और सक्षम प्राजधकारी न,े उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोट च िे िी

और केन्द्रीय सरकार न,े उक्त ररपोट च पर जवचार करने के पश्चात, और यह समाधान हो िाने पर की उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसम ें उपयोग के अजधकार का अिनच करने का जवजनश्चय दकया ह;ै

अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए,
यह घोषणा करती ह ै की इस अजधसूचना स े संलग्न अनुसूची में जवजनर्िष्टच भूजम म ें पाइपलाइन जबछाने के जलए उपयोग के
अजधकार का अिचन दकया िाए;
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, यह
जनिेि िते ी ह ै की उक्त भूजम म ें उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख स े केन्द्रीय सरकार म ें जनजहत होन े
के बिाए, सभी जवल्लंगमों स ेमक्तु होकर जहन्द्िस्ट्ु थान पेरोजलयम कापोरेिन जलजमटेड (एच.पी.सी.एल) म ें जनजहत होगा।
पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 दक धारा 10 के अधीन दकसी भी क्षजतपूर्तच के जलए
जहन्द्िस्ट्ु तान पेरोजलयम कापोरेिन जलजमटेड (एच.पी.सी.एल) पणू चतया उत्तरिायी होगी और पाइपलाइन स े सम्बजन्द्धत दकसी
भी मामले पर केन्द्रीय सरकार के जवरुद्द कोई वाि िावा या कानूनी कायचवाही नहीं हो सकेगी।

New Delhi, the 22nd March, 2022
S.O. 1378(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and
Natural Gas S.O.No. 3949(E) dated the 25th Oct. 2019 and S.O.No. 729(E) dated the 17th Feb. 2021 and
S.O. No. 2968(E) dated the 22nd July. 2021 issued under Sub-section (1) of Section 3 of the Petroleum and Minerals
Pipeline (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act),
published in the Extraordinary Gazette of India No. 3559 dated the 31th Oct. 2019 and Extraordinary Gazette of India
No. 666 dated the 17th Feb. 2021 and Extraordinary Gazette of India No.2761 dated the 27th July. 2021 the Central[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
Government declared its intention to acquire the Right of User in the land specified in the Schedule appended to that
notification for the purpose of laying pipeline in state of Telangana for transportation of LPG, from Hassan
(Karnataka) to Cherlapalli (Telangana) Pipeline by Hindustan Petroleum Corporation Limited (HPCL).
And whereas copies of the said Extraordinary Gazette notification were made available to the public up to
26th November 2019.
And whereas the competent authority has under Sub-section (1) of Section 6 of the said Act submitted report
to the Central Government.
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire Right of User therein;
Now, therefore, in exercise of the powers conferred by Sub-section (1) of the Section 6 of the said Act, the
Central Government hereby declares that the Right of User in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central
Government hereby directs that the Right of User in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited
(HPCL), free from all encumbrances.
Hindustan Petroleum Corporation Limited (HPCL) shall be exclusively liable for any compensation in terms
of Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government
for any matter relating to the pipeline.
