L.-33004/99 सी.जी.-डी.एल.-अ.-16032024-253089 xxxGIDHxxx CG-DLxx-xEG-I1D6E0x3x2x0 24-253089 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 1356] नई ददल्ली, िुक्रवार, मार्ध 15, 2024/फाल्ग नु 25, 1945 No. 1356] NEW DELHI, FRIDAY, MARCH 15, 2024/PHALGUNA 25, 1945 वाजणज्य और उद्योग मत्रं ालय (उद्योग संवधनध और आतं ररक व्य ापार जवभाग) आदेि नई ददल् ली, 15 मार्ध, 2024 का.आ. 1422(अ).—भारतीय मानक ब् यूरो अजधजनयम, 2016 (2016 का 11) की धारा 25 की उप-धारा (3) के साथ परित धारा 16 की उप-धाराओं (1) और (2) द्वारा प्रदत् त िजियों का प्रयोग करते हुए तथा सभी रबड़ और पॉलीमर सामग्री स े बन े फुटजवयर और इसके घटक (गुणवत् ता जनयंत्रण) आदिे , 2022, के अजधक्रमण म,ें जसवाय ऐसे कायों के िो अजधक्रमण से पहले दकए गए अथवा जिन् ह ें दकए िाने से छोड़ ददया गया, केंद्र सरकार का ब् यूरो के साथ परामिध करने के बाद यह मत ह दक यह िनजहत म ेंआवश् यक अथवा जहतकर ह, अत: एतद्द्वारा जनम्न जलजखत आदेि करती ह, नामत: 1. संजिप्त िी्कध और प्रारंभ.(1) इस आदेि को सभी रबड़ और सभी पॉलीमर सामग्री स े बने फुटजवयर और इसके घटक (गणु वत् ता जनयंत्रण) आदेि, 2024 कहा िाए। (2) यह आदेि ददनांक 01 अगस्ट्त, 2024 से प्रभावी होगा। 2. मानक जर्ह्न का अजनवाय धप्रयोग. ताजलका के कॉलम (2) में जवजनर्दष्ध ट वस्ट् तुएं या सामान उ‍त ताजलका के कॉलम (3) म ें उजल्लजखत तद्नरूु पी भारतीय मानक के अनुरूप होंग े तथा उनमें भारतीय मानक ब् यूरो (अनुपालन मूल् यांकन) जवजनयम, 2031 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2018 की अनुसूर्ी-II की स्ट् कीम-I के अनुसार ब् यरू ो के लाइससें के तहत मानक जर्ह्न लगा होगा। बिते दक जनयाधत की िाने वाली वस्ट् तओंु या सामान पर इस आदेि में स ेकुछ भी लाग ू नहीं होगा। बिते यह भी दक समय-समय पर यथा संिोजधत सूक्ष्म , लघ ु और मध् यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के अनुच्छेद के तहत यथा पररभाज्त सूक्ष्म और लघ ुजवजनमाधण इकाइयों पर इस आदिे म ेंसे कुछ भी लागू नहीं होगा। बिते यह भी दक केवल जनयाधत के जलए भारत में फुटजवयर के जवजनमाधण में प्रयु‍ त की िाने वाली जनम्न जलजखत ताजलका म ें जवजनर्दष्ध ट वस्ट् तुओं अथवा सामान के आयात पर इस आदेि में से कुछ भी लाग ूनहीं होगा: क्र.स.ं वस्ट्त एु ं अथवा सामान भारतीय मानक भारतीय मानक का िी्कध (घटक) (i) (ii) (iii) (iv) 1. मोजल्डड रबड़ आउटसोल आईएस 5676:1995 मोजल्डड रबड़ यूजनट आउटसोल – जविे्ताएं 2. आउटसोल के जलए माइक्रोसेल् यलु र आईएस 6664:1992 आउटसोल के जलए माइक्रोसेल् यलु र रबड़ िीट रबड़ िीट – जविे्ताए ं 3. मोल् डेड पीवीसी आउटसोल आईएस 6719:1972 मोल्ड ेड पीवीसी यूजनट आउटसोल — जविे्ताएं 4. पीयू आउटसोल आईएस 13893:1994 पॉलीयूरेथने यूजनट आउटसोल - जविे्ताएं बिते यह भी दक आयातक को, ऐसे फुटजवयर सोल के आयात की अनुमजत सीमा िल्ु क द्वारा जनम्नजलजखत तरीके से प्राप्त करने से पूवध, र्मड़ा जनयाधत परर्द ्द्वारा सत्याजपत स्ट्व-घो्णा प्रस्ट्तुत करनी होगी: (i). आयातक की यह स्ट् व-घो्णा दक आयाजतत फुटजवयर सोल का इस्ट् तेमाल केवल जनयाधत के जलए फुटजवयर के उत् पादन अथवा असेम् बल करन े में दकया िाएगा तथा भारत के घरेल ू बािार में बेर्न े के जलए नहीं दकया िाएगा। (ii). स्ट् व-घो्णा, आयातक के पत्रिी्ध (लेटर हडे ) पर दी िाएगी जिसमें इनवॉइस नंबर और आयात खेप के अन् य संगत ब् यौरे जवजधवत रूप से उजल्लजखत होंगे तथा यह उल्ल ेख होगा दक आयाजतत मद जनयाधत के प्रयोिन के जलए फुटजवयर के जवजनमाधण के अलावा घरेल ू बािार में दकसी अन् य कायध के जलए अथवा बेर्ने के जलए इस्ट्त ेमाल नहीं की िाएगी तथा कंपनी संबंजधत प्राजधकरणों द्वारा प्रमाणन अथवा भजवष्य में लेखा परीिा के जलए अपने आंतररक ररकॉड ध का रखरखाव करेगी। (iii). र्मड़ा जनयाधत परर्द ्का सत् यापन दक आयातक परर्द ्में पंिीक त एक जवजनमाधता जनयाधतक ह जिसम:ें (क) वतधमान में व ध पंिीकरण-सह-सदस्ट् यता प्रमाणपत्र सं्‍ या और िारी करने की तारीख; (ख) उद्यम पंिीकरण प्रमाण पत्र स्‍ं या और तारीख अथवा औद्योजगक उद्यजमता ञापापन सं्‍ या और तारीख; (ग) होम कंज़म् पिन नंबर के जलए प्रवेि का जबल और तारीख जिसे आयात मंिूरी हते ु भारतीय सीमा िल्ु क इले‍र ॉजनक डाटा इंटरर्ेंि में दायर दकया गया ह, का उल्ल ेख हो; Short title and commencement.