NOTIFICATION
New Delhi, the 9th December, 2022
S.O. 5914(E).—Whereas by notification of Government of India in the Ministry of Petroleum and Natural Gas
3(1) notification S.O. No. 3771 (E) dated 04.08.2022, notified in the Extraordinary Gazette of India No.3598
dated 12.08.2022. issued under sub- section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of
Right of User in Land) Act, 1962 (50 of 1962) in the respectively in the Central Government declared its intention to
acquire the Right of User in the lands specified in the Schedule appended to that notification for the purpose of laying
of Srikakulam Angul Spur Gas Pipeline in Srikakulam District in the State of Andhra Pradesh by the GAIL
(India) Limited, Srikakulam.
And whereas copies of the said Gazette notification were made available on 30.08.2022
And whereas the objections received from the land owners for laying of gas pipeline and disposed of as per
Appendix-C;
And, whereas the Competent Authority has, under sub-section (1) of Section 6 of the said Act, submitted its
report to Central Government.
And Further whereas the Central Government has, after considering the said report and on being satisfied that
the said land is required for laying the pipelines, has decided to acquire the Right of User therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, Central
Government hereby declares that the Right of User in the land specified in the Schedule appended to this notification
hereby acquired for laying the pipe line;
And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, Central
Government hereby directs that the Right of User in the said lands for laying the pipeline shall, instead of vesting in
Central Government vest, on this date of the publication of the declaration, in the GAIL (India) Limited, proposing to
lay the pipeline and there up the right of such user in the land shall subject to the terms and conditions so imposed, vest
in the GAIL(India) Limited free from all encumbrances.
