S.O.No.5988 (E) dated 13.12.2022, notified in the Extraordinary Gazette of India No.5750 dated 21.12.2022 issued under sub- section (1) of section 3 of the Petroleum and Minerals Pipeline (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act, Government of India declared its intention to acquire the Right of User in the land specified in the Schedule appended to that notification for the purpose of laying pipeline form Srikakulam to Angul (SAPL) Project, Parvathipuram Manyam District in the State of Andhra Pradesh by the GAIL (India) Ltd., Srikakulam AND WHEREAS copies of the said Gazette notification were made available to the public on 30.12.2022; AND WHEREAS the objections have been received from the land owners for laying of gas pipeline and disposed off as per Appendix-C;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 AND, WHEREAS the Competent Authority has, under sub-section (1) of Section 6 of the said Act, submitted its report to Government; AND FURTHER WHEREAS the Central Government has, after considering the said report and on being satisfied that the said land is required for laying the pipelines, has decided to acquire the Right of User therein; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, Government of India hereby declares that the Right of User in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; AND FURTHER, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, Government of India hereby directs that the Right of User in the land for laying the pipeline shall, instead of vesting in Government of India, Proposing to lay the pipe line and there up the Right of such User in the land shall subject to the terms and Conditions so imposed, vest, in the GAIL (India) Limited, free from all encumbrances.
