का.आ. 5384(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइन (भूजम म ें उपयोग के अजधकार का
अिजन), अजधजनयम 1962 (1962 का 50) (जिसे इसम ें इसके पश्चात उक्त अजधजनयम कहा गया ह)ै दक धारा 3 की उप
धारा-(1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या
का.आ. 669 (अ) दिनांक 15 फरवरी, 2022 और भूल का.आ.1989 (अ) दिनांक 28 अप्रलै , 2022 िो भारत के
साप्ताजहक रािपत्र अजधसूचना संख्या का.आ. 650, दिनांक 15 फरवरी, 2022 और भलू रािपत्र संख्या 1889, दिनांक 29
अप्रैल, 2022 म ें प्रकाजित की गई थी द्वारा उस अजधसूचना स े संलग्न अनुसूची म ें जवजनर्िष्टज भूजम म ें कृष्णापमनम
एस.पी.एस.आर नेल्लोर, आंध्र प्रिेि स े हिै राबाि, तेलंगाना राज्य तक पेरोजलयम उत्पािों के पररवहन के जलए
कृष्णापमनम- हिै राबाि पाइपलाइन पररयोिना के माध्यम स े भारत पेरोजलयम कॉपोरेिन द्वारा पाइपलाइन जबछान े के
प्रयोिन के जलए उपयोग के अजधकार का अिजन के अपने आिय की घोषणा की थी;
और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी गई थी;
और सक्षम प्राजधकारी न,े उक्त अजधजनयम की धारा 6 की उप-धारा (1) के अधीन केन्द्रीय सरकार को अपनी
ररपोमज िे िी ह;ै

और केन्द्रीय सरकार न,े उक्त ररपोम ज पर जवचार करने के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम
पाइपलाइन जबछान े के जलय ेअपेजक्षत ह,ै उसम ें उपयोग के अजधकार का अिजन करन े का जवजनजश्चय दकया ह;ै
अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए
यह घोषणा करती ह ै दक इस अजधसूचना स े सलं ग्न अनुसूची म ें जवजनर्िष्टज भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के
अजधकार का अिजन दकया िाए;
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, यह
जनिेि िेती ह ै दक उक्त भूजम म ें उपयोग का अजधकार इस घोषणा के प्रकािन की दिनांक स े केन्द्रीय सरकार म ें जनजहत होन े
की बिाए, सभी जवल्लंगमों स ेमुक्त होकर भारत पेरोजलयम कॉपोरेिन जलजममेड म ें जनजहत होगी।
पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्त ज के जलए भारत
पेरोजलयम कॉपोरेिन जलजममेड पणू जतया उत्तरिायी होगा और पाइपलाइन स े सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय
सरकार के जवरूद्ध कोई वाि, िावा या कानूनी कायजवाही नहीं हो सकेगी।

NOTIFICATION
New Delhi, the 19th December, 2023
S.O. 5384(E).— Whereas by a notification of the Government of India in the Ministry of Petroleum and
Natural Gas S.O. NO.669(E) dated 15th February, 2022 and Erratum S.O.NO.1989(E) dated 28th April, 2022 issued
under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act,
1962 (50 of 1962) (hereinafter referred to as the said Act), published in the weekly Gazette of India Extraordinary
No.650, 15th February, 2022 and Erratum Gazette of India No.1889, 29th April, 2022 the Central Government declared
its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the
purpose of laying Krishnapatnam - Hyderabad Pipeline for transportation of Petroleum products from Krishnapatnam
(SPSR Nellore, Andhra Pradesh) to Madharam near Hyderabad (Ranga Reddy, Telangana) by Bharat Petroleum
Corporation Limited;
And whereas copies of the said Gazette notification were made available to the public;
And whereas the competent authority has under sub-section (1) of Section 6 of the said Act submitted report
to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire the right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, the
Central Government hereby declares that the right of user in the land, specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of the publication of the declaration, in Bharat Petroleum Corporation Limited,
free from all encumbrances.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Bharat Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of Section
10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any
matter relating to the pipeline.
