**Report on Amendment to National Highways Act, 1956 Regarding Land Acquisition for National Highway No. 214 / New NH 216 in Andhra Pradesh**
**1. Executive Summary:**
This report analyzes an amendment to a notification under the National Highways Act, 1956, specifically concerning land acquisition for National Highway No. 214, now designated as New NH 216, in the state of Andhra Pradesh. The amendment, published on June 3, 2022, revises the schedule related to land acquisition from km 27.500 to km 69.500 within the Timmapuram-Gurjanapalli section. The key change involves replacing the original land acquisition schedule with a new schedule detailing specific villages, districts, and mandals affected by the highway construction. This amendment likely aims to clarify and update the land acquisition details, which is crucial for the efficient implementation of the highway project.
**2. Introduction:**
The purpose of this report is to provide an informative analysis of the amendment to the Government of India's notification regarding land acquisition for National Highway No. 214/New NH 216 in Andhra Pradesh. The analysis is based solely on the provided text of the notification published on June 3, 2022.
**3. Policy Overview:**
* **Amendment To:** Notification S.O. 35E, dated January 7, 2014, published in the Gazette of India, Extraordinary, Part II, Section 3, Subsection ii.
* **Core Objective(s):** Based on the text, the core objective is to amend the schedule related to land acquisition for the construction or improvement of National Highway No. 214/New NH 216, specifically focusing on the stretch between km 27.500 and km 69.500 in Andhra Pradesh. The overarching implied objective is the efficient and lawful acquisition of land necessary for the highway project.
**4. Background and Rationale:**
The notification from 2014 is being amended to likely address inaccuracies, omissions, or changes in the original land acquisition plan. The *provided text* indicates a need to update the schedule specifying affected land parcels by replacing it entirely, suggesting possibly changes in the scope or alignment of the highway project within the specified section, requiring revised details of affected villages and administrative boundaries.
**5. Key Provisions / Changes:**
This is an amendment, so we focus on the *changes*:
* **Specific Part Changed:** The "schedule" in the original notification (S.O. 35E, dated January 7, 2014) is being entirely *replaced*.
* **New Rule/Provision:** The amendment introduces a completely new schedule detailing the specific land parcels to be acquired, listing them by:
* Sl. No.
* CALA (Competent Authority for Land Acquisition - implied)
* Stretch (km 27.5KM to km 69.5KM)
* State (ANDHRA PRADESH)
* District (Kakinada)
* Taluk/Mandal (various)
* Name of the Village (numerous villages are listed)
* **Difference/Effect of the Change:** The original schedule is no longer valid. The *new* schedule now dictates precisely which land in which villages, mandals, and districts is subject to acquisition for the highway project. This increases the precision of land acquisition notifications.
**6. Target Audience and Stakeholders:**
Based on the *provided text*, the primary target audience and stakeholders directly affected by this amendment include:
* **Landowners:** Individuals and entities owning land within the specified villages (Kathipudi, Pavara, Pandrawada, Pandhuru, Pansapadu, Koppavaram, Mamilladoddi, Madhavapatnam, Bhogapuram, Illindrada, Pithapuram, Agraharam, Chithrada, Chendurthi, Chebrolu, Gollaprolu, Nadakuduru, Gurajanapalli, Thimmapuram, Sarpavaram, Ganganapalli, Cheediga, Turangi, Kakinada, Medaline, A.P.Trayam, Chollangi, Coringa, P.mallavaram, Latchipalem, Sunkarapalem, Chollangipeta, G.Vemavaram, Patavala, Polekurru) along the NH-216 corridor between km 27.500 and km 69.500.
* **Residents:** Individuals residing in the affected villages.
* **Local Authorities:** Officials in the Kakinada District, and the listed Taluks/Mandals, who are involved in the land acquisition process.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:**
* Ministry of Road Transport and Highways (issuing authority).
* Central Government (exercising powers under the National Highways Act, 1956).
* Joint Collector, Kakinada District, serving as the CALA (Competent Authority for Land Acquisition).
* **Timelines/Procedures:** The text does not specify timelines, but it establishes the legal basis for land acquisition to proceed according to the National Highways Act, 1956. It is inferred that the CALA will follow due process as outlined in the Act for acquiring the land detailed in the new schedule.
* **Implementation Aspects Specific to the Changes:** The immediate implementation step is to ensure that all land acquisition activities are based on the *newly* defined schedule. The CALA needs to be aware of the revised list of villages and administrative areas.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome *of this amendment* is to:
* **Facilitate Land Acquisition:** By providing a revised and detailed schedule, the amendment aims to streamline the land acquisition process, ensuring that the correct land parcels are identified and acquired.
* **Reduce Disputes:** Accurate identification of affected land may minimize potential disputes with landowners.
* **Accelerate Project Implementation:** By clarifying the land acquisition requirements, the amendment is expected to contribute to the timely completion of the National Highway project.
**9. Conclusion:**
The amendment to the notification concerning land acquisition for National Highway No. 214/New NH 216 in Andhra Pradesh is a significant update. This amendment ensures accuracy in the land acquisition process, facilitating the efficient construction of the highway. Landowners and other stakeholders should take note of these changes.
