20) (जिसे इसमें इसके पश्चात् उक्त अजधजनयम कहा गया ह)ै की धारा 4 की उपधारा (1) अधीन िारी भारत सरकार के कोयला मंत्रालय की अजधसूचना संखयांक का. आ. 4558 (अ), तारीख 17 अक्टूबर 2024, िो भारत के रािपत्र, भाग II, खंड 3, उप खंड (ii), तारीख 17 अक्टूबर, 2024 द्वारा प्रकाजित की गई थी, उस अजधसूचना स ेउपाबद्ध अनुसूची म ेंजिजनर्िष्टज पररक्षेत्र की भूजम म ें जिसका माप 592.43 हक्े टर (लगभग) या 1463.894 एकड़ (लगभग) ह,ै कोयल े का पूिेक्षण करन े के अपन ेआिय की सूचना िी थी;
और केन्द्रीय सरकार का यह समाधान हो गया ह ैदक इस अजधसूचना में सलं ग्न अनुसूची म ेंजिजहत की गई उक्त भूजम के भाग म ेंकोयला अजभप्राप्य ह।ै अतः, अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 7 की उप धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत ेहुए, इससे संलग्न अनुसूची में िर्णजत 543.35 हक्े टर (लगभग) या 1342.62 एकड़ (लगभग) माप िाली भूजम में या उस पर के भू-सतह अजधकार का अिजन करने के अपन ेआिय की सूचना िते ी ह।ैं रटप्पण 1: इस अजधसूचना स े सबं ंजधत क्षेत्र का नक्िा क्रमांक एसईसीएल/बीएसपी/िीएम (एल एण्ड आर)/भूजम/28 दिनांक
18.05.2026 को कलेक्टर, जिला सूरिपरु (छत्तीसगढ़) के कायाजलय में या कोयला जनयंत्रक, कोयला जनयंत्रक संगठन, 6983 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] कोयला मंत्रालय, स्ट्कोप मीनार, पांचिी मंजिल, कोर 2, लक्ष्मी नगर, दिल्ली 110092 के कायाजलय में या साउथ ईस्ट्टन ज कोलफील््स जलजमटेड (भूजम और रािस्ट्ि जिभाग), सीपत रोड, जबलासपुर-495006 (छत्तीसगढ़) का जनरीक्षण कर सकेगा। रटप्पण 2: उक्त अजधजनयम की धारा 8 के उपबंधों की ओर ध्यान आकृष्ट दकया िाता ह,ै जिसमें जनम्नजलजखत उपबंध ह:ै - “8. अिनज की बाबत ्आपजत यॉ.- (1) कोई व्यजक्त िो दकसी भजू म में जिसकी बाबत् धारा 7 के अधीन अजधसूचना िारी की गई ह,ै जहतबद्ध ह,ै अजधसूचना के िारी दकए िाने स े तीस दिन के भीतर सम्पूणज भूजम या उसके दकसी भाग या ऐसी भूजम म ें या उस पर के दकन्द्हीं अजधकारों का अिजन दकए िान े के बारे म ेंआपजत्त कर सकेगा। स्ट्पष्टीकरण:- इस धारा के अथाजन्द्तगजत यह आपजत्त नहीं मानी िाएगी दक कोई व्यजक्त दकसी भूजम में कोयला उपािन के जलए स्ट्ियं खनन संदक्रयाएं करना चाहता ह ैऔर ऐसी संदक्रयाएं केन्द्रीय सरकार या दकसी अन्द्य व्यजक्त को नहीं करनी चाजहए।
(2) उपधारा (1) के अधीन प्रयेक आपजत्त सक्षम अजधकारी को जलजखत रूप में की िाएगी और सक्षम अजधकारी, आपजत्तकताज को स्ट्ियं सुने िाने का या जिजध व्यिसायी द्वारा सुनिाई का अिसर िेगा और ऐसी सभी आपजत्तयों को सुनने के पश्चात् और ऐसी अजतररक्त िाचाँ , यदि कोई हो, करने के पश्चात, िो िह आिश्यक समझे, िह या तो धारा 7 की उपधारा (1) के अधीन अजधसूजचत भूजम का या ऐसी भूजम में या उस पर के अजधकारों के संबंध में एक ररपोटज या ऐसी भूजम के जिजभन्न टुकड़े या ऐसी भूजम में या उस पर के अजधकारों के संबंध म ें आपजत्तयों पर अपनी जसफाररिों और उसके द्वारा की गई कायजिाहीयों के अजभलेख सजहत जिजभन्न ररपोटज केन्द्रीय सरकार को उसके जिजनश्चय के जलए िगे ा |

NOTIFICATION New Delhi, the 9th September, 2026 S.O. 5011(E).— Whereas, by the notification of the Government of India in the Ministry of Coal number S.O. 4558 (E), dated the 17th October, 2024 issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), published in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 17th October, 2024, the Central Government gave notice of its intention to prospect for coal in 592.43 hectares (approximately) or 1463.894 acres (approximately) of the lands in the locality specified in the Schedule annexed to that notification;
And whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed in the Schedule appended to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 543.35 hectares (approximately) or
1342.62 acres (approximately) as surface rights in or over the said lands described in the Schedule appended hereto:
Note 1. - The plan bearing number SECL/BSP/GM(L&R)/LAND/28, dated the 18th May, 2026 of the area covered by this notification may be inspected in the office of the Collector, District Surajpur (Chhattisgarh) or in the office of the Coal Controller, Coal Controller’s Organisation, Ministry of Coal, Scope Minar, 5th floor, Core II, Laxmi Nagar, Delhi 110092 or in the office of the South Eastern Coalfields Limited (Land and Revenue Department), Seepat Road, Bilaspur- 495006 (Chhattisgarh).
Note 2. - Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows: - “8. Objection to Acquisition. - (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or of any rights in or over such land.
Explanation. - It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person.
(2) Every objection under sub-section (1) shall be made to the competent authority in writing and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either makes a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land or make different reports in respect of different parcels of such land or of rights in or over such land to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of the Government.
(3) For the purposes of the section, a person shall be deemed to be interested in land, who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act.” Note 3. - The Coal Controller, Coal Controller’s Organisation, Ministry of Coal, Scope Minar, 5th Floor, Core II, Laxmi Nagar, Delhi 110092, has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 905, dated the 20th March, 1987, published in Part II, Section 3, Sub-section
(ii) of the Gazette of India, dated the 4th April, 1987.
