## Policy Analysis Report: Corrigendum to S.O. 1725(E) dated 22nd July 2011, National Highways Act, 1956
**1. Executive Summary:**
This report analyzes a corrigendum to the Government of India's notification S.O. 1725(E), dated 22nd July 2011, under the National Highways Act, 1956. The corrigendum, issued on April 8th, 2022, addresses an error in the area published for a specific survey number within Bhandgaon village, Daund Taluka, Pune District. The correction is a result of an order from the Hon'ble High Court of Bombay in Civil Writ Petition number 4748 of 2014. The key finding is a change in the area specified in column No. 8 of the original notification for survey number 557 pt. of Bhandgaon from "700" to "0" square meters.
**2. Introduction:**
This report aims to provide a concise and informative analysis of the provided corrigendum, F. No. NHAI11013LAPIU Pune3D Corrigendum2022, to notification S.O. 1725(E) concerning land acquisition for national highway purposes under the National Highways Act, 1956. The analysis focuses solely on the information contained within the provided text.
**3. Policy Overview:**
* **Amendment:** This document is a corrigendum, meaning it is an amendment to the original notification S.O. 1725(E) dated 22nd July 2011, published in the Gazette of India.
* **Core Objective(s):** While the original policy likely pertained to land acquisition for national highway development, as inferred from reference to the National Highways Act, the *specific* objective of this amendment is to *correct an error* in the originally published area for land parcel in Bhandgaon village.
**4. Background and Rationale:**
The rationale for this specific amendment is to rectify an error in the original notification concerning the area measurement (in square meters) of a particular land parcel (Survey No. 557 pt.) in Bhandgaon village. The error correction is mandated by an order from the Hon'ble High Court of Bombay, indicating that the original published area was inaccurate and subject to legal challenge.
**5. Key Provisions / Changes:**
This amendment *specifically* changes the area published in column No. 8 of the original notification S.O. 1725(E) for survey number 557 pt. of Bhandgaon village.
* **Specific Part Being Changed:** Column No. 8 of the schedule to the original notification S.O. 1725(E).
* **New Rule/Provision:** The area of Survey No. 557 pt. in Bhandgaon village, as per the amended notification, is "0" square meters.
* **Difference/Effect of the Change:** The change from an area of "700" square meters to "0" square meters indicates that the land area associated with that particular survey number is likely not being acquired or the previously assessed area was inaccurate or the land is not subject to acquisition under this notification. This could affect compensation, land ownership records, and the overall highway project plan.
**6. Target Audience and Stakeholders:**
Based on the text, the direct target audience and stakeholders affected by this amendment are:
* Landowners of Survey No. 557 pt. in Bhandgaon village, Daund Taluka, Pune District.
* The National Highways Authority of India (NHAI), as they are responsible for the implementation of the highway project.
* Relevant government departments responsible for land records and compensation.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is ultimately responsible for issuing the corrigendum. The NHAI is likely involved in identifying and reporting the error.
* **Timelines or Procedures:** No specific timelines or procedures are mentioned in the text beyond the date of the corrigendum (April 8th, 2022). However, the existence of a court order suggests a legal process leading to this correction.
* **(Amendment-Specific Implementation):** This amendment requires updating official records and potentially re-evaluating compensation related to the affected land parcel.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this specific amendment is to:
* Correct an error in official records pertaining to land acquisition for the highway project.
* Comply with the order of the Hon'ble High Court of Bombay.
* Reduce potential legal challenges and disputes related to land acquisition.
* Ensure fair compensation (or lack thereof) based on accurate land measurements.
* Potentially alter construction plans based on the corrected area available for the project.
**9. Conclusion:**
The corrigendum to S.O. 1725(E) dated 22nd July 2011, represents a crucial correction to land records for the national highway project affecting Bhandgaon village. This adjustment, mandated by a court order, highlights the importance of accurate land measurements and legal oversight in land acquisition processes. The change from "700" to "0" square meters for Survey No. 557 pt. has significant implications for landowners, compensation, and project planning, underscoring the significance of this amendment.
