द्वारा दियाजन्द्ित दकए जा रह ें "कांडला गोरखपरु एल.पी.जी. पररयोजना” के सम्बन्द्ध म ें पाआपलाआन जबछान े के प्रयोजन के
जलए ईपयोग के ऄजधकार का ऄजजन करन े के जलए ऄपन े अिय की घोषणा की थीं :
और ईक्त राजपत्र ऄजधसूचनाओं की प्रजतयां जनता को तारीख 24/03/2021 तक ईपलब्ध करा दी गइ थी।
और ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄनुसरण म ें सक्षम प्राजधकारी न े केन्द्रीय सरकार को ऄपनी
ररपोर् ज दे दी ह।ै
और केन्द्रीय सरकार न े ईक्त ररपोर् ज पर जिचार करन े के पश्चात और यह समाधान हो जाने पर दक ईक्त भूजम

और केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईपधारा (4) द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए, यह
जनदेि देती ह ैदक ईक्त भूजम म ेंईपयोग का ऄजधकार आस घोषणा के प्रकािन की तारीख स े केन्द्रीय सरकार म ें जनजहत होने के
बजाय सभी जिल्लंगमों स ेमुक्त होकर अइ.एच.बी.जल.म ें जनजहत होगा।
पेरोजलयम और खजनज पाआपलाआन ऄजधजनयम, 1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्जत के जलए
अइ.एच.बी.जल. पूणजतया ईत्तरदायी होगी और पाआपलाआन स े सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के जिरुद्ध
कोइ िाद, दािा या कानूनी कायजिाही नही हो सकेगी।

NOTIFICATION
New Delhi, the 11th October, 2021
S.O. 4248(E).—Whereas by the notification of The Government of India in the Ministry of Petroleum
and Natural Gas, published in the Gazette No. 3783 date : 01/12/2020 S.O No. 4292(E) date 26/11/2020
part-II,Section-3,Sub-Section (ii) issued under sub-section (1) of section 3 of the Petroleum and minerals
pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (Hereinafter referred to as the said Act)
the Central Government declared its intention to acquire the right of user In the land situated in Tehsil -
Vadodara District - Vadodara in Gujarat State, specified in the schedule appended to that notification for the
purpose of laying pipeline for the transportation of petroleum Product from Kandla in the State Gujarat to
Gorakhpur in the state Uttar Pradesh by the IHB Limited for implementing the “Kandla-Gorakhpur LPG Pipeline
Project”
And whereas the copies of the said Gazette notification were made available to the public on 24/03/2021.
And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act, has
submitted his report to Central Government.
And whereas, the central Government after Considering the report and on being satisfied that The said
land is required for laying the pipeline, has decided to acquire right of the user therein; Now therefore, in exercise of
the power conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares
that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for
laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user of the said land for laying the pipeline shall, instead of
vesting in the Central Government, vests on the date of publication of the declaration, in IHB Limited, free from
all encumbrances .
IHB Limited shall be exclusively liable for any compensation in terms of section 10 ofthe P&MP
Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to pipeline.
