एवं भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय के िुजिपत्र- संख्या का.अ. 435(ऄ), तारीख 31 जनवरी

पदाथो के पररवहन हते ु अइ॰एच॰बी॰ जलजमटेड द्वारा पाइपलाआन जबछाने के प्रयोजन के जलए ईपयोग के ऄजधकार के ऄजजन
के ऄपने अिय की घोषणा की थी;
और ईक्त राजपत्र ऄजधसूचना की प्रजतयां संबजन्द्धत भ-ू स्ट्वाजमयों को तारीख 04 ददसम्बर, 2021 तक ईपलब्ध
करा की गइ थी ;

ऄतः ऄब, केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईप-धारा (1) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े
हुए यह घोषणा करती ह ै दक आस ऄजधसूचना से सलं ग्न ऄनसु ूची में जवजनर्ददष्ट भूजम म ें पाआपलाइन जबछान े के जलए
ईपयोग के ऄजधकार का ऄजजन दकया जाए ;
और केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईप-धारा (4) द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए,
यह जनदेि देती ह ै दक ईक्त भूजम में ईपयोग का ऄजधकार आस ऄजधसूचना के प्रकािन की तारीख से केन्द्रीय सरकार में
जनजहत होने के बजाए, सभी जवल्लगं मों से मक्तु होकर अइ.एच.बी जलजमटेड में जनजहत होगी ।
पेरोजलयम और खजनज पाआपलाइन ऄजधजनयम, 1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्तत के जलए
अइ.एच.बी जलजमटेड पणू जतय: ईतरदायी होगी और पाआपलाइन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के
जवरुि कोइ वाद दावा या काननू ी कायजवाही नहीं हो सकेगी।

NOTIFICATION
New Delhi, the 20th July, 2022
S.O. 3302(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum and
Natural Gas S.O. No. 4300(E) dated the 26 November 2020, published in the Extraordinary Gazette of India
No-3785 dated 1st December, 2020, and erratum of the Government of India in the Ministry of Petroleum and
Natural S.O. 435 (E) dated 31st January 2022 published in Extraordinary Gazette of India No.- 416 dated the
2nd February, 2022, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition
of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), the Central Government
declared its intention to acquire the Right of User in the land specified in the Schedule appended to that4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
notification for the purpose of laying ”Kandla -Gorakhpur LPG Pipeline Project” for the transportation of LPG in
Bhavnagar District in the State of Gujarat by IHB Limited;
And whereas, copies of the said Gazette notification were made available to the concerned land owners by
04 December, 2021;
And whereas, the Competent Authority has under sub-section (1) of Section 6 of said Act submitted
report to the Central Government;
And Whereas, the Central Government, after considering the said report and on being satisfied that the
said land is required for laying the pipeline, has decided to acquire Right of User therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the Right of User in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the
Central Government hereby directs that Right of User in the said land for laying the pipeline shall, instead of
vesting in the Central Government, vest on the date of publication of the declaration, in IHB Limited, free from all
encumbrances.
IHB Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act,
1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the
pipeline.
