का.आ. 3014(अ).—केन्द्रीय सरकार न े पेरोजलयम और खजनि पाइपलाइन (भूजम म ें उपयोग के अजधकार का
अिनज ) अजधजनयम, 1962 (1962 का 50) (जिसे इसम ें इसके पश्चात उक्त अजधजनयम कहा गया ह)ै की धारा 3 की
उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना सख्ं या
का॰आ॰ 990(अ), दिनांक 28 फरवरी 2023, भारत के रािपत्र सं० 952 दिनाकं 02 माच,ज 2023, म ें प्रकाजित की गई
थी, इस अजधसूचना स े संलग्न अनुसूची म ें जवजनर्िजष्ट भूजम म ें उत्तर प्रिेि राज्य म ें “कांडला-गोरखपुर एल.पी.िी पाइपलाइन
पररयोिना हते ु तहसील-भिोही, जिला-भिोही, राज्य-उत्तर प्रिेि म ें एल.पी.िी के पररवहन हते ु आई.एच.बी. जलजमटेड
द्वारा पाइपलाइन जबछान े के प्रयोिन के जलए उपयोग के अजधकार के अिनज के अपने आिय की घोषणा की थी।
और उक्त रािपत्र अजधसूचना की सूचना संबजन्द्धत भ-ू स्ट्वाजमयों को दिनांक 17 माचज, 2023 तक उपलब्ध करा िी
गई थी,
और श्री राकेि कुमार सक्षम प्राजधकारी ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार
को ररपोटज िे िी ह,ै
और केन्द्रीय सरकार न,े उक्त ररपोटज पर जवचार करने के पश्चात और यह समाधान हो िान े पर दक उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसम ें उपयोग के अजधकार के अिजन करन े का जवजनश्चय दकया ह;ै

अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित िजक्तयों का प्रयोग करत े हुए
एतिद्वारा यह घोषणा करती ह ै दक इस अजधसूचना स े संलग्न अनुसूची म ें जवजनर्िजष्ट भूजम में पाइपलाइन जबछाने के जलए
उपयोग के अजधकार का अिजन दकया िाए,
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित िजक्तयों का प्रयोग करत े हुए, यह
जनिेि िेती ह ै दक उक्त भूजम म ें उपयोग के अजधकार इस घोषणा के प्रकािन की तारीख स े केन्द्रीय सरकार म ें जनजहत होन े के
बिाए, सभी जवल्लगं मो स े मक्तु होकर आई.एच.बी. जलजमटेड म ें जनजहत होगी,
पेरोजलयम और खजनि पाइपलाइन अजधजनयम,1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए
आई.एच.बी. जलजमटेड पूणतज या उत्तरिायी होगा और पाइपलाइन स े संबजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के
जवरुद्ध कोई वाि, िावा या कानूनी कायजवाही नहीं हो सकेगी।

MINISTRY OF PETROLEUM AND NATURAL GAS
NOTIFICATION
New Delhi, the 6th July, 2023
S.O. 3014(E).—Whereas, by the notification of the Government of the India in the Ministry of Petroleum
and Natural Gas vide S.O. No. 990 (E) Dated 28 February, 2023 published in the Gazette of the India Gazette No. 952
dated 02 March, 2023 under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of
Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central Government
declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for
the purpose of laying “Kandla-Gorakhpur LPG Pipeline Project” for the transportation of LPG in Tehsil-Bhadohi,
District-Bhadohi in the state of Uttar Pradesh by IHB Limited.
And whereas copies of the said Gazette notification were made available to the public up to 17 March, 2023
and whereas the Shri Rakesh Kumar Competent Authority has under sub-section (1) of section 6 of the said Act
submitted report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline.
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall instead of vesting in the
Central Government, vests on the date of publication of this declaration in IHB Limited, free from all encumbrances.
IHB Limited shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962
and no suit, claim or legal proceeding would be against the Central Government on any matter relating to the pipeline.
