3713 दिनांक 01 अक्टूबर, 2021 में प्रकाजित की गई थी द्वारा उस अजधसूचना से संलग्न अनुसूची में जिजनर्िजष्ट भूजम में कृष्णापटनम एस.पी.एस.आर नेल्लोर, आध्रं प्रिेि स े हिै राबाि, तले गं ाना राज्य तक पेरोजलयम उत्पािों के पररिहन के जलए कृष्णापटनम- हिै राबाि पाइपलाइन पररयोिना के माध्यम से भारत पेरोजलयम कॉपोरेिन द्वारा पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार का अिजन के अपने आिय की घोषणा की थी; और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी गई थी; और सक्षम प्राजधकारी न,े उक्त अजधजनयम की धारा 6 की उप-धारा (1) के अधीन केन्द्रीय सरकार को अपनी ररपोटज िे िी ह;ै और केन्द्रीय सरकार ग्न अनुसूची में जिजनर्िजष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिजन दकया िाए; और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, यह जनिेि िेती ह ै दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की दिनांक से केन्द्रीय सरकार में जनजहत होन े की बिाए, सभी जिल्लगं मों से मुक्त होकर भारत पेरोजलयम कॉपोरेिन जलजमटेड म ेंजनजहत होगी। पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए भारत पेरोजलयम कॉपोरेिन जलजमटेड पणू जतया उत्तरिायी होगा और पाइपलाइन स े सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF PETROLEUM AND NATURAL GAS NOTIFICATION New Delhi, the 19th December, 2023 S.O. 5388(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and Natural Gas S.O. NO.4047(E) dated the 21st August, 2021 issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act), published in the weekly Gazette of India No.3713, 1st October, 2021 the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying Krishnapatnam - Hyderabad Pipeline for transportation of Petroleum products from Krishnapatnam (SPSR Nellore, Andhra Pradesh) to Madharam near Hyderabad (Ranga Reddy, Telangana) by Bharat Petroleum Corporation Limited; And whereas copies of the said Gazette notification were made available to the public; And whereas the competent authority has under sub-section (1) of Section 6 of the said Act submitted report to the Central Government; And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire the right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, the Central Government hereby declares that the right of user in the land, specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of the publication of the declaration, in Bharat Petroleum Corporation Limited, free from all encumbrances. Bharat Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
