और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी गई थी; और सक्षम प्राजधकारी ने, उक्त अजधजनयम की धारा 6 की उप-धारा (1) के अधीन केन्द्रीय सरकार को अपनी ररपोटच िे िी ह;ै और केन्द्रीय सरकार ने, उक्त ररपोटच पर जिचार करने के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम पाइपलाइन जबछाने के जलय ेअपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनच करने का जिजनजश्चय दकया है; 2199 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए यह घोषणा करती ह ै दक इस अजधसूचना से सलं ग्न अनुसूची में जिजनर्िचष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिचन दकया िाए; NO.1067(E) dated 9th March,2022 and Erratum S.O.NO.1988(E) dated 28th April, 2022 issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act), published in the weekly Gazette of India Extraordinary No.1035, dated 10th March, 2022 and Erratum Gazette of India No.1888, dated 29th April, 2022the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying Krishnapatnam - Hyderabad Pipeline for transportation of Petroleum products from Krishnapatnam (SPSR Nellore, Andhra Pradesh) to Hyderabad of Telangana State by Bharat Petroleum Corporation Limited; And whereas copies of the said Gazette notification were made available to the public; And whereas the competent authority has under sub-section (1) of Section 6 of the said Act submitted report to the Central Government;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire the right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, the Central Government hereby declares that the right of user in the land, specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of the publication of the declaration, in Bharat Petroleum Corporation Limited, free from all encumbrances. Bharat Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
