## Policy Analysis Report: Land Acquisition for National Highway 75 (Section 3A Notification)
**1. Executive Summary:**
This report analyzes a notification issued by the Ministry of Road Transport and Highways, Government of India, regarding land acquisition for the building, widening, maintenance, management, and operation of National Highway 75 (NH-75) in the state of Madhya Pradesh. The core purpose of the notification is to declare the government's intention to acquire specific parcels of land within the SINGRAULI district for the aforementioned highway project. Key findings indicate that this notification triggers a process allowing landowners to object to the acquisition within a specified timeframe. The gazette also specifies the area being acquired through document numbers, location, and size.
**2. Introduction:**
The purpose of this report is to provide an informative analysis of a government notification pertaining to land acquisition for the National Highway 75 project, based solely on the provided text. This report aims to outline the policy's objective, affected parties, and potential implications.
**3. Policy Overview:**
This is a *new* policy action.
* **Core Objective(s):** The core objective, as inferred from the text, is to facilitate the building, widening, maintenance, management, and operation of NH-75. This necessitates the acquisition of land within the district of SINGRAULI in the state of MADHYA PRADESH from Km. 127700 to Km. 165000 for the purpose of infrastructure development related to the highway.
**4. Background and Rationale:**
This is a *new* policy action.
* **Likely Problem/Issue:** The policy likely addresses the need for improved infrastructure along the NH-75 corridor. This includes widening the road (two-lane with paved shoulder to four-laning), maintaining its existing condition, and efficiently managing its operation. The underlying issue is likely insufficient land availability to achieve these infrastructure goals, necessitating land acquisition. The text explicitly mentions the need to acquire land for "building, widening... maintenance, management and operation" of the highway.
**5. Key Provisions / Changes:**
This is a *new* policy action.
* **Main Components, Rules, and Actions:**
* **Declaration of Intent:** The notification declares the Central Government's intention to acquire specific land parcels for the NH-75 project.
* **Land Description:** The schedule provides a brief description of the land to be acquired, including survey plot numbers, type and nature of land (irrigated/unirrigated), and area in hectares.
* **Objection Mechanism:** It establishes a 21-day period from the publication date (September 2, 2021) during which interested parties can object to the land acquisition.
* **Objection Procedure:** Objections must be submitted in writing to the Competent Authority (Sub Divisional Land Acquisition Officer, Deosar), stating the grounds for the objection.
* **Hearing and Enquiry:** The Competent Authority is required to provide objectors an opportunity to be heard, either in person or through a legal representative. They may conduct further enquiry as deemed necessary.
* **Authority Decision:** The Competent Authority will then either allow or disallow the objections through a final and binding order.
* **Land Plan Access:** The land plans and other relevant details are available for inspection at the office of the Competent Authority.
* The area is specified through document numbers, location, and size.
**6. Target Audience and Stakeholders:**
Based on the provided text, the primary target audience and stakeholders are:
* **Landowners:** Individuals or entities owning land within the specified stretch of NH-75 in the SINGRAULI district of Madhya Pradesh, particularly those whose land is listed in the schedule.
* **Residents of Affected Villages:** Residents of villages like Barainiya, Dagaa, Gondwali, Jiyawan, Khobha, Kohrakhoh and Sajhar.
* **Sub Divisional Land Acquisition Officer, Deosar:** Named as the 'Competent Authority' for the purpose of objections.
* **Ministry of Road Transport and Highways** The agency ultimately in charge of the project.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is the primary responsible agency. The Sub Divisional Land Acquisition Officer, Deosar, acts as the Competent Authority for handling objections.
* **Timelines and Procedures:** A 21-day objection period is specified. The Competent Authority is responsible for hearing objections and making a final order. Further timelines for land acquisition and project implementation are not specified in the provided text. The process is governed by the National Highways Act, 1956.
**8. Expected Outcomes / Impact of Changes:**
This is a *new* policy action.
* **Likely Intended Outcomes:** The likely intended outcomes are:
* Acquisition of necessary land for the NH-75 project.
* Improved infrastructure along the NH-75 corridor, including widening, maintenance, and efficient management.
* Enhanced connectivity and transportation efficiency in the region.
* Economic development stimulated by improved transportation infrastructure.
* Fair opportunity for affected landowners to voice concerns and objections.
**9. Conclusion:**
The notification represents a key step in facilitating the infrastructure development of National Highway 75. It initiates the process of land acquisition, establishes a framework for addressing landowner objections, and underscores the government's commitment to improving transportation infrastructure in the region. The significance of this notification lies in its potential to unlock economic benefits, improve connectivity, and enhance the overall quality of life for residents along the NH-75 corridor. The policy will directly affect landowners as the state uses eminent domain for the purpose of infrastucture improvement and safety.