(1) This Order may be called the Footwear made from All Rubber and all Polymeric Material and its Components (Quality Control) Order, 2024. (2) It shall come into force with effect from the 1st day of August, 2024. 2. Compulsory use of Standard Mark. Goods or articles specified in the column (2) of the Table shall conform to the corresponding Indian Standard specified in the column (3) of the said Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-I of Schedule-II of Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that nothing in this Order shall apply to goods or articles meant for export: Provided further that nothing in this Order shall apply to micro and small manufacturing units as defined in section 7 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) as amended from time to time: Provided also that nothing in this Order shall apply to import of goods or articles specified in the Table below used in manufacturing of footwear in India for export only, namely: Sl. PU Outsoles IS 13893:1994 Polyurethane Unit Outsoles — Specification[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 Provided also that the importer shall furnish a self-declaration certified by the Council for Leather Exports before the import of such footwear soles are allowed by the customs in the following manner, namely:- (i) self-declaration by the importer that the footwear soles imported are meant for production or assembly of footwear for exports and not for sale in the domestic market of India; (ii) the self-declaration shall be in the Letter Head of the importer duly mentioning the Invoice Number and other relevant details of the import consignment and mentioning that the imported items shall not be put to any other use or sold in the domestic market except in the manufacture of footwear for the purpose of exports and the company will maintain its internal records for any future verification or audit by concerned authorities; (iii) certification by the Council for Leather Exports that the importer is a manufacturer exporter registered with the Council by quoting (a) Currently valid Registration-cum-Membership Certificate number and date of issue; (b) Udyam Registration Certificate Number and date; (c) Bill of Entry for home consumption number and date which is filed in the Indian Customs Electronic Data Interchange system for import clearance; and (iv) the importers must upload the above documents along with other relevant documents in the Indian Customs Electronic Data Interchange portal, for smooth customs clearance of the footwear soles: Provided also that if any manufacturer certified by the Bureau or any manufacturer who has applied for certification to the Bureau, declares prior to the Commencement of this Order, under sub-section (4) of section 18 of the Bureau of Indian Standards, Act 2016 (11 of 2016) its old stock of footwear products without Bureau of Indian Standards Mark manufactured or imported prior to such commencement, such manufacturer shall be permitted to sell or display or offer to sell such declared stock upto the 30th June, 2025. 3. Certification and enforcement authority. The Bureau of Indian Standards shall be the certifying and enforcing authority for the goods or articles specified in the column (2) of the Table.
