## Policy Analysis Report: National Highways Act Amendment (June 13, 2025)
**1. Executive Summary:**
This report analyzes a notification (S.O. 2589E) issued by the Ministry of Road Transport and Highways, Government of India, published on June 13, 2025. Based on the provided text, the notification concerns land acquisition and infrastructure development along a specific stretch of National Highway NH44 (Old NH26) in Uttar Pradesh and Madhya Pradesh. The core purpose appears to be authorizing specific officers to act as competent authorities under the National Highways Act, 1956, in relation to these projects. The report details the key provisions, affected stakeholders, and likely implementation aspects discernible from the text. The notification can be regarded as an amendment to the existing policy/framework under the National Highway Act of 1956.
**2. Introduction:**
The purpose of this report is to provide an informative analysis of the notification S.O. 2589E, issued by the Ministry of Road Transport and Highways on June 13, 2025. This analysis is based solely on the content of the provided text.
**3. Policy Overview:**
* **Reference to Original Policy:** This notification is issued in exercise of powers conferred by clause (a) of section 3 of the National Highways Act, 1956 (48 of 1956), implying it's an amendment or implementation measure under the existing Act.
* **Core Objective(s) (Inferred):** The core objective, as inferred from the text, is to facilitate land acquisition and infrastructure development (design, construction, demolition, reconstruction and installation) along a specific stretch of NH44 (Old NH26) by designating competent authorities under the National Highways Act.
**4. Background and Rationale:**
* **Rationale for Amendment:** The notification suggests an ongoing need to improve and maintain the National Highway infrastructure. The specific mention of "Design and construction of 26 Nos. Vehicular Underpasses and 04 Nos. Service Road, Installation of Metal Beam Crash Barrier for the package C3, C4, C5, C6, C7 C8, and C9 Demolition and Reconstruction of Distressed Bridge" indicates that this particular amendment is likely driven by the need to address safety concerns, improve traffic flow, and repair existing infrastructure along the specified stretch of NH44. The distressed bridge is a major impetus for this action.
**5. Key Provisions / Changes:**
This notification details specific changes concerning land acquisition and project oversight on NH44:
* **Specific part of the original policy being changed:** The notification directly refers to clause (a) of section 3 of the National Highways Act, 1956, which likely pertains to the authorization of officers as competent authorities. Therefore, the amendment concerns this specific aspect of the act.
* **New Rule/Provision:** The central government authorizes specific officers mentioned in column 2 of the attached Schedule to act as "competent authorities" under the National Highways Act, 1956. The schedule links these officers to specific geographical areas of activity on NH44.
* **Difference/Effect of the Change:** This change essentially empowers designated officers to perform functions related to land acquisition and project oversight along the NH44 stretch, streamlining the processes required for the planned infrastructure development. By authorizing them under the National Highways Act, they likely gain specific powers and responsibilities related to these projects that they may not have had previously, or which needed formal re-authorization. The authorization is effective from the date of publication of the notification.
**6. Target Audience and Stakeholders:**
Based on the text, the primary target audience and stakeholders include:
* **Landowners:** Those owning land along the specified stretch of NH44 (Km. 219.25 to Km. 220.40) in Sagar District (Madhya Pradesh), and from Km 99.005 to Km 415.089 Section of NH44 Old NH26 in the State of Uttar Pradesh and Madhya Pradesh, as their land may be subject to acquisition for the project.
* **Construction Companies/Contractors:** Those involved in the design, construction, demolition, and reconstruction of infrastructure along NH44, specifically those involved in the specified projects (Vehicular Underpasses, Service Roads, Crash Barrier Installation, and Bridge Reconstruction).
* **National Highways Authority of India (NHAI):** Mentioned in the F. No. NHAI35010202526LA3aNotifPIUSagar, they appear to be overseeing the projects.
* **The designated "competent authorities"** empowered to carry out functions under the act.
* **Commuters/Road Users:** Who will ultimately benefit from improved infrastructure and safety on NH44.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is the issuing authority. The National Highways Authority of India (NHAI) is likely involved in overseeing and managing the projects. The designated "competent authorities" are responsible for implementing the land acquisition and other related provisions.
* **Timelines/Procedures:** The notification is effective from the date of publication (June 13, 2025). The process for land acquisition and infrastructure development will likely follow the procedures outlined in the National Highways Act, 1956. Further specifics about procedures aren't discernable.
* **Implementation Aspects specific to the changes:** The change in authorizations for 'competent authorities' is effective from the date of publication itself. This is to ensure seamless transfer of responsibilities, and quicker and more effective implementation of the intended action.
**8. Expected Outcomes / Impact of Changes:**
* **Likely Intended Outcomes (of these specific changes):**
* Streamlined land acquisition process for the projects outlined in the notification.
* Accelerated construction and improvement of infrastructure along the specified stretch of NH44 (Vehicular Underpasses, Service Roads, Crash Barrier Installation, and Bridge Reconstruction).
* Improved safety and traffic flow on NH44.
* Efficient execution of project work in the specified area under the nominated competent authorities.
**9. Conclusion:**
The notification S.O. 2589E represents an amendment, in the form of specific project implementation, under the National Highways Act, 1956. Its significance lies in designating competent authorities to facilitate land acquisition and infrastructure development along a critical stretch of NH44 (Old NH26) in Uttar Pradesh and Madhya Pradesh. This is likely intended to expedite project implementation, improve road safety, and enhance overall infrastructure along the highway. The effective implementation of this notification is crucial for realizing the intended benefits for commuters, landowners, and the transportation network.
