Adani Ports and Special Economic Zone Limited (formerly M/s. Mundra Port and Special Economic Zone Limited), had proposed under section 3 of the Special Economic Zones Act, 2005 (28 of 2005), (hereinafter referred to as the said Act) to set up a Multi Product Special Economic Zone at Mundra Taluka, District Kutch, in the State of Gujarat; AND, WHEREAS, the Central Government approved the request of change of name from M/s. Mundra Port and SEZ Limited to M/s. Adani Ports and Special Economic Zone Limited; AND, WHEREAS, the Central Government, in exercise of the powers conferred by sub-section (1) of section 4 of the said Act read with rule 8 of the Special Economic Zones Rules 2006, had re-notified an area of 8481.2784 hectares at the above Special Economic Zone vide Ministry of Commerce and Industry Notification Number S.O. 3029(E) dated 21st September, 2016 by consolidating all the Special Economic Zones notified earlier vide Notification Nos. S.O.1365(E) dated 27th May, 2009; S.O. 583(E) dated 26th March, 2012; S.O. 1443(E) dated 31st May, 2013 and S.O. 3379(E) dated 11th December, 2015 and subsequently de-notified an area of 46.6894 hectares at the above Special Economic Zone vide Ministry of Commerce and Industry Notification Number S.O. 2452(E) dated 4th July, 2019; AND, WHEREAS, M/s. Adani Ports and Special Economic Zone Limited has now proposed for de-notification of 151.8220 hectares from the above Special Economic Zone;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 AND, WHEREAS, the State Government of Gujarat has given its approval to the proposal vide letter No. IC/INFRA/SEZ/NOC/1760233 dated 28th October, 2021; AND, WHEREAS, the Development Commissioner, APSEZ has recommended the proposal for de-notification of an area of 151.8220 hectares of the Special Economic Zone; AND, WHEREAS, the Central Government is satisfied that the requirements under sub-section (8) of section 3 of the said Act and other related requirements are fulfilled and the de-notified land will be utilized for industrial purposes (Crude Oil terminal) as per Developer’s application form dated 02nd March, 2021; NOW, THEREFORE, in exercise of the powers conferred by second proviso to sub-section (1) of section 4 of the Special Economic Zones Act, 2005 and in pursuance of rule 8 of the Special Economic Zones Rules, 2006, the Central Government hereby partial de-notifies an area of 151.8220 hectares at Mundra Taluka, District Kutch, in the State of Gujarat, thereby making resultant area as 8282.7670 hectares.
