## Policy Analysis Report: Land Acquisition for NH135A Upgradation in Uttar Pradesh
**1. Executive Summary:**
This report analyzes a notification from the Ministry of Road Transport and Highways, Government of India, regarding land acquisition for the upgradation of National Highway NH135A in Uttar Pradesh. The core purpose of the notification is to authorize specific officers to act as competent authorities for land acquisition related to the highway's two-laning with paved shoulders. The key finding is that this notification facilitates the execution of a specific infrastructure project by designating individuals responsible for acquiring the necessary land. This will primarily affect landowners and residents along the specified stretch of NH135A in the Jaunpur district.
**2. Introduction:**
This report provides an informative analysis of a government notification pertaining to land acquisition for the upgradation of National Highway NH135A in the State of Uttar Pradesh. The analysis is based solely on the content of the provided policy text.
**3. Policy Overview:**
This is a new policy regarding the *implementation* of the National Highways Act, 1956, specifically related to the acquisition of land for a defined infrastructure project.
* **Core Objective(s):** Based on the text, the core objective is to facilitate the acquisition of land necessary for the "upgradation to 2 laning with paved shoulders of Mariahu Bypass From km. 53.55 to km 59.2 in tehsil Mariahu District of Jaunpur NH135A in the State of UTTAR PRADESH." This implies an overall objective of improving transportation infrastructure in the specified region.
**4. Background and Rationale:**
* **New Policy Rationale:** The policy addresses the need for land acquisition to improve highway infrastructure. It can be inferred that the current state of the highway (NH135A) is insufficient to meet existing or projected transportation demands, necessitating the upgradation to a two-lane highway with paved shoulders. This will likely lead to improved traffic flow, road safety, and regional connectivity.
**5. Key Provisions / Changes:**
* **New Policy Details:** The notification authorizes officers (mentioned in column 2 of the Schedule) to act as "competent authorities" under the National Highways Act, 1956. This authority is specifically granted with effect from the date of publication of the notification in the Official Gazette. The scope of their authority is limited to the stretch of land specified in column 3 of the schedule, relating to state, districts, taluk and villages mentioned in column 4, 5, 6 and 7. This stretch is defined as km 53.55 to km 59.2 of Mariahu Bypass on NH135A in the Jaunpur district of Uttar Pradesh. The schedule also lists the specific villages impacted. This delegation of authority enables the Central Government to acquire land through its representatives, as per the provision of the National Highways Act.
**6. Target Audience and Stakeholders:**
Based on the text, the following are directly affected:
* **Landowners and residents of the villages listed in the Schedule (Maidieh, Sarai Kalidas, Khizirpur, etc.):** Their land is subject to acquisition.
* **The designated officers:** They are assigned the responsibility of land acquisition.
* **The Mariahu tehsil and Jaunpur district administration:** The upgrade project falls within their jurisdiction.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is the issuing authority. The officers listed in the schedule are the designated "competent authorities" responsible for land acquisition. The Additional District Magistrate is mentioned as an officer.
* **Timelines/Procedures:** The notification takes effect upon publication in the Official Gazette (November 23, 2021 based on the document). The procedures for land acquisition would be governed by the National Highways Act, 1956. No specific deadlines are mentioned *in the provided text*.
**8. Expected Outcomes / Impact of Changes:**
* **New Policy Outcomes:** The intended outcome is the successful acquisition of land required for the NH135A upgradation project. This, in turn, should facilitate the improvement of the highway to two lanes with paved shoulders, leading to:
* Improved traffic flow and reduced congestion.
* Enhanced road safety for vehicles and pedestrians.
* Better connectivity and accessibility for the region.
* Potential economic benefits from improved transportation infrastructure.
**9. Conclusion:**
This notification represents a crucial step in the process of upgrading National Highway NH135A in Uttar Pradesh. It delegates the necessary authority for land acquisition, paving the way for the execution of the infrastructure project. The policy will have a direct impact on landowners and residents in the specified area and will contribute to improved transportation infrastructure in the region. The effective and timely implementation of this notification is essential for realizing the intended benefits of the highway upgrade.
