## Policy Analysis Report: Land Acquisition for National Highway Expansion in Rajasthan **1. Executive Summary:** This report analyzes a notification (S.O. 722(E)) issued by the Ministry of Road Transport and Highways, Government of India, regarding the intention to acquire land for building, widening (two lane with paved shoulder/four laning etc.) of the Manoharpur Dausa Section of National Highway No. 11A in Rajasthan. The notification declares the government's intention to acquire specific land parcels in the Jaipur district and outlines procedures for affected individuals to raise objections. This appears to be a new policy specific to this land acquisition project and not an amendment to an existing policy. The key finding is the government's intent to proceed with land acquisition for highway expansion and the process by which affected landowners can contest this. **2. Introduction:** This report provides an analysis of Notification S.O. 722(E) published in the Gazette of India on February 16, 2022, pertaining to land acquisition for the Manoharpur Dausa Section of National Highway No. 11A in Rajasthan. The purpose is to inform stakeholders, specifically landowners and related industries, about the policy's key provisions, procedures, and potential impact based solely on the information contained within the provided text. **3. Policy Overview:** * This appears to be a **new policy specific to the land acquisition** described in the document, not an amendment. * **Core Objective(s):** The core objective, as stated in the text, is to acquire land for "building wideningtwo lane with paved shoulderfour laning etc., in the stretch of land of from Km 58.320 to Km 62.500" of the specified highway section, deemed necessary for a "public purpose." **4. Background and Rationale:** Since this appears to be a new policy, the background and rationale can be inferred from the text. The policy addresses the need for expanding and improving the National Highway No. 11A. The phrases "building wideningtwo lane with paved shoulderfour laning etc.," indicates that the existing infrastructure is either insufficient or requires upgrading, likely to improve traffic flow, reduce congestion, and enhance connectivity. The policy is deemed to serve a "public purpose," suggesting that the highway improvement is considered to be in the best interest of the community and the nation. **5. Key Provisions / Changes:** This is a new policy and its main components include the following: * **Declaration of Intent:** The Central Government declares its intention to acquire land for the specified highway project. * **Land Description:** A brief description of the land to be acquired, including survey numbers, type of land, nature of land, area in local units and hectares, is provided in the schedule. Specifically, the provided schedule identifies two land parcels in Shivpuri village, Shahpura Taluk, Jaipur district: * Survey No. 5459/6: 0.0078 hectares, private commercial land. * Survey No. 54594: 0.0042 hectares, private residential land. * **Objection Process:** Individuals interested in the land are granted 21 days from the date of publication to object to the land acquisition. * **Competent Authority:** Objections must be submitted in writing to the Sub Divisional Officer (Competent Authority). * **Hearing and Decision:** The Competent Authority is required to provide objectors with an opportunity to be heard (either in person or via a legal practitioner), conduct further inquiries if necessary, and then either allow or disallow the objections. * **Finality of Decision:** The decision made by the Competent Authority is deemed final. * **Access to Information:** Land plans and other details are available for inspection at the office of the Competent Authority. **6. Target Audience and Stakeholders:** Based on the provided text, the directly affected stakeholders are: * **Landowners:** Specifically, the owners of the land parcels identified in the schedule (Survey No. 5459/6 and 54594 in Shivpuri village). More generally, any person who owns land within the specified stretch of the highway project (Km 58.320 to Km 62.500). * **Residents and Businesses:** Residents and businesses operating on the land slated for acquisition. * **Legal Practitioners:** Legal professionals who may represent landowners in the objection process. * **Construction and Transportation Industries:** Companies involved in highway construction, material supply, and transportation, who may benefit from the project. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is the responsible central government body. The Sub Divisional Officer acts as the "Competent Authority" responsible for handling objections. * **Timelines:** A 21-day window is provided for landowners to file objections from the date of publication (February 16, 2022). Other timelines related to the inquiry and final decision by the Competent Authority are not specified in the provided text. * **Procedures:** The procedure for objecting is outlined: a written objection must be submitted to the Competent Authority, stating the grounds for the objection. The Competent Authority will then provide a hearing before making a decision. **8. Expected Outcomes / Impact of Changes:** Since this is a new policy and not an amendment, we focus on the potential impact of the policy itself. * **Highway Improvement:** The primary intended outcome is the improvement and expansion of the Manoharpur Dausa Section of National Highway No. 11A. * **Land Acquisition:** The acquisition of the specified land parcels is a necessary step towards achieving the highway improvement goal. * **Potential Displacement:** Landowners and residents may face displacement and require resettlement or compensation. * **Economic Impacts:** The improved highway could lead to increased economic activity in the region due to better connectivity and transportation infrastructure. **9. Conclusion:** Notification S.O. 722(E) signals the government's intention to proceed with land acquisition for the improvement and expansion of the Manoharpur Dausa Section of National Highway No. 11A. This policy will affect landowners within the specified area, granting them the right to object to the acquisition within a limited timeframe. This document is significant as it marks the beginning of a process that will ultimately lead to the physical transformation of this region, potentially impacting property owners, residents, and local businesses.
