## Policy Analysis Report: Acquisition of Land for National Highway No. 219 (Bihar Border to Chandauli Road) **1. Executive Summary:** This report analyzes a notification from the Ministry of Road Transport and Highways regarding the acquisition of land for the building, widening (two-lane with paved shoulder, four-laning etc.), maintenance, management, and operation of National Highway No. 219, specifically the stretch from Km. 44470 to 55073 km, with design changes from Km 0000 to 10.603, in Uttar Pradesh. The notification declares the government's intention to acquire land for this purpose and outlines the process for affected individuals to raise objections. The report highlights key provisions, identifies affected stakeholders, and infers implementation aspects and expected outcomes based solely on the provided text. This is likely a new policy action related to land acquisition for infrastructure development, rather than an amendment. **2. Introduction:** This report provides an informative analysis of a government notification (S.O. 2657E) concerning land acquisition for National Highway No. 219. The analysis is based solely on the text of the provided notification and aims to inform affected stakeholders of the policy's key aspects. **3. Policy Overview:** * **Core Objective(s):** The core objective, as inferred from the text, is to acquire land for the building, widening (two-lane with paved shoulder, four-laning etc.), maintenance, management, and operation of National Highway No. 219, specifically the stretch from Km. 44470 to 55073 km, with design changes from Km 0000 to 10.603. This encompasses improving and maintaining the highway infrastructure. **4. Background and Rationale:** * **Likely Problem/Issue Addressed:** Based on the text, the policy addresses the need for infrastructure development and improvement of National Highway No. 219. This suggests existing inadequacies in the highway, such as insufficient capacity, poor road conditions, or the absence of essential features like paved shoulders or multiple lanes. The text's reference to "building, widening...maintenance, management and operation" clearly indicates a comprehensive plan to enhance the highway. **5. Key Provisions / Changes:** * **Main Components, Rules, and Actions:** * **Declaration of Intention to Acquire Land:** The Central Government declares its intention to acquire land for the highway project. * **Objection Process:** Individuals interested in the said land have 21 days from the date of publication of the notification (June 13, 2025) to object to the land acquisition. * **Competent Authority:** Objections must be submitted in writing to the Addtional District Magistrate, Chandauli. * **Hearing of Objections:** The Competent Authority must provide objectors an opportunity to be heard, either in person or through a legal practitioner. * **Authority Decision:** The Competent Authority has the power to either allow or disallow objections after due enquiry. * **Final Order:** The order made by the Competent Authority under subsection 2 of section 3C of the said Act shall be final. * **Land Plan Availability:** Land plans and other details regarding the acquisition are available for inspection at the office of the Competent Authority. * **Land Description:** A brief description of the land to be acquired is provided in the schedule, including survey/plot numbers, land type, land nature, and area in hectares. * **Legal basis:** The notification is issued under the authority of subsection 1 of section 3A of the National Highways Act, 1956. **6. Target Audience and Stakeholders:** Based on the text, the primary target audience and stakeholders are: * Landowners whose property falls within the identified stretch of National Highway No. 219 (Km. 44470 to 55073 km, with design changes from Km 0000 to 10.603) in the Chandauli district of Uttar Pradesh, particularly in Matakkipur village. * Residents of Chandauli district, Uttar Pradesh, who may be affected by the highway construction and improvements. * The Addtional District Magistrate, Chandauli, who serves as the Competent Authority. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** * Ministry of Road Transport and Highways (issuing the notification). * Addtional District Magistrate, Chandauli (Competent Authority for handling objections). * Central Government (responsible for land acquisition under the National Highways Act, 1956). * **Timelines/Procedures:** * 21-day period for affected individuals to submit objections following the notification's publication (June 13, 2025). * The Competent Authority must provide a hearing to objectors. * The Competent Authority will make a final order after enquiry. * Land plans are available for inspection at the Competent Authority's office. **8. Expected Outcomes / Impact of Changes:** * **Likely Intended Outcomes:** * Acquisition of land necessary for the building, widening, maintenance, management and operation of National Highway No. 219. * Improved highway infrastructure, potentially leading to increased traffic flow, reduced travel times, and enhanced road safety. * Stimulation of economic activity in the region due to improved transportation infrastructure. **9. Conclusion:** The notification outlines the government's intention to acquire land for improving National Highway No. 219. Key aspects include the declaration of intent, the provision for affected individuals to raise objections, and the role of the Competent Authority in the process. The policy is significant as it aims to facilitate infrastructure development, which can have positive economic and social impacts. Stakeholders should be aware of the timelines and procedures for raising objections to protect their interests.
