L.-33004/99 सी.जी.-डी.एल.-अ.-06012022-232475 xxxGIDHxxx CG-DL-E-06012022-232475 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 9] नई ददल्ली, बृहस्ट्प जतवार, जनवरी 6, 2022/पौष 16, 1943 No. 9] NEW DELHI, THURSDAY, JANUARY 6, 2022/PAUSHA 16, 1943 खान मत्रं ालय अजधसचू ना नई ददल् ली, 6 जनवरी, 2022 सा.का.जन. 9(अ).—राष्ट्रपजत, संजवधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त िजियों का प्रयोग करत े हुए और भारतीय खान ब्यूरो (श्रेणी-3 अजलजपकवगीय पद) भती जनयम, 1965 को, जहां तक उनका संबंध हल्के वाहन का चालक और मैकेजनकल ड्राईवर के पदों से ह,ै उन बातों के जसवाय अजधक्ांत करत े हुए जजन् ह ें से अजधक्मण स े पूवव दकया गया ह ैया करने का लोप दकया गया ह,ै खान मंत्रालय के भारतीय खान ब्यूरो में स्ट्टाफ़ कार चालक ग्रडे I, स्ट्टाफ़ कार चालक ग्रडे II और स्ट्टाफ़ कार चालक (साधारण ग्रेड) के पदों पर भती की पद्धजत का जवजनयमन करने के जलए जनम्नजलजखत जनयम बनात े ह,ैं अथावत ् :- 1. सजं िप्त नाम और प्रारंभ.—(1) इन जनयमों का संजिप् त नाम खान मंत्रालय, भारतीय खान ब् यूरो, स्ट्टाफ़ कार चालक ग्रडे I, स्ट्टाफ़ कार चालक ग्रडे II और स्ट्टाफ़ कार चालक (साधारण ग्रेड) भती जनयम, 2022 ह।ै (2) ये राजपत्र में प्रकािन की तारीख को प्रवृत्त होंगे। 2. आरंजभक गठन.— इन जनयमों के प्रारंभ की तारीख को स्ट्टाफ कार चालक ग्रडे I, स्ट्टाफ कार चालक ग्रेड II और स्ट्टाफ कार चालक (साधारण ग्रडे ) के पदों पर जनयजमत आधार पर पदाजधकारी व्यजियों को इन जनयमों के अधीन उि पदों पर जनयुि दकया गया माना जाएगा और उि जनयमों के प्रारंभ स े पूवव उि पदों पर जनयजमत आधार पर उनके द्वारा की गई सेवाओं को उनकी पररवीिा अवजध, ज्य ष्ठताे ता और अगले उच श श्रेणी म ें प्रोनतिजत के जलए पात्रता को ययान में रखा जाएगा। 112 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. पदों की सख्ं या, वगीकरण और वते न मरै रक्स म ें स्ट्त र— उक्त पदों की संख्या, उनका वगीकरण और उससे उपाबद्ध वेतन मैररक्स म ेंस्ट् तर वे होंगे जो इन जनयमों से उपाबद्ध अनुसूची के स्ट् तंभ (2) से स्ट् तभं (4) में जवजनर्ददष्ट ह।ैं 4. भती की पद्धजत, आय-ु सीमा, अहतव ाएं, आदद— उक्त पदों पर भती की पद्धजत, आय-ु सीमा, अहतव ाए ं और उससे संबंजधत अन्य बातें वे होंगी जो पूवोि अनुसूची के स्ट्त ंभ (5) से स्ट् तंभ (13) में जवजनर्ददष्ट ह।ैं 5. जनरहतव ा —वह व् यजि— (क) जजसने से व्यजि से जजसका पजत या जजसकी पत् नी जीजवत ह,ैं जववाह दकया ह ै या जववाह की संजवदा की ह;ै या (ख) जजसने अपने पजत या अपनी पत् नी के जीजवत रहत े हुए दकसी व्यजि से जववाह दकया है या जववाह की संजवदा की ह,ै उि पदों पर जनयुजि का पात्र नहीं होगा: परंतु यदद केंद्रीय सरकार का यह समाधान हो जाता ह ै दक सा जववाह से व्यजि और जववाह के अन्य पिकार को लाग ू स्ट् वीय जवजध के अधीन अनञेयु ेय ह ै और सा करन े के जलए अन्य आधार ह ैं तो वह दकसी व्यजि को इस जनयम के प्रवतवन से छूट दे सकेगी। 6. जिजथल करन े की िजि— जहााँ केंद्रीय सरकार की यह राय ह ै दक सा करना आवश्यक या समीचीन है, वहााँ वह उसके जलए जो कारण ह,ैं उन् ह ें लेखबद्ध करके, इन जनयमों के दकसी उपबंध को दकसी वगव या प्रवगव के व्यजियों की बावत, आदिे द्वारा जिजथल कर सकेगी। 7. व्य ावजृ त्त— इन जनयमों की कोई बात, से आरिण, आय-ु सीमा में छूट और अन्य ररयायतों पर प्रभाव नहीं डालगे ी, जजनका केंद्रीय सरकार द्वारा इस संबंध म ें समय-समय पर जारी दकए गए आदेिों के अनुसार अनुसूजचत जाजतयों, अनुसूजचत जनजाजतयों, अन्य जपछडे वगों, भूतपूवव सैजनकों और अन्य जविेष प्रवगव के व्यजियों के जलए उपबंध करना अपेजित ह।