और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को दिनांक 31 माच,ा 2023 तक उपलब्ध करा िी गई थी; और सक्षम प्राजधकारी न,े उक्त अजधजनयम की धारा 6 की उप-धारा (1) के अधीन केन्द्रीय सरकार को अपनी ररपोटा ि े िी ह;ै और केन्द्रीय सरकार न,े उक्त ररपोटा पर जवचार करन े के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम पाइपलाइन जबछान े के जलय ेअपेजक्षत ह,ै उसम ें उपयोग के अजधकार का अिना करन े का जवजनजश्चय दकया ह;ै 7273 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए यह घोषणा करती ह ै दक इस अजधसूचना स े सलं ग्न अनुसूची म ें जवजनर्िाष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिान दकया िाए; NO.449(E) dated 30th January, 2023 issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (Act 50 of 1962) (hereinafter referred to as the said Act), published in the Gazette of India Extraordinary No.435 Dated 30th January, 2023 the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying Krishnapatnam - Hyderabad Pipeline for transportation of Petroleum products from Krishnapatnam (SPSR Nellore, Andhra Pradesh) to Malkapur near Hyderabad (Ranga Reddy, Telangana) by Bharat Petroleum Corporation Limited; And whereas copies of the said Gazette notification were made available to the public up to 31st March, 2023; And whereas the competent authority has under sub-section (1) of Section 6 of the said Act submitted report to the Central Government; And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire the right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, the Central Government hereby declares that the right of user in the land, specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of the publication of the declaration, in Bharat Petroleum Corporation Limited, free from all encumbrances. Bharat Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
