Executive Summary & Key Takeaways

## Report on Acquisition of Right of User for Petroleum and Natural Gas Pipeline **1. Executive Summary:** This report analyzes a government notification regarding the acquisition of the Right of User (ROU) in land for the purpose of laying a natural gas pipeline. The notification concerns Pipeline Infrastructure Limited’s Silvassa Spur Pipeline project, specifically relating to the section running from Gujarat to Dadra Nagar Haveli. The core purpose is to facilitate the transportation of natural gas by granting the ROU to Pipeline Infrastructure Limited. The key finding is that the ROU, free from all encumbrances, is being transferred to Pipeline Infrastructure Limited rather than vesting in the Government of India. **2. Introduction:** This report provides an overview of a notification issued by the Ministry of Petroleum and Natural Gas, Government of India, pertaining to the acquisition of the Right of User (ROU) for land required for the laying of a natural gas pipeline. The analysis is based solely on the provided text of the notification. **3. Policy Overview:** This is effectively a new policy application related to an existing legal framework, the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962. The core objective, as stated in the text, is to acquire the Right of User in land for the transportation of natural gas via Pipeline Infrastructure Limited’s PIL Silvassa Spur Pipeline from a tap-off point in Gujarat to Reliance Industries Limited's Silvassa Manufacturing Division in Dadra Nagar Haveli. **4. Background and Rationale:** Based on the provided text, the policy addresses the need to establish a natural gas pipeline infrastructure to facilitate the transportation of natural gas between specified locations. The notification implies a governmental commitment to developing and expanding the energy infrastructure by enabling the acquisition of land rights necessary for pipeline construction. **5. Key Provisions / Changes:** This is a new policy application under an existing act, therefore the focus is on the main rules and actions mandated. The main provisions, as stated in the text, are: * **Declaration of Intent:** The Government of India initially declared its intention to acquire the ROU in land specified in the schedule attached to notification S.O. 2936E dated 27062022. * **Public Consultation:** Copies of the gazette notification were made available to the public, and no objections were received regarding the pipeline laying. * **Competent Authority Report:** The Competent Authority submitted a report to the Government of India, as per the Act. * **Acquisition of Right of User:** The Government of India declared the acquisition of the ROU in the land specified in the schedule for laying the pipeline. * **Vesting of Rights:** Crucially, the notification directs that the ROU in the land, free from all encumbrances, shall vest in Pipeline Infrastructure Limited, instead of the Government of India, from the date of publication. * **Land Specifics:** The schedule details the specific plots of land (Survey Numbers, Subdivisions, Area) in the Union Territory of Dadra and Nagar Haveli that are subject to the ROU acquisition (specifically Village Kanadi). **6. Target Audience and Stakeholders:** The primary target audience and stakeholders are: * **Pipeline Infrastructure Limited:** As the entity receiving the ROU and responsible for laying the pipeline. * **Reliance Industries Limited:** As the recipient of the natural gas being transported by the pipeline. * **Landowners in Dadra and Nagar Haveli (specifically Kanadi):** Whose land is subject to the ROU. * **Consumers of Natural Gas:** That will be served by the new pipeline infrastructure. * **Ministry of Petroleum and Natural Gas:** The Government agency overseeing the policy. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** * Ministry of Petroleum and Natural Gas (issuing the notification). * Pipeline Infrastructure Limited (laying the pipeline and holding the ROU). * Competent Authority (submitting reports). * **Timelines/Procedures:** * The ROU vests in Pipeline Infrastructure Limited from the date of publication of the declaration. * The notification references prior steps: declaration of intent, public consultation, and a report from the Competent Authority, suggesting a sequential process. * The implementation of the provision related to the vesting of rights in Pipeline Infrastructure Limited, free from all encumbrances, would require proper coordination to ensure that they can begin laying the pipeline as soon as the provision comes into effect. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of this policy are: * Efficient transportation of natural gas from Gujarat to Reliance Industries Limited's Silvassa Manufacturing Division. * Enhanced energy infrastructure in the region. * Economic benefits associated with increased natural gas availability. * Expedited project implementation by vesting the ROU directly in Pipeline Infrastructure Limited, potentially streamlining the process and avoiding governmental delays. **9. Conclusion:** The notification represents a significant step in facilitating the development of natural gas infrastructure. By acquiring the Right of User and vesting it directly in Pipeline Infrastructure Limited, the government aims to expedite the construction and operation of the Silvassa Spur Pipeline. This action is likely to have a positive impact on natural gas transportation and availability in the region.
