थाजपत दकया िाएगा, अथायत्: -
“(1क) यदि आयोग का सजचव केंद्रीय सरकार या रायय सरकार अथवा संघ राययक्षेत्र प्रिासन की सेवा म ें ह,ै तो
उसके वेतन और भत्त,े इसके जनजमत्त लाग ू जनयमों या उप-जनयम (1) के अनुसार िो भी अजधक हो, जवजनयजमत दकए िाएगं े।
स्ट्पष्टीकरण:- इस उप-जनयम के प्रयोिनों के जलए, यह स्ट्पष्ट दकया िाता ह ैदक िहा ं सजचव केंद्रीय सरकार या रायय
सरकार या संघ रायय क्षत्रे प्रिासन की सेवा म ें ह,ै वहा ंआयोग म ें उसकी जनयुजि को प्रजतजनयुजि माना िाएगा।”
(च) उप-जनयम (2) के खडं (ii) म ें “पंद्रह वषय” िब्िों के स्ट्थान पर “सात वषय” िब्ि रख े िाएंगे।

New Delhi, the 13th May, 2026
G.S.R. 366(E).––In exercise of the powers conferred by clauses (a), (b), (c), (d), (e), (f), (g), (h), (i), (o) and
(p) of sub-section (2) of section 54 of the National Commission for Homoeopathy Act, 2020 (15 of 2020), the Central
Government hereby makes the following rules, further to amend the National Commission for Homoeopathy (Manner
of Appointment and Nomination of Members, Their Salary, Allowances and Terms and Conditions of Service, and
Declaration of Assets, Professional and Commercial Engagements) Rules, 2020, namely:–
1. (1) These Rules may be called the National Commission for Homoeopathy (Manner of Appointment and
Nomination of Members, Their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets,
Professional and Commercial Engagements) Amendment Rules, 2026.
(2) They shall come into force from the date of their publication in Official Gazette.
2. In the National Commission for Homoeopathy (Manner of Appointment and Nomination of Members,
Their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
Commercial Engagements) Rules, 2020,-
(a) in rule 5, in sub-rule (2), the following Explanation shall be inserted, namely:-
“Explanation.- For the purposes of this sub-rule, it is clarified that where, the Chairperson is in the service of
the Central Government or a State Government or Union territory Administration, his appointment in the Commission
shall be treated as on deputation.”;
(b) in rule 10, for sub-rule(1), the following sub-rule shall be substituted, namely :-
“(1) The Chairperson of the Commission shall be governed by the provisions of the Contributory Provident
Fund Rules (India), 1962 or the Employees' Provident Funds and the Miscellaneous Provisions Act, 1952 (19 of
1952), as the case may be, where no option to subscribe under the General Provident Fund (Central Services) Rules,
1960 is available.”;
(c ) in rule 13, in sub-rule (2), the following Explanation shall be inserted, namely:-
“Explanation.- For the purposes of this sub-rule, it is clarified that where the President or Member is in the
service of the Central Government or a State Government or Union territory Administration, his appointment in
Autonomous Boards shall be treated as on deputation.”;
(d) in rule 18, for sub-rule(1), the following sub-rule shall be substituted, namely :-
“(1) The President and Members of the Autonomous Boards shall be governed by the provisions of the
Contributory Provident Fund Rules (India), 1962 or the Employees' Provident Funds and the Miscellaneous Provisions
Act, 1952 (19 of 1952) as the case may be, where no option to subscribe under the General Provident Fund (Central
Services) Rules, 1960 is available.”;
(e ) in rule 20,-
(i) after sub-rule (1), the following sub-rule shall be inserted, namely: -
“(1A) If the Secretary to the Commission is in service of the Central Government or a State Government or
Union territory Administration, his salary and allowances shall be regulated in accordance with the rules applicable to
him or sub-rule (1), whichever is higher.
Explanation.- For the purposes of this sub-rule, it is clarified that where the Secretary is in the service of the
Central Government or a State Government or Union territory Administration, his appointment in the Commission
shall be treated as on deputation.”;
(ii ) sub-rule (2), in clause (ii), for the words “fifteen years”, the words “seven years” shall be
substituted.’’.
