**Report: Analysis of Notification Regarding Land Acquisition for NH28 Gorakhpur Bypass Project**
**1. Executive Summary:**
This report analyzes a notification (S.O. 3392(E)) issued by the Ministry of Road Transport and Highways, Government of India, dated August 18, 2021. The notification authorizes designated officers to act as competent authorities for land acquisition related to the building, widening, four-laning, maintenance, management, and operation of a section of National Highway 28 (NH28) in Uttar Pradesh. The key finding is the specification of the land stretch from Km. 253.55 to Km. 285.27 and the identification of affected villages within the Gorakhpur district for the Gorakhpur Bypass project. This report summarizes the notification's key provisions, identifies affected stakeholders, and infers likely implementation aspects and expected outcomes.
**2. Introduction:**
This report aims to provide an informative overview of the Ministry of Road Transport and Highways' notification S.O. 3392(E), dated August 18, 2021, concerning land acquisition for the NH28 Gorakhpur Bypass project in Uttar Pradesh. The analysis is based solely on the provided text.
**3. Policy Overview:**
* This appears to be a *new* policy or directive related to land acquisition for a specific infrastructure project rather than an amendment.
* **Core Objective:** To authorize specific officers as competent authorities for land acquisition, building, widening, four-laning, maintenance, management, and operation of a designated section of NH28 in Uttar Pradesh.
**4. Background and Rationale:**
* **Likely Problem/Issue Addressed:** The notification likely addresses the need to expedite land acquisition for the NH28 Gorakhpur Bypass project. Without designated competent authorities, the project's progress would be hampered by bureaucratic delays. Efficient land acquisition is crucial for infrastructure development, reducing transportation costs, and improving connectivity.
**5. Key Provisions / Changes:**
* **New Policy:**
* Authorizes officers, as listed in the schedule, to perform the functions of competent authorities under the National Highways Act, 1956, concerning land acquisition.
* Defines the specific stretch of land affected: Km. 253.55 to Km. 285.27 of NH28 in Uttar Pradesh.
* Specifies that the authorization is for building, widening, four-laning, maintenance, management, and operation activities.
* Identifies the affected state as Uttar Pradesh and the specific district as Gorakhpur.
* Lists specific villages (Mahi, Tenua, Khanipur, Mujaila, Nagwa, Kakna, Kaleser Mu, Kurmaul, Baghagara, Siktaur, Koni, Ekla Ahirauli, Patakhauli, Chhapiya Betua Urf, Chanau, Jharwa, Khirwaniya, Ajawaniya Manjhariya, Bistaul Gaighat, Bujurg Khorabar, Urf Subabazar Jan. Ramgar, Urf Chavree, Talkandala Pipari, Mustakil, Badgo, Domandad Lahsadi, Mustakil Taal, Ramgarh, Malmaliya Ramnagar, Kadjahn, Marapar Muthiya Chauri, Buzurg Chaura, Jagdishpur, Bahrampur, Bhainsha Arazi, Vasdila) within the Gorakhpur district which fall under Sahjanwa, Sadar, Ramnagar and Khorabar Taluks/Mandals.
**6. Target Audience and Stakeholders:**
* Landowners and residents along the designated stretch of NH28 in the Gorakhpur district of Uttar Pradesh.
* Businesses and industries that rely on transportation along NH28.
* The National Highways Authority of India (NHAI) or the implementing agency responsible for the NH28 project.
* Local government officials in the Gorakhpur district.
* Construction companies and contractors involved in the road project.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways (issuing authority), the designated "competent authorities" (specified officers to be appointed by state). Special Land Acquisition Officer (S.S., Gorakhpur, U.P.).
* **Timelines/Procedures:** The notification is effective from the date of its publication in the Official Gazette (August 18, 2021). The specific procedures for land acquisition would be governed by the National Highways Act, 1956, and relevant state laws.
* The implementation would involve surveying the land, determining fair compensation for landowners, and potentially resettling displaced populations.
**8. Expected Outcomes / Impact of Changes:**
* Efficient and timely land acquisition for the NH28 Gorakhpur Bypass project.
* Expedited construction and improvement of the highway, leading to better connectivity and reduced travel times.
* Potential for economic growth in the region due to improved transportation infrastructure.
* Potential displacement of landowners and residents, requiring fair compensation and resettlement.
* Reduced congestion along the existing NH28 route through Gorakhpur city.
**9. Conclusion:**
The notification S.O. 3392(E) is a crucial step in facilitating the NH28 Gorakhpur Bypass project. By authorizing competent authorities for land acquisition, the government aims to streamline the process and ensure the timely completion of this important infrastructure project. Affected landowners and businesses should familiarize themselves with the provisions of the National Highways Act, 1956, and engage with the designated authorities to ensure a fair and transparent land acquisition process. The successful implementation of this notification will have significant implications for transportation, economic development, and the lives of people in the Gorakhpur region.
