का.आ. 907(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाईन (भूजम में उपयोग के अजधकार का अिजन)
अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात् उक्त अजधजनयम कहा गया ह)ैं की धारा-3 की उप-धारा (1) के अधीन
िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का.आ. 972(अ), तारीख 28 फरवरी,
2024, िो भारत के असाधारण रािपत्र, क्रमांक 927 तारीख 29 फरवरी, 2024, में प्रकाजित की गई थी, इस अजधसूचना से
संलग्न अनुसूची में जवजनर्िजष्ट भूजम में गुिरात राज्य में "कांडला गोरखपुर एल.पी.िी. पाइपलाइन पररयोिना “ अनुभाग:
जपपावाव स े आई.एच.बी. जलजमटेड डुमाड” तालुका जसहोर, जिला भावनगर में एल.पी.िी. के पररवहन हते ु आई.एच.बी.
जलजमटेड द्वारा पाईपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार के अिजन के अपने आिय की घोषणा की थी;
और उक्त रािपत्र अजधसूचना की प्रजतयां संबजन्द्धत भू-स्ट्वाजमयों को तारीख 26 अप्रैल, 2024 तक उपलब्ध करा िी
गई थी ;
और श्री अवलाभाई खातराभाई बारीआ, सक्षम प्राजधकारी और सेवाजनवृत नायब कलक्े टर, कांडला गोरखपुर एल.पी.िी.
पाइपलाइन पररयोिना, आई.एच.बी. जलजमटेड, वडोिरा (गुिरात) न े उक्त अजधजनयम की धारा 6 की उप-धारा (1) के अधीन
केन्द्रीय सरकार को ररपाजट िे िी ह ै;

और केन्द्रीय सरकार न,े उक्त ररपोटज पर जवचार करन े के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम पाइपलाईन
जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जवजनश्चय दकया ह ै ;
अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा(1) द्वारा प्रद्त्त िजक्तयों का प्रयोग करते हुए
यह घोषणा करती ह ै दक इस अजधसूचना से सलं ग्न अनुसूची में जवजनर्िजष्ट भूजम म ें पाइपलाईन जबछान े के जलए उपयोग के
अजधकार का अिजन दकया िाए ;
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा(4) द्वारा प्रद्त्त िजक्तयों का प्रयोग करते हुए, यह
जनिेि िेती ह ैदक उक्त भूजम में उपयोग का अजधकार इस अजधसूचना के प्रकािन की तारीख स ेकेन्द्रीय सरकार म ेंजनजहत होन े
के बिाए, सभी जवल्लगं मों स ेमक्तु होकर आई.एच.बी जलजमटेड में जनजहत होगी ।
पेरोजलयम और खजनि पाइपलाईन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए
आई.एच.बी जलजमटेड पणू जतय: उतरिायी होगी और पाइपलाईन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के जवरुद्ध
कोई वाि िावा या कानूनी कायवज ाही नहीं हो सकेगी ।

NOTIFICATION
New Delhi, the 18th February, 2025
S.O. 907(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural
Gas vide S.O. No. 972(E) dated the 28 February, 2024, published in the Extra Ordinary Gazette of India No. 927 dated 29
February, 2024, issued under Sub-Section (1) of Section-3 of the Petroleum and Minerals Pipelines (Acquisition of Right
of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), the Central Government declared its
intention to acquire the Right of User in the land specified in the Schedule appended to that notification for the purpose of
laying “Kandla -Gorakhpur LPG Pipeline Project, Section :- Pipavav to IHB Limited Dumad” for the transportation of
LPG in Tehsil Sihor, Bhavnagar District in the State of Gujarat by IHB Limited;
And whereas, copies of the said Gazette notification were made available to the concerned land owners upto
26th April, 2024;
And whereas, Shri Avalabhai Khatarabhai Baria, Competent Authority and Deputy Collector (Retd.), Kandla -
Gorakhpur LPG Pipeline Project, IHB Limited, Vadodara (Gujarat) has under sub-section-(1) of Section-6 of said Act,
submitted report to the Central Government;
And whereas, the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire Right of User therein;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7
Now, therefore, in exercise of the powers conferred by Sub-Section-(1) of Section-6 of the said Act, the Central
Government hereby declares that the Right of User in the land specified in the Schedule appended to this notification is
hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by Sub-Section-(4) of Section-6 of the said Act, the Central
Government hereby directs that Right of User in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vests on the date of publication of this declaration, in IHB Limited, free from all encumbrances.
IHB Limited shall be exclusively liable for any compensation in terms of Section-10 of the P&MP Act, 1962
and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
