L.-33004/99 xxxGIDHxxx सी.जी.-डी.एxलxx.-GअID.E-0xx2x1 12021-230902 CG-DL-E-02112021-230902 ऄसाधारण EXTRAORDINARY भाग II—खण् ड 3—ईप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4220] नइ ददल्ली, सोमिार, निम्ब र 1, 2021/कार्ततक 10, 1943 No. 4220] NEW DELHI, MONDAY, NOVEMBER 1, 2021/KARTIKA 10, 1943 परे ोजलयम और प्राकृजतक गसै मत्रं ालय ऄजधसचू ना नइ ददल्ली, 29 ऄक् तूबर, 2021 का.अ. 4581(ऄ).—केन्द्रीय सरकार ने पेरोजलयम और खजनज पाआपलाआन (भूजम में ईपयोग के ऄजधकार का ऄजजन) ऄजधजनयम 1962 (1962 का 50) (जजसे आसमें आसके पश्चात ईक्त ऄजधजनयम कहा गया ह)ैं की धारा 3 की ईपधारा (1) के ऄधीन जारी की गइ भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की ऄजधसूचना संख्या का.अ. 2627 (ऄ) तारीख 18 जून 2021, जो भारत के ऄसाधारण राजपत्र तारीख 30 जून 2021, में प्रकाजित की गइ थी द्वारा ईस ऄजधसूचना से संलग्न ऄनुसूची में जिजनर्ददष्ट भूजम में जबहार राज्य में ‘‘पारादीप-हजल्दया-दगु ापज रु एलपीजी पाआपलाआन का संबधनज तथा पटना और मजु फ्फरपरु तक आसका जिस्ट्तार‘‘ ऄन्द्तगजत थाना : बाढ़, जजला : पटना, राज्य : जबहार में एलपीजी पदाथज के पररिहन के जलए आंजडयन ऑयल कॉपोरेिन जलजमटेड द्वारा पाआपलाआन जबछान े के प्रयोजनाथज ईपयोग के ऄजधकार के ऄजजन के ऄपन ेअिय की घोषणा की थी ; और ईक्त राजपत्र ऄजधसूचना की प्रजतयां जनता को तारीख 22 जुलाइ 2021 तक ईपलब्ध करा दी गइ थी ; और सक्षम प्राजधकारी न े ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन केन्द्रीय सरकार को ररपोटज दे दी ह;ै और केन्द्रीय सरकार ने, ईक्त ररपोटज पर जिचार करन े के पश्चात् और यह समाधान हो जान े पर दक ईक्त भूजम पाइपलाइन जबछाने के जलए ऄपेजक्षत ह,ै ईसम ें ईपयोग के ऄजधकार का ऄजनज करने का जिजनश्चय दकया ह ै ; 6360 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ऄतः ऄब, केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए यह घोषणा करती ह ै दक आस ऄजधसूचना से सलं ग्न ऄनुसूची में जिजनर्ददष्ट भूजम में पाआपलाआन जबछान े के जलए ईपयोग के ऄजधकार का ऄजजन दकया जाए ; और केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईपधारा (4) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए, यह जनदेि देती ह ैदक ईक्त भूजम में ईपयोग का ऄजधकार आस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार म ेंजनजहत होन े के बजाए, सभी जिल्लंगमों से मक्तु होकर आंजडयन ऑयल कॉपोरेिन जलजमटेड म ेंजनजहत होगी। पेरोजलयम ओर खजनज पाआपलाआन ऄजधजनयम, 1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्तत के जलए आंजडयन ऑयल कॉपोरेिन जलजमटेड पणू तज या ईतरदायी होगी और पाआपलाआन से सम्बजन्द्धत दकसी भी मामल े पर केन्द्रीय सरकार के जिरुद्ध कोइ िाद दािा या काननू ी कायजिाही नहीं हो सकेगी। ऄनसु चू ी थाना : बाढ़ जजला : पटना राज्य : जबहार मौजा /ग्राम सि े/ ब्लाक / क्षत्रे फल स.ं(प्लोट स.ं) सब-डीि-स ं हक्े टेयर अरे िग जमीटर 1 2 3 4 5 6 िाहपुर-155 668 00 01 55 ऄंचल : बजख्तयारपरु 669 00 01 29 Bakhtiyarpur 670 00 01 09 [फा. सं. अर-11025(11)/235/2017-ओअर-1/इ-13716] पी. सोमाकुमार, ऄिर सजचि MINISTRY OF PETROLEUM AND NATURAL GAS NOTIFICATION New Delhi, the 29th October, 2021 S.O. 4581(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas No. S.O. 2627 (E) dated 18th June 2021, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extra ordinary Gazette of India dated 30th June 2021, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying “Augmentation of Paradip-Haldia-Durgapur LPG pipeline and its extension upto Patna and Muzaffarpur’’ for the transportation of LPG Products in Thana Barh, Patna District in the state of Bihar by Indian Oil Corporation Limited; And whereas copies of the said Gazette notification were made available to the public up to 22nd July 2021; And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report to the Central Government; And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances. Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
