का.आ. 2287(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइन (भूजम म ें उपयोग के अजधकार का
अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसम ें इसके पश्चात ् उक्त अजधजनयम कहा गया ह)ैं की धारा 3 की उप-
धारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का.आ.
4940(अ), तारीख 19 अक्तूबर 2022, िो भारत के असाधारण रािपत्र, क्रमांक 4728 तारीख 20 अक्तूबर 2022 म ें
प्रकाजित की गई थी, द्वारा इस अजधसूचना स े संलग्न अनुसचू ी म ें जिजनर्िजष्ट भूजम म ें गुिरात राज्य म ें "कांडला गोरखपुर
एलपीिी पाइपलाइन पररयोिना अनुभाग: जपपािाि स े आई॰एच॰बी॰ जलजमटेड डुमाड” अतं गजत गुिरात राज्य म ें तालुका
आनंि, जिला आनंि म ें पेरोजलयम पिाथो के पररिहन हते ु आई॰एच॰बी॰ जलजमटेड द्वारा पाइपलाइन जबछाने के प्रयोिन के
जलए उपयोग के अजधकार के अिजन के अपन े आिय की घोषणा की थी;
और उक्त रािपत्र अजधसूचना की प्रजतयां संबजन्द्धत भू-स्ट्िाजमयों को तारीख 04 िनिरी, 2023 तक उपलब्ध करा
की गई थी ;

और श्री अिलाभाई खातराभाई बारीआ, सक्षम प्राजधकारी और जडप्टी कलेक्टर (सेिाजनिृत्त), कांडला गोरखपरु
एलपीिी पाइपलाइन पररयोिना, आई.एच.बी. जलजमटेड, गिु रात न े उक्त अजधजनयम की धारा 6 की उप-धारा (1) के
अधीन केन्द्रीय सरकार को ररपोटज िे िी ह ै;
और केन्द्रीय सरकार न,े उक्त ररपोटज पर जिचार करने के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसम ें उपयोग के अजधकार का अिनज करने का जिजनश्चय दकया ह ै;
अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (1) द्वारा प्रद्त्त्त िजक्तयों का प्रयोग करत े हुए
यह घोषणा करती ह ै दक इस अजधसूचना स े सलं ग्न अनुसूची म ें जिजनर्िजष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के
अजधकार का अिजन दकया िाए ;
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (4) द्वारा प्रद्त्त्त िजक्तयों का प्रयोग करत े हुए, यह
जनिेि िेती ह ै दक उक्त भूजम में उपयोग का अजधकार इस अजधसूचना के प्रकािन की तारीख स े केन्द्रीय सरकार म ें जनजहत
होने के बिाए, सभी जिल्लगं मों स े मुक्त होकर आई.एच.बी जलजमटेड म ेंजनजहत होगी ।
पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए
आई.एच.बी जलजमटेड पणू जतय: उत्तरिायी होगी और पाइपलाइन स े सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के
जिरुद्ध कोई िाि, िािा या कानूनी कायजिाही नहीं हो सकेगी।

MINISTRY OF PETROLEUM AND NATURAL GAS
NOTIFICATION
New Delhi, the 8th May, 2023
S.O. 2287(E).— Whereas by the notification of the Government of India in the Ministry of Petroleum and
Natural Gas vide S.O. No. 4940(E) dated the 19th October, 2022, published in the Extraordinary Gazette of India No.
4728 dated 20th October, 2022, issued under sub-section (1) of section-3 of the Petroleum and Minerals Pipelines
(Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), the Central
Government declared its intention to acquire the Right of User in the land specified in the Schedule appended to that
notification for the purpose of laying “Kandla -Gorakhpur LPG Pipeline Project, Section:- Pipavav to IHB Limited
Dumad” for the transportation of LPG in Tehsil Anand, District Anand in the State of Gujarat by IHB Limited;
And whereas, copies of the said Gazette notification were made available to the concerned land owners up to
04 January, 2023.
And whereas, the Competent Authority Shri Avalabhai Khatarabhai Baria, Competent Authority and Deputy
Collector (Retd.), Kandla Gorakhpur LPG Pipeline Project, IHB Limited, Gujarat has under sub-section (1) of
Section-6 of said Act submitted report to the Central Government;
And Whereas, the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire Right of User therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section-6 of the said Act, the
Central Government hereby declares that the Right of User in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the Central
Government hereby directs that Right of User in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in IHB Limited, free from all encumbrances.
IHB Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act,
1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the
pipeline.
