का.आ. 4251(अ).—केंद्रीय सरकार न े पेरोजलयम और खजनि पाइपलाइन (भूजम म ें उपयोग के अजधकार का
अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसम ें इसके पश्चात उक्त अजधजनयम कहा गया ह)ै की धारा 3 की उपधारा
(1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का. आ. 2643
(अ) तारीख 05 िलु ाई, 2024 िो भारत के रािपत्र स.ं 2508, भाग–II, खंड 3, उप-खंड (ii) तारीख 05 िुलाई, 2024 म ें
प्रकाजित की गई थी, द्वारा उस अजधसूचना स े संलग्न अनुसचू ी म ें जिजनर्िजष्ट भूजम म ें हररयाणा राज्य म ें इंजडयन ऑयल
कापोरेिन जलजमटेड को कच्च े तले के पररिहन के जलए, न्य ू मद्रुं ा-पानीपत पाइपलाइन पररयोिना के तहत, चडु िा गांि स े
पानीपत तक पाइपलाइन को तहसील: गोहाना, जिला: सोनीपत, राज्य: हररयाणा म ें जबछाने के प्रयोिन के जलए उपयोग के
अजधकार के अिजन करन े के जलए अपने आिय की घोषणा की थी ।
और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी गई थी। और उक्त अजधजनयम की धारा 6 की
उपधारा (1) के अनुसरण म ें सक्षम प्राजधकारी न ेकेंद्रीय सरकार को ररपोटज िे िी ह।ै
और केंद्रीय सरकार न,े उक्त ररपोटज पर जिचार करन े के पश्चात ् और यह समाधान हो िाने पर दक उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसम ें उपयोग के अजधकार का अिनज करने का जिजनश्चय दकया ह।ै

अतः अब, केंद्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए
एति द्वारा घोषणा करती ह ै दक इस अजधसूचना स े सलं ग्न अनुसचू ी म ें जिजनर्िजष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग
के अजधकार का अिजन दकया िाए।
और केंद्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह
जनिेि िेती ह ै दक उक्त भूजम म ें उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख स े केंद्रीय सरकार म ें जनजहत होन े के
बिाए, सभी जिल्लगं मो स े मक्तु होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड म ेंजनजहत होगी।
पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए इंजडयन
ऑयल कॉपोरेिन जलजमटेड पणू तज या उत्तरिायी होगी और पाइपलाइन स े सम्बंजधत दकसी भी मामले पर केंद्रीय सरकार के
जिरुद्ध कोई िाि, िािा या कानूनी कायजिाही नहीं हो सकेगी।

MINISTRY OF PETROLEUM AND NATURAL GAS
NOTIFICATION
New Delhi, the 26th September, 2024
S.O. 4251 (E).—Whereas, by the notification of the Government of India in the Ministry of Petroleum and
Natural Gas, published in the Gazette of India No. 2508, Part-II, Section-3, Sub Section(ii) dated 05th July, 2024 vide
S.O. No.2643 (E), dated 05th July, 2024, issued under sub-section (1) of section 3 of the Petroleum and Minerals
Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), the
Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to
that notification for the purpose of laying of Pipeline from Chudva to Panipat under New Mundra - Panipat Pipeline
Project by Indian Oil Corporation Limited in Tehsil-Gohana of Sonipat District in the State of Haryana for
transportation of Crude Oil.
And whereas copies of the said Gazette notification were made available to the public, and whereas the
Competent Authority has under sub-section (1) of section 6 of the said Act, has submitted report to the Central
Government.
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline.
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from
all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the
P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to the pipeline.
