50) (लजसे इसम ें इसके पशचात उक्त अलिलनयम कहा गया ह)ै की िारा 3 की उपिारा (1) के अिीन जारी की गई भारत सरकार के पेट्रोलियम और प्राकृलतक गैस मंत्रािय की अलिसूचना संख्या का.आ. 2122 (अ) तारीख 29 मई, 2024 जो भारत के राजपत्र तारीख 29 मई, 2024. म ेंप्रकालशत की गई थी, द्वारा उस अलिसूचना स ेसंिग्न अनुसूची म ें लिलनर्दजष्ट भूलम म ें राजस्थान राज्य म ें बाड़मेर स े गुजरात राज्य म ें भोगत तक क्रूड ऑयि स्थानान्द्तरण के लिए बाड़मेर - भोगत पाइपिाइन पररयोजना के अंतगजत िेदांता लिलमटेड और ऑयि एण्ड नेचुरि गैस कारपोरेशन लिलमटेड द्वारा पाइपिाइन लबछाने के प्रयोजन के लिए उपयोग के अलिकार का अजजन के अपन े आशय की घोषणा की थी ; और उक्त असाधारण राजपत्र अलिसूचना की प्रलतयां जनता को तारीख 04 जिु ाई, 2024 को उपिब्ि करा दी गई थी; 6473 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और सक्षम प्राजधकारी ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोर्ट िे िी ह;ै और केन्द्रीय सरकार न े उक्त ररपोर्ट पर जवचार करन े के पश्चात् और यह समाधान हो िाने पर दक उक्त भूजम पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनट करने का जवजनश्चय दकया ह:ै अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए यह घोषणा करती ह ै दक इस अजधसूचना से सलं ग्न अनुसूची में जवजनर्िटष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिटन दकया िाए; और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए यह जनिेि िेती ह ैदक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के बिाए, सभी जवल्लगं मों से मक्तु होकर ऑयल एण्ड नेचुरल गैस कॉरपोरेिन जलजमर्ेड म ेंजनजहत होगा। पेरोजलयम और खजनि पाइपलाइन अजधजनयम,1962 की धारा 10 के अध्याधीन दकसी भी क्षजतपूर्तट के जलए ऑयल एण्ड नेचुरल गैस कॉरपोरेिन जलजमर्ेड पणू टतया उत्तरिायी होगी और सजचव MINISTRY OF PETROLEUM AND NATURAL GAS NOTIFICATION New Delhi, the 7th October, 2024 S.O. 4351(E).—Whereas by the notification of Government of India in Ministry of Petroleum and Natural Gas Number S.O. 2122(E) Dated the 29th May, 2024, issued under sub-section (1) of Section 3 of the petroleum and Minerals Pipeline (Acquisition of Right of User in Land) Act 1962 (hereinafter referred to as the said Act), published in the Gazette of India dated the 29th May, 2024 the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for evacuation of Crude Oil from Barmer in the State of Rajasthan to Bhogat in the State of Gujarat within Barmer -Bhogat Pipeline Project by Vedanta Limited and Oil & Natural Gas Corporation Limited; And whereas copies of the said Gazette notification were made available to the public on the 30th May, 2024;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act submitted his report to the Central Government, And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying this pipeline, has decided to acquire right of user therein, Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of this declaration, in Vedanta Limited and Oil & Natural Gas Corporation Limited, free from all encumbrances. Vedanta Limited and Oil & Natural Gas Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline; SCHEDULE District:- Barmer State :- Rajasthan Area Sl.