ै अनसु चू ी पद का नाम पद की संख्या वगीकरण वते न मैररक् स में स्ट्त र चयन अथवा अचयन पद। (1) (2) (3) (4) (5) 1. स्ट्टाफ कार चालक 20* (2022) साधारण केन्द्रीय सेवा, स्ट् तर– 5 अचयन। ग्रेड-I समूह 'ग', अराजपजत्रत, *कायवभार के (29200-92300 रू.) अननुसजचवीय। आधार पर पररवतवन दकया जा सकता ह।ै सीधे भती दकए जाने सीधे भती दकए सीधे भती दकए जाने वाले पररवीिा की अवजध, भती की पद्धजत: भती सीधी वाले व् यजियों के जलए जाने वाले व् यजियों के जलए जवजहत यदद कोई हो। होगी या प्रोनतिजत द्वारा या आयु सीमा व् यजियों के जलए आयु और िैजिक अहतव ाएं प्रजतजनयुजि या आमेलन द्वारा अपेजित िैजिक प्रोनतित व् यजियों की दिा तथा जवजभनति पद्धजतयों द्वारा और अन्य में लागू होंगी या नहीं। भरी जाने वाली ररजियों की अहतव ाएं। प्रजतितता। (6) (7) (8) (9) (10) लागू नहीं होता। लागू नहीं होता। लागू नहीं होता। लागू नहीं होता। प्रोन् नजत[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 प्रोनतिजत अथवा प्रजतजनयुजि/ आमेलन द्वारा भती की दिा में वे श्रेजणयां जजनसे प्रोनतिजत अथवा प्रजतजनयुजि/ आमेलन दक या जाएगा। (11) प्रोन् नजत : वेतन मैररक्स के स्ट् तर - 4 (25500 - 81100 रू.) में स े स्ट्टाफ कार चालक ग्रेड II जजन् होंने उस ग्रेड में छह वषव जनयजमत सेवा की हो या स्ट्टाफ कार चालक ग्रेड II और स्ट्टाफ कार चालक (साधारण ग्रेड) के पद पर पंद्रह वषव की संयुि सेवा की हो; और सरकार द्वारा जवजनर्ददष्ट व् यावसाजयक परीिण उत्तीणव दकया हो। रटप्पण: जहां से कजनष्ठता व्यजियों के संबंध में, जजन्होंने अपनी अहकव या पात्रता सेवा पूरी कर ली है, प्रोनतिजत के जलए जवचार दकया जा रहा हो, वहां उनसे ज्य ेष् ठ व्यजियों के संबंध में भी जवचार दकया जाएगा परन्तु यह तब जब दक उसके द्वारा की गई सी अहवक या पात्रता सेवा, अपेजित अहकव या पात्रता सेवा के आधे से अजधक से या दो वषव से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपन े से कजनष्ठता व्यजियों सजहत, जजन्होंने सी अहकव या पात्रता सेवा पहले ही पूरी कर ली है, अगली उच शतर ग्रेड में प्रोनतिजत के जलए अपनी पररवीिा की अवजध सफलतापूववक पूरी कर ली हो। यदद जवभागीय प्रोनतिजत सजमजत है, तो उसकी संरचना भती करने में दकन पररजस्ट्थजतयों म ें संघ लोक सेवा आयोग से परामिव दकया जाएगा। (12) (13) समूह 'ग' जवभागीय प्रोन् नजत सजमजत (प्रोन्न जत के संबंध में जवचार करने के जलए) जो लागू नहीं होता। जनम् नजलजखत से जमलकर बनेगी :- 1. िेत्रीय खान जनयंत्रक, भारतीय खान ब्यूरो - अययि; 2. ज् येष्ठता खनन भूजवञेयानी, भारतीय खान ब्यूरो - सदस्ट्य; 3. प्रिासजनक अजधकारी/ भंडार अजधकारी, भारतीय खान ब्यूरो - सदस्ट्य। (1) (2) (3) (4) (5) 3. स्ट्टाफ कार चालक 9* (2022) साधारण केन्द्रीय सेवा, स्ट् तर– 2 लागू नहीं होता । (सामान्य ग्रेड) समूह 'ग', अराजपजत्रत, *कायवभार के आधार (19900-63200 रू.) अननुसजचवीय। पर पररवतवन दकया जा सकता ह।