## Policy Analysis Report: Amendment to National Highways Act, 1956 Notifications **1. Executive Summary:** This report analyzes an amendment to existing notifications under the National Highways Act, 1956, as published in the Gazette of India on June 13, 2022. The amendment addresses the acquisition of land for National Highway No. 71 in Andhra Pradesh. Specifically, it updates references to district names (Chittoor to Tirupati) and corresponding administrative divisions (Taluks/Mandals/Villages) due to the restructuring of districts within Andhra Pradesh. The key finding is that the amendment ensures the correct administrative divisions are referenced for land acquisition related to the specified highway stretch. **2. Introduction:** This report aims to provide an informative overview of the amendment to notifications concerning the National Highways Act, 1956, specifically regarding land acquisition for National Highway No. 71 in Andhra Pradesh. The analysis is based solely on the provided policy text published in the Gazette of India on June 13, 2022. **3. Policy Overview:** * **Amendment to:** This document amends previously issued notifications of the Government of India in the Ministry of Road Transport and Highways, specifically: * S.O. 2520(E), dated the 8th August 2017 * S.O. 1702(E), dated the 17th April 2018 * S.O. 1786(E), dated the 12th April 2022 * **Core Objective(s):** The core objective, as inferred from the text, is to update administrative references within existing notifications related to land acquisition for National Highway No. 71, reflecting changes in district boundaries and administrative divisions in Andhra Pradesh. This ensures accurate application of the National Highways Act for the highway's development. **4. Background and Rationale:** The amendment is necessitated by the restructuring of districts in Andhra Pradesh. The text explicitly states that the Taluks/Mandals Chinna Gotti Gallu, Chandragiri Tirupati Rural, previously in Chittoor District, now fall under the jurisdiction of the newly formed Tirupati District. This change necessitates updating existing notifications to reflect the current administrative boundaries to ensure proper land acquisition processes and avoid legal challenges due to outdated references. **5. Key Provisions / Changes:** This document focuses specifically on the changes introduced by the amendment. * **Specific Part of Original Policy Changed:** The amendment alters the Schedules within the referenced notifications (S.O. 2520(E), S.O. 1702(E), S.O. 1786(E)) that detail the villages falling under each administrative unit (Taluk/Mandal) for land acquisition purposes. The text refers to previously published amendment to the notification of the Government of India in the Ministry of Road Transport and Highways, number S.O. 2216 E, dated the 13th May 2022 published in the Gazette of India, Extraordinary, Part II, Section3, Subsection ii, dated the 13th May 2022 * **New Rule/Provision:** The new provision involves substituting the Schedules for the remaining Taluks/Mandals/Villages within the specified notifications. The provided text includes an updated schedule for "Acquisition of land in respect of National Highway No. 71 in the stretch from Km.55900 to Km.95717 in the State of Andhra Pradesh," specifically naming the Villages and District. * **Difference/Effect of Change:** The effect of this change is to align the official notifications with the current administrative map of Andhra Pradesh. Previously, land acquisition efforts referencing the old district boundaries might have faced legal or administrative hurdles. This amendment ensures that current district names and administrative divisions are used, streamlining the land acquisition process and reducing potential disputes or delays. The name of District 'Chittoor' is being updated to reflect current divisions of the state. **6. Target Audience and Stakeholders:** Based on the text, the directly affected stakeholders include: * Landowners within the stretch of National Highway No. 71 from Km.55.900 to Km.95.717 in Andhra Pradesh. * Government agencies involved in land acquisition, particularly those responsible for highway development and administration in Andhra Pradesh (e.g., the Collector of Chittoor as indicated in the provided schedule). * Contractors and other parties involved in the construction and maintenance of National Highway No. 71. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is the responsible agency. The Collector of Chittoor (Joint Collector) is also directly involved in the land acquisition process, as indicated in the Schedule. * **Timelines/Procedures:** The notification is effective from the date of publication (June 13, 2022). Specific timelines or procedures for the land acquisition process are not detailed in the provided text but would likely be governed by the National Highways Act, 1956, and related regulations. * **(Amendment Specific):** The amendment's implementation requires updating the records and references used by the responsible agencies involved in land acquisition. This includes updating databases, maps, and any other relevant documentation to reflect the change in district boundaries. **8. Expected Outcomes / Impact of Changes:** The intended outcome of this amendment is to facilitate smoother and more efficient land acquisition for National Highway No. 71 in Andhra Pradesh. By aligning the official notifications with the current administrative boundaries, the amendment aims to: * Reduce potential legal challenges or disputes related to land ownership or administrative jurisdiction. * Streamline the land acquisition process, potentially accelerating the development and maintenance of the highway. * Ensure accurate record-keeping and administrative oversight of the land acquisition process. **9. Conclusion:** The amendment to the National Highways Act, 1956, notifications concerning land acquisition for National Highway No. 71 in Andhra Pradesh is a necessary update to reflect the restructured district boundaries within the state. By updating administrative references, the amendment aims to streamline the land acquisition process, minimize potential legal issues, and ultimately facilitate the development and maintenance of this critical transportation infrastructure. This change is significant for the affected industries as it will expedite the NH71 project.
