का.आ. 4582(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइन (भूजम में उपयोग के अजधकार का
अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसम ें इसके पश्चात उक्त अजधजनयम कहा गया ह)ैं की धारा 3 की
उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या
का.आ. 2628(अ) तारीख 18 िून 2021, िो भारत के असाधारण रािपत्र तारीख 30 िून 2021, में प्रकाजित की गई थी
द्वारा उस अजधसूचना से संलग्न अनुसूची में जिजनर्िष्टज भूजम में जबहार राज्य में ‘‘पारािीप-हजल्िया-िगु ापज रु एलपीिी
पाइपलाइन का सबं धनज तथा पटना और मिु फ्फरपरु तक इसका जिस्ट्तार‘‘ अन्द्तगजत थाना : पटना जसटी, जिला : पटना,
राज्य : जबहार में एलपीिी पिाथज के पररिहन के जलए इंजडयन ऑयल कॉपोरेिन जलजमटेड द्वारा पाइपलाइन जबछाने के
प्रयोिनाथज उपयोग के अजधकार के अिनज के अपने आिय की घोषणा की थी ;
और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को तारीख 28 िुलाई 2021 तक उपलब्ध करा िी गई थीं ;
और सक्षम प्राजधकारी ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोट जिे िी ह ै ;
और केन्द्रीय सरकार ने, उक्त ररपोटज पर जिचार करन े के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जिजनश्चय दकया ह ै ;

अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए
यह घोषणा करती ह ै दक इस अजधसूचना से संलग्न अनुसूची में जिजनर्िष्टज भूजम में पाइपलाइन जबछाने के जलए उपयोग के
अजधकार का अिजन दकया िाए ;
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए, यह
जनिेि िते ी ह ै दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार म ें जनजहत होन े
के बिाए, सभी जिल्लंगमों स ेमक्तु होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड म ेंजनजहत होगी।
पेरोजलयम ओर खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए
इंजडयन ऑयल कॉपोरेिन जलजमटेड पणू जतया उतरिायी होगी और पाइपलाइन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय
सरकार के जिरुद्ध कोई िाि िािा या कानूनी कायजिाही नहीं हो सकेगी।

NOTIFICATION
New Delhi, the 29th October, 2021
S.O. 4582(E).— Whereas by the notification of the Government of India in the Ministry of Petroleum and
Natural Gas No. S.O. 2628 (E) dated 18th June 2021, issued under sub-section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said
Act), published in the Extra ordinary Gazette of India dated 30th June 2021, the Central Government declared its
intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose
of laying “Augmentation of Paradip-Haldia-Durgapur LPG pipeline and its extension upto Patna and Muzaffarpur’’
for the transportation of LPG Products in Thana : Patna City, District : Patna in the state of Bihar by Indian Oil
Corporation Limited;
And whereas copies of the said Gazette notification were made available to the public up to 28th July 2021;
And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report
to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from
all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the
P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to the pipeline.