ै (6) (7) (8) (9) (10) 18 और 25 वषव के बीच* आवश्यक:- लागू नहीं सीधी भती प्रजतजनयुजि होता। दकए जाने जजसके न हो सकने *अजखल भारतीय खुली प्रजतयोजगता (i) जजनके पास मोटर कारों के वाले व् यजियों पर सीधी भती द्वारा भरे जाने की दिा में, यह 18 जलए जवजधमान् य चालक अनुञेयजति है और द्वारा वषव से 27 वषव के बीच होगा I (ii) जजन् ह ें मोटर यंत्र दक्या का पुनर्थनयोजजत सिस्त्र बल (केंद्रीय सरकार द्वारा जारी दकए ञेयान हो (अभ्यथी को यान की छोटी- व् यजियों के कार्थमकों के जलए : गए अनुदिे ों या आदिे ों के अनुसार मोटी खराजबयों को दरू करने की िमता जलए दो वषव प्रजतजनयुजि/ सरकारी सेवकों के जलए जिजथल हो) पुनर्थनयोजन करके 40 वषव तक जिजथल की जा (iii) जजनके पास मोटर कार चलाने सकती ह)ै का कम से कम 3 वषव का अनुभव हो, और रटप्पण :- आयु सीमा अवधाररत (iv) जो 10वीं किा उत्तीणव दकया करने के जलए जनणावयक तारीख हो। भारत में अभ्यर्थथयों से आवेदन पत्र प्राप्त करने के जलए जनयत की गई वाछं नीय:- होम गाडव/ जसजवल स्ट्वयं अंजतम तारीख होगी (न दक वह सेवकों के रूप में 3 वषव की सेवा I अंजतम तारीख जो असम, मेघालय, रटप्प ण 1: अहतव ाएं, अन् यथा सुअर्थहत अरुणाचल प्रदिे , जमज़ोरम, अभ् यर्थथयों की दिा में सिम प्राजधकारी मजणपुर, नागालैंड, जत्रपुरा, जसदिम, के जववेकानुसार जिजथ ल की जा सकती जहमाचल प्रदिे के लाहौल और ह।ै स्ट्पीजत जजला और चंबा जजला के रटप्प ण 2: अनुभव संबंधी अहतव ा पंगी उप खंड, लद्दाख या अंदमान (अहतव ाएं) सिम प्राजधकारी के तथा जनकोबार द्वीप समूह या जववेकानुसार अनुसूजचत जाजतयों और लिद्वीप संघ राज्य िेत्रों के अनुसूजचत जनजाजतयों के अभ् यर्थथयों की अभ्यर्थथयों के जलए जनयत की गई दिा में तब जिजथल की जा सकती ह ैंजब हIै)[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 चयन के दकसी प्रक्म पर सिम प्राजधकारी की यह राय ह ैदक उनके जलए आरजित ररजियों को भरने के जलए अपेजित अनुभव रखने वाले उन समुदायों के अभ् यर्थथयों के पयावप्त संख्य ा में उपलब् ध होने की संभावना नहीं ह।ै (11) प्रजतजनयुजि: केंद्रीय सरकार या राज्य सरकार या संघ राज्य िेत्रों में वेतन मैररक् स के स्ट्त र-1 (18000-56900 रु.) में जनयजमत सवार हरकारा (समूह ‘ग’) और समूह ‘ग’ के कमवचाररयों में से जजनके पास मोटर कारों को चलाने की सिमता जनधावरण करने के जलए चालन परीिण के आधार पर मोटर कारों के जलए जवजधमान् य चालन अनुञेयजति है, जजसके न हो सकने पर केंद्रीय सरकार के अन् य मंत्रालयों में वेतन मैररक् स में स्ट् तर-1 (18000-56900 रु.) में जनयजमत आधार पर सवार हरकारा या जनयजमत समूह 'ग' कमवचारी का पदधारण दकए हुए ह ैं जो स्ट् तंभ (7) में यथावर्थणत अपेजित अहतव ाएं पूरी करते ह।ैं सिस्त्र बल के कार्थमकों के जलए प्रजतजनयुजि/ पुनर्थनयोजन:- सिस्त्र बल के कार्थमकों पर भी जवचार दकया जाएगा जो एक वषव की अवजध के भीतर सेवाजनवृत्त होने वाले ह ैंया ररजवव में स्ट्थानांतररत दकए जाने वाले ह ैंऔर जजनके पास अपेजित अनुभव और जवजहत अहवताएं ह।ैं से व्यजियों को उस तारीख तक प्रजतजनयुजि की जनबंधनों पर रखा जाएगा जजस तारीख को उन् हें सिस्त्र बलों से जवमुक् त दकया जाना ह;ै तत् पश् चात् उन्ह ें पुनर्थनयोजन, पर बने रहने ददया जा सकता ह।ै रटप्प ण (i): प्रजतजनयजु ि की अवजध, जजसके अंतगवत केंद्रीय सरकार के उसी या दकसी अन्य संगठन या जवभाग में इस जनयुजि से ठीक पहले धाररत दकसी अन्य काडर बाह्य पद पर प्रजतजनयुजि की अवजध है, साधारणतया तीन वषव से अजधक नहीं होगी। रटप्प ण (ii): प्रजतजनयुजि द्वारा जनयजु ि के जलए अजधकतम आयु सीमा आवेदन प्राप्त करने की अंजतम तारीख को 56 वषव से अजधक नहीं होगी। (12) (13) समूह 'ग' जवभागीय पुजष् ट सजमजत (पुजष्ट के संबंध में जवचार करने के जलए) जो जनम् नजलजखत से जमलकर लागू नहीं होता। बनेगी:- 1. उप खान जनयंत्रक /अयस्ट्क प्रसाधन अजधकारी, भारतीय खान ब्यूरो - अययि; 2. कजनष्ठता खनन भूजवञेयानी/ सहायक खजनज अथविास्त्री (आसूचना), भारतीय खान ब्यूरो - सदस्ट्य; 3. सहायक भंडार अजधकारी/ सहायक प्रिासजनक अजधकारी, भारतीय खान ब्यूरो - सदस्ट्य। [फा. सं. 