20) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया ह)ै की धारा 4 की उपधारा (1) अधीन भारत सरकार के कोयला मंत्रालय की अजधसूचना संख्या का.आ. 4488(अ), तारीख 14 अक्टूबर 2024, िो भारत के रािपत्र, असाधारण, भाग 2 खंड 3, उप-खंड (ii), तारीख 14 अक्टूबर 2024 द्वारा प्रकाजित की से सलं ग्न अनुसूची म ें जिजनर्िजष्ट पररक्षेत्र की भूजम म ें जिसका माप 512.057 हक्े टर (लगभग) या 1265.29 एकड़ (लगभग) ह,ै कोयले का पूिेक्षण करने के अपने आिय की सूचना िी थी;

और केन्द्रीय सरकार को यह समाधान हो गया ह ैदक इस अजधसूचना से संलग्न अनुसूची में जिजहत उक्त भूजम के भाग में कोयला अजभप्रास ह;ै अतः, अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 7 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुय े इससे संलग्न अनुसूची में िर्णजत 269.73 हक्े टर (लगभग) या 666.502 एकड़ (लगभग) माप िाली भूजम में या उस पर के सभी अजधकार का अिजन करन ेके अपन ेआिय की सूचना िेती हःै रटप्पण 1: इस अजधसूचना से संबंजधत क्षेत्र का मानजचत्र क्रमाकं एसईसीएल/बीएसपी/िी. एम. (एलआर)/भूजम/24 तारीख 8 अक्टूबर, 2025 जिला सूरिपुर और बलरामपुर के कलेक्टर कायाजलय में, या कोयला जनयंत्रक, कोयला जनयंत्रक का संगठन, कोयला मंत्रालय, स्ट्कोप मीनार, पााँचिीं मंजिल, कोर 2, लक्ष्मी नगर, दिल्ली 110092, या साउथ ईस्ट्टन ज कोलफील््स जलजमटेड (रािस्ट्ि अनुभाग), सीपत रोड, जबलासपुर-495006 (छत्तीसगढ़) के कायाजलय म ें 7525 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] रटप्पण 2: उपरोक्त अजधजनयम की उपधारा 8 के उपबंधों की ओर ध्यान आकृष्ट दकया िाता ह,ै जिसम ें जनम्नजलजखत उपबंध ह:ै "8. अिनज की बाबत् आपजत्तयां. - (1) कोई व्यजक्त िो दकसी भूजम में, जिसकी बाबत् धारा 7 के अधीन अजधसूचना िारी की गई ह,ै जहतबद्ध ह,ै अजधसूचना के िारी दकए िाने से तीस दिन के भीतर सम्पूणज भूजम या उस पर के दकन्द्हीं अजधकारों का अिजन दकए िाने के बारे में आपजत्त कर सकेगा । स्ट्पष्टीकरणः- इस धारा के अधीन यह आपजत्त नहीं मानी िाएगी, दक कोई व्यजक्त दकसी भूजम म ेंकोयला उत्पािन के जलए स्ट्िय ं खनन संदक्रयाएं करना चाहता ह ैऔर ऐसी संदक्रयाएं केन्द्रीय सरकार या दकसी अन्द्य व्यजक्त को नहीं करनी चाजहए।

(2) उपधारा (1) के अधीन प्रत्येक आपजत्त सक्षम अजधकारी को जलजखत रूप में की िाएगी और सक्षम अजधकारी, आपजत्तकताज को स्ट्िय ं सुने िान े या दकसी जिजध व्यिसायी द्वारा सुनिाई का अिसर िगे ा और ऐसी सभी आपजत्तयों को सुनने के पश्चात् और ऐसी अजतररक्त िांच, यदि कोई हो, करने के पश्चात ् िो िह आि‍यक समझता है, िह या तो धारा 7 की उपधारा (1) के अधीन अजधसूजचत भूजम के या ऐसी भूजम में या उस पर के अजधकारों के संबंध में एक ररपोटज या ऐसी भूजम के जिजभन्न टुकडों या ऐसी भूजम में या उस पर के अजधकारों के संबंध में आपजत्तयों पर अपनी जसफाररिों और उसके द्वारा की गई कायजिाही के अजभलेख सजहत जिजभन्न ररपोटज केन्द्रीय सरकार को उसके जिजनश्चय के जलए िगे ा ।

NOTIFICATION New Delhi, the 30th September, 2026 S.O. 5365(E).— Whereas, by the notification of the Government of India in the Ministry of Coal number S.O. 4488(E), dated the 14th October, 2024 issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 14th October, 2024, the Central Government gave notice of its intention to prospect for coal in 512.057 hectares

(approximately) or 1265.29 acres (approximately) of the land in the locality specified in the Schedule annexed to the said notification;

And whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed in the Schedule appended to this notification;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 269.730 hectares

(approximately) or 666.502 acres (approximately) and all rights in or over the said lands described in the schedule appended hereto;

Note 1.- The Plan bearing number SECL/BSP/GM(L&R)/LAND/24 dated the 8th October, 2025 of the area covered by this notification may be inspected in the office of the Collector, District Surajpur and Balrampur or in the office of the Coal Controller, Coal Controller Organization, Ministry of Coal, Scope Minar, 5th Floor, Core II, Laxmi Nagar, Delhi 110092 or in the office of the South Eastern Coalfields Limited (Revenue

Section), Seepat Road, Bilaspur-495006 (Chhattisgarh).

section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land.

Explanation - It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person.

(2) Every objection under sub-section (1) shall be made to the competent authority in writing and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either makes a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land or make different reports in respect of different parcels of such land or of rights in or over such land to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of the Government.
