और उक्त अजधजनयम की धारा 6 की उपधारा (1) के अनुसरण म ें सक्षम प्राजधकारी न े केन्द्रीय सरकार को
अपनी ररपोर् ज ि ेिी ह।ै
और केन्द्रीय सरकार न े उक्त ररपोर् ज पर जिचार करन े के पश्चात और यह समाधान हो िाने पर दक उक्त भूजम
पाइपलाईन जबछाने के जलए अपेजक्षत ह ैं, उसम ें उपयोग के अजधकार का अिनज करने का जिजनश्चय दकया ह।ै

अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग
करते हुए एति ् द्वारा घोषणा करती ह ै दक इस अजधसूचना स े संलग्न अनुसूची म ें जिजिर्िष्टज भूजम म ें पाईपलाईन
जबछाने के उपयोग का अजधकार अर्िजत दकया िाए:
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह
जनिेि िते ी ह ै दक उक्त भूजम म ें उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख स े केन्द्रीय सरकार म ें जनजहत
होने के बिाय सभी जिल्लंगमों स े मुक्त होकर आई.एच.बी.जल. म ें जनजहत होगा।
पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए
आई.एच.बी.जल. पूणजतया उत्तरिायी होगी और पाइपलाईन स े सम्बजन्द्धत दकसी भी मामल े पर केन्द्रीय सरकार के जिरुद्ध
कोई िाि, िािा या कानूनी कायजिाही नही हो सकेगी।

NOTIFICATION
New Delhi, the 20th July, 2022
S.O. 3305(E).—Whereas by the notification of The Government of India in the Ministry of Petroleum and
Natural Gas, published in the Gazette No. 3129 date : 12/10/2020 S.O No. 3528(E) date 07/10/2020 part-II,
Section-3, Sub-Section (ii) issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines
(Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (Hereinafter referred to as the said Act) the Central
Government declared its intention to acquire the right of user in the land situated in Tehsil - Kheda
District Kheda in Gujarat State, specified in the schedule appended to that notification for the purpose of[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
laying pipeline for the transportation of LPG from Kandla in the State Gujarat to Gorakhpur in the State of Uttar
Pradesh by the IHB Limited for implementing the “Kandla-Gorakhpur LPG Pipeline (KGPL) Project”
And whereas the copies of the said Gazette notification were made available to the public on
11/12/2020.
And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act, has
submitted his report to the Central Government.
And whereas, the Central Government after considering the report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire Right of the User therein;
Now therefore, in exercise of the power conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended
to this notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the
Central Government hereby directs that the Right of User of the said land for laying the pipeline shall,
instead of vesting in the Central Government, vests on the date of publication of this declaration, in IHB Limited,
free from all encumbrances .
IHB Limited shall be exclusively liable for any compensation in terms of section 10 of the P&MP Act,
1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to pipeline.