22/5/2019-एम.III] संजय लोजहया, अपर सजचव MINISTRY OF MINES NOTIFICATION New Delhi, the 6th January, 2022 G.S.R. 9(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Indian Bureau of Mines (Class III Non-Ministerial Posts) Recruitment Rules, 1965, in so far as they relate to the posts of Light Vehicle Driver and Mechanic-Cum-Driver, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Staff Car Driver Grade I, Staff Car Driver Grade II and Staff Car Driver (Ordinary Grade) in Indian Bureau of Mines, Ministry of Mines namely:-—6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. Short title and commencement.—(1) These rules may be called the Ministry of Mines, Indian Bureau of Mines, Staff Car Driver Grade I, Staff Car Driver Grade II and Staff Car Driver (Ordinary Grade) Recruitment Rules, 2022. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Initial Constitution.— The persons holding the posts of Staff Car Driver Grade I, Staff Car Driver Grade II and Staff Car Driver (Ordinary Grade) on regular basis on the date of commencement of these rules shall be deemed to have been appointed to said posts under these rules and the services rendered by them in the said posts on regular basis before the commencement of said rules shall be taken into account for deciding their period of probation, seniority and eligibility for promotion to the next higher grade. 3. Number of posts, classification and level in pay matrix.—The number of the said posts, their classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 4. Method of recruitment, age-limit, qualifications, etc.-— The method of recruitment, age- limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the aforesaid Schedule. 5. Disqualifications .—No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 7. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. (11) Promotion : Staff Car Driver Grade II in level 4 (Rs. 25500-81100) in the pay matrix with six years of regular service in the grade or with a combined service of fifteen years in Staff Car Driver Grade II and Staff Car Driver (Ordinary Grade); and have passed the trade test, specified by the Government. Note: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service. Deputation/re-employment for Armed Forces Personnel :- The Armed Forces Personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered. Such persons would be given deputation terms upto the date on which they are due for release from the Armed Forces; thereafter they may be continued on re-employment. Note (i): The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not exceed three years. Note (ii): The maximum age limit for appointment by deputation shall be ‘not exceeding 56 years’ as on the closing date of receipt of applications.
