L.-33004/99 सी.जी.-डी.एल.-अ.-05072024-255205 CG-DxLx-xEG-I0D5H0x7x2x0 24-255205 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2471] नई दिल्ली, बृहस्ट्पजतवार, िलु ाई 4, 2024/आषाढ 13, 1946 No. 2471] NEW DELHI, THURSDAY, JULY 4, 2024/ASHADHA 13, 1946 परे ोजलयम और प्राकृजतक गसै मत्रं ालय अजधसचू ना नई दिल्ली, 3 िुलाई, 2024 का.आ. 2606(अ).— केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइंस (भूजम म े उपयोग के अजधकार का अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया है) की धारा 3 की उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्रकृजतक गैस मंत्रालय की अजधसूचना संख्या का० आ० 408(अ), दिनांक 31 िनवरी, 2024, भारत के रािपत्र सं० 384 दिनांक 01 फरवरी, 2024 म ें प्रकाजित की गई थी, इस अजधसूचना से सलं ग्न अनुसूची में जवनीर्िजष्ट भूजम में गुिरात राज्य म ें “कांडला-गोरखपरु पाईपलाइन पाररयोिना” हते ु तालुका- िेवगढ़ बाररया, जिला-िाहोि, राज्य-गुिरात म ें एल. पी. िी. के पररवहन हते ु आई॰एच॰बी॰ जलजमटेड द्वारा पाईपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार के अिजन के अपने आिय की घोषणा की थी; और उक्त रािपत्र अजधसूचना की सूचना संबजन्द्धत भू-स्ट्वाजमयों को दिनांक 7 फरवरी 2024 तक उपलब्ध करा िी गई थी; और श्री अवलाभाई खातराभाई बारीआ, सक्षम प्राजधकारी और जडप्टी कलेक्टर (सेवाजनवृत्त) कांडला गोरखपरु एलपीिी पाइपलाइन पररयोिना, आई.एच.बी. जलजमटेड, गिु रात ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोटज िे िी है; और केन्द्रीय सरकार ने, उक्त ररपोटज पर जवचार करने के पश्चात और यह समाधान हो िान े पर दक उक्त भूजम पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसमे उपयोग के अजधकार के अिजन करन े का जवजनश्चय दकया है; 4004 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, केन्द्रीय सरकार,उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित िजक्तयों का प्रयोग करते हुए यह घोषणा करती ह ै की इस अजधसूचना से सलं ग्न अनुसूची में जवनीर्िजष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिजन दकया िाए; और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित िजक्तयों का प्रयोग करत े हुए, यह जनिेि िेती ह ै दक उक्त भूजम म ें उपयोग के अजधकार इस घोषणा के प्रकािन की तारीख स े केन्द्रीय सरकार म ें जनजहत होन े के बिाए, सभी जवल्लगं मो से मक्तु होकर आई॰एच॰बी॰ जलजमटेड में जनजहत होगी; पेरोजलयम और खजनि पाइपलाइंन अजधजनयम,1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए आई॰एच॰बी॰ जलजमटेड पणू जतया उत्तरिाई होगा और पाइपलाइन से संबजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के जवरुद्ध कोई वाि, िावा या कानूनी कायजवाही नहीं हो सकेगी । अनसु चू ी तहसील : िेवगढ़ बाररया जिला : िाहोि राज्य : गिु रात क्षत्रे फल मौिा / ग्राम सव े/ ब्लाक / स.ं सब-डीव-स.ं हक्े टेयर आरे वग जमीटर 1 2 3 4 5 6 रुवाबारी 783 00 03 80 784 00 02 00 471/389 00 05 44 471/379 00 03 24 [फा.स ंआर-11025(15)/11/2019-ओआर-I/पार्ट 1/ई-45901] िजि िेखर ससंह, अवर सजचव MINISTRY OF PETROLEUM AND NATURAL GAS NOTIFICATION New Delhi, the 3rd July, 2024 S.O. 2606(E).—Whereas by the notification of the Government of the India in the Ministry of Petroleum and Natural Gas vide S. O. No. 408(E), dated 31 January, 2024, published in the Gazette of the India No-384 dated 01 February, 2024, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying “Kandla-Gorakhpur Pipeline Project” for the transportation of LPG in Taluka: Devgadh Baria of Dahod District in the state of Gujarat by IHB Limited. And whereas copies of the said Gazette notification were made available to the public up to 07 February, 2024. And whereas Shri Avalabhai Khatarabhai Baria, Competent Authority and Deputy Collector (Retd.), Kandla Gorakhpur LPG Pipeline Project, IHB Limited, Gujarat has under sub-section (1) of section 6 of the said Act submitted report to the Central Government; And whereas the central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vests on the date publication of this declaration, in IHB Limited, free from all encumbrances. IHB limited shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
