कोयला मंत्रालय की अजधसूचना संख यांक का. आ. 993 (अ), तारीख 01 माच,ज 2024 िो भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) तारीख 01 माच,ज 2024 म ेंप्रकाजित की गई थी, उस अजधसूचना स े उपाबद्ध अनुसूची म ें जवजनर्िजष्ट पररक्षेत्र की भूजम म ें जिसका माप 863.00 हक्े टर (लगभग) या 2132.47 एकड़ (लगभग) ह,ै कोयल े का पूवेक्षण करने के अपने आिय की सूचना िी थी | और केन्द्रीय सरकार का यह समाधान हो गया ह ै दक इस अजधसूचना स े उपाबद्ध अनुसूची म ें जवजहत की गई उक्त भूजम के भाग म ेंकोयला अजभप्राप्य ह;ै अत, अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 7 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए इससे संलग्न अनुसूची म ें वर्णजत 861.701 हक्े टर (लगभग) या 2129.27 एकड़ (लगभग) माप वाली भूजम म ें या उस पर के सभी अजधकार का अिजन करन ेके अपन ेआिय की सूचना िेती ह;ै रटप्पण 1: इस अजधसूचना के अधीन आन - “8. अिजन की बावत् आपजत्तयां: (1) कोई व्यजक्त िो दकसी भूजम म ें जिसकी बाबत् धारा 7 के अधीन अजधसूचना जनकाली गई ह,ै जहतबद्ध ह,ै अजधसूचना के जनकाल े िान े स े तीस दिन के भीतर सम्पूण ज भूजम या उसके दकसी भाग या ऐसी भूजम म ें या उस पर के दकन्द्हीं अजधकारों का अिजन दकए िाने के बारे म ेंआपजत्त कर सकेगा। स्ट्पष्टीकरण:- इस धारा के अन्द्तगजत यह आपजत्त नहीं मानी िाएगी दक कोई व्यजक्त दकसी भूजम म ेंकोयला उत्पािन के जलए स्ट्वय ंखनन संदियाए ंकरना चाहता ह ैऔर ऐसी संदियाएं केन्द्रीय सरकार या दकसी अन्द्य व्यजक्त को नहीं करनी चाजहए। (2) उपधारा (1) के अधीन प्रत्येक आपजत्त सक्षम अजधकारी को जलजखत रूप म ें की िाएगी और सक्षम अजधकारी, आपजत्तकता ज को स्ट्वय ंसुन े िाने, जवजध व्यवसायी द्वारा सुनवाई का अवसर िगे ा और ऐसी सभी आपजत्तयों को सनु न े के पश्चात ् और ऐसी अजतररक्त िााँच, यदि कोई हो, करने के पश्चात, िो यह आवश्यक समझता ह,ै वह या तो धारा 7 की उपधारा (1) के अधीन अजधसूजचत भूजम का या ऐसी भूजम म ें या उस पर के अजधकारों के संबंध म ें एक ररपोटज या ऐसी भूजम के जवजभन्न टुकड़े या ऐसी भूजम म ेंया उस पर के अजधकारों के संबंध म ेंआपजत्तयों पर अपनी जसफाररिों और उसके द्वारा की गई कायजवाही के अजभलेख सजहत जवजभन्न ररपोटज केन्द्रीय सरकार को उसके जवजनश्चय के जलए िगे ा | (3) इस धारा के प्रयोिनों के जलए वह व्यजक्त the 30th January, 2025 S.O. 531(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S.O. 993(E) dated the 01st March, 2024, issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition & Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (ii) dated the 1st March, 2024, the Central Government give notice of its intention to prospect for coal in 863.000 hectares (approximately) or 2132.47 acres (approximately) of the land in the locality specified in the Schedule annexed to that notification; And whereas the Central Government is satisfied that coal is obtainable in a part of the said land specified in the Schedule appended to this notification; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 861.701 hectares (approximately) or 2129.27 acres (approximately) and all rights in or over the said land specified in the Schedule appended hereto; Note 1: The plan bearing NO. SECL/BSP/GM(L and R)/LAND/17 dated the 29th November, 2024 of the area covered by this notification may be inspected in the office of the Collector, District Korba (Chhattisgarh) or in the office of the Coal Controller, Coal Controller’s Organization, Ministry of Coal, Scope Minar, 5th Floor, Core II, Laxmi Nagar, Delhi 110092 or in the office of the South Eastern Coalfields Limited (Revenue Section), Seepat Road, Bilaspur 495006, Chhattisgarh.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows: - “8. Objection to Acquisition: (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land. Explanation. - It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operation in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of that Government. (3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act”. Note 3: The Coal Controller, Coal Controller’s Organization, Ministry of Coal, Scope Minar, 5th Floor, Core II, Laxmi Nagar, Delhi 110092, has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 905, dated the 20th March, 1987, published in Part II, Section 3, sub-section (ii) of the Gazette of India, dated the 4th April, 1987. The instant proposal is meant for entire acquisiton of villages Ralia, Bhilaibazar and Mudianar; therefore, if any plot number is still not mentioned under Sl.No. 1, 2 and 3 than it will be deemed to be acquired under section 7(1) as indicated in Plan No. SECL/BSP/GM(L and R)/Land/17 dated the 29th November, 2024 for all practical purposes. Boundary description: A-B: Line Starts from point ‘A’ (Trijunction point of villages Amgaon, Ralia and Saraisingar) and passes over the earlier acquired southern boundary of village Ralia, further runs over the common boundary of villages Ralia and Bhilaibazar and finally reaches up to point “B” (Trijunction point of villages Bhilaibazar, Mudianar and Ralia acquired part).
