L.-33004/99 सी.जी.-डी.एल.-अ.-29112024-259026 CG-DxLx-xEG-I2D9H1x1x2x0 24-259026 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4227] नई दिल्ली, बहृ स्ट्प जतवार , नवम् बर 28, 2024/अग्रहायण 7, 1946 No. 4227] NEW DELHI, THURSDAY, NOVEMBER 28, 2024/AGRAHAYANA 7, 1946 परे ोजलयम एव ंप्राकृजतक गसै मत्रं ालय अजधसचू ना नई दिल्ली, 26 नवम् बर, 2024 का.आ. 5117(अ).— केंद्रीय सरकार न े पेरोजलयम और खजनि पाइपलाइन (भूजम में उपयोग के अजधकार का अिजन अजधजनयम) 1962 (1962 का 50) (जिसे इसम ें इसके पश्चात उक्त अजधजनयम कहा गया ह)ै की धारा 3 की उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का. आ. 2460(अ). तारीख 21 िून, 2024 िो भारत के रािपत्र सं. 2339, भाग – II, खण्ड 3, उप-खण्ड (ii) तारीख 26 िून, 2024, संख्या का. आ. 3239 (अ). तारीख 09 अगस्ट्त, 2024िो भारत के रािपत्र सं. 3085, भाग – II, खण्ड 3, उप- खण्ड (ii) तारीख 09 अगस्ट्त, 2024 एव ं संख्या का. आ. 3913(अ). तारीख 12 जसतम्बर, 2024 िो भारत के रािपत्र स.ं 3578, भाग – II, खण्ड 3, उप-खण्ड (ii) तारीख 12 जसतम्बर, 2024, म ें प्रकाजित की गई थी, द्वारा उस अजधसूचना स े संलग्न अनुसूची म ें जवजनर्िजष्ट भजू म मेंरािस्ट्थान राज्य में इंजडयन ऑयल कोपोरेिन जलजमटेड को कच्चे तले के पररवहन के जलए,न्यूमुंद्रा-पानीपत पाइपलाइन पररयोिना के तहत,चुडवा गांव स े पानीपत तक पाइपलाइन को तहसील–रोहट एव ं पाली, जिला-पाली, तहसील-रानीवाड़ा, भीनमाल एव ं िालोर, जिला-िालोर तहसील –िोधपरु एव ं पीपाड़ िहर, जिला- िोधपरु राज्य –रािस्ट्थान म ें जबछाने के प्रयोिन के जलए उपयोग के अजधकार के अिजन करने के जलय े अपन े आिय की घोषणा की थी । और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी गई थी। और उक्त अजधजनयम की धारा 6 की उपधारा (1) के अनुसरण में सक्षम प्राजधकारी न े केंद्रीय सरकार को ररपोटज िे िी ह।ै और केंद्रीय सरकार ने, उक्त ररपोटज पर जवचार करन े के पश्चात् और यह समाधान हो िाने पर दक उक्त भूजम पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जवजनश्चय दकया ह।ै 7695 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, केंद्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए एति द्वारा घोषणा करती ह ैदक इस अजधसूचना से सलं ग्न अनुसचू ी में जवजनर्िजष्ट भूजम में पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिजन दकया िाए। और केंद्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह जनिेि िेती ह ै दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केंद्रीय सरकार म ें जनजहत होन े के बिाए, सभी जवल्लगं मो से मक्तु होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड म ेंजनजहत होगी। पेरोजलयम और खजनि पाइपलाइन अजधजनयम,1962 की धारा 10के अधीन दकसी भी क्षजतपर्ू तज के जलए इंजडयन ऑयल कॉपोरेिन जलजमटेड पणू तज या उत्तरिायी होगी और पाइपलाइन से सम्बंजधत दकसी भी मामले पर केंद्रीय सरकार के जवरुद्ध कोई िावा या कानूनी कायजवाही नहीं हो सकेगी। अनसु चू ी तहसील –रानीवाड़ा जिला – िालोर राज्य - No. 2460(E) dated the 21stJune, 2024, no.3085, Part-II, section-3, sub-section (ii) dated 09th August 2024 vide S.O. No. 3239(E) dated the 09stAugust, 2024 and no.3578, Part-II, section-3, sub-section (ii) dated 12th September 2024 vide S.O. No. 3913(E) dated the 12th September 2024 issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962),(hereinafter referred to as the said Act), the Central Government declared its intention to acquire the right of user in the land specified in the[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 Schedule appended to that notification for the Purpose of laying of Pipeline from Chudva to Panipat under New Mundra - Panipat Pipeline Project by Indian Oil Corporation Limited in Tehsil–Raniwada,Bhinmal and Jalore of Jalore District,Tehsil–Rohat and Pali of Pali District and Tehsil- Jodhpur and Pipar City of Jodhpur District in State of Rajasthan.For transportation of crude oil. And whereas copies of the said Gazette notification were made available to the public. And whereas, under sub-section (1) of section 6 of the said Act the Competent Authority has submitted report to the Central Government. And whereas, the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein. Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline. And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances. Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
