## Policy Analysis Report: Land Acquisition for National Highway 19 (NH19) - Panagarh Palsit Section **1. Executive Summary:** This report analyzes a government notification regarding land acquisition for the building, widening (six-laning), maintenance, management, and operation of National Highway 19 (NH19) on the Panagarh Palsit Section, located in the district of PURBA BARDHAMAN in the state of WEST BENGAL. The notification, dated April 18, 2022, declares the Central Government's intent to acquire specified land parcels, overriding any prior objections and vesting the land absolutely in the Central Government. The report outlines the policy's objective, key provisions, affected stakeholders, and likely impacts based on the provided government notification text. **2. Introduction:** The purpose of this report is to provide an informative analysis of a notification issued by the Ministry of Road Transport and Highways, Government of India, pertaining to the acquisition of land for the NH19 Panagarh Palsit Section project. This analysis is solely based on the content of the provided notification text. **3. Policy Overview:** This is a *new* policy regarding specific land acquisition for a particular stretch of NH19. * **Core Objective(s):** The core objective of this policy, as stated within the text, is to acquire land for the purpose of "building, widening (six-laning), etc., maintenance, management and operation of NH19" on the specified stretch between Km. 521.251 and Km. 603.94. **4. Background and Rationale:** The policy addresses the need for land acquisition to facilitate infrastructure development along the NH19 corridor. The intention to widen the existing highway to six lanes suggests a requirement to increase capacity, improve traffic flow, and likely enhance connectivity and economic activity in the region. The policy serves to formally acquire the necessary land, overcoming legal hurdles and objections to ensure the project's timely execution. The initial notification S.O. 4811 E Dated 22nd November 2021 declared the government's intention to acquire the land; this current notification signifies the completion of the objection review process and the formal declaration of acquisition. **5. Key Provisions / Changes:** As this is a new policy (regarding specific land acquisition), the main provisions of the text are as follows: * **Declaration of Intent:** The notification declares the Central Government's intention to acquire the land specified in the schedule attached to the notification. * **Overruling of Objections:** The notification states that objections were received, considered, and disallowed by the competent authority, paving the way for the acquisition. * **Acquisition Declaration:** The Central Government declares that the land specified in the schedule "should be acquired for the aforesaid purpose". * **Vesting of Land:** Upon publication of the notification in the Official Gazette, the land specified in the schedule "shall vest absolutely in the Central Government, free from all encumbrances." * **Land Schedule:** The notification includes a schedule detailing the land to be acquired, specifying the state (WEST BENGAL), district (PURBA BARDHAMAN), affected village (Budbud), survey numbers, type and nature of land, area in hectares, and the names of the land owners/interested persons. The schedule includes 6 distinct land plots, with land usages including Sali (potentially agricultural land), Nadi (riverbank), and Bastu (homestead). **6. Target Audience and Stakeholders:** The primary target audience and stakeholders directly affected by this policy are: * **Landowners:** Individuals and entities owning land within the specified stretch of NH19 (Panagarh Palsit Section) in the PURBA BARDHAMAN district of WEST BENGAL, as listed in the schedule. These landowners will be subject to the land acquisition process. * **Interested Persons:** Other individuals or entities with a vested interest in the land being acquired, who may not be the direct landowners. * **Residents of Budbud Village:** The residents of Budbud may be indirectly affected. * **Construction Companies/Contractors:** Those involved in the road construction/widening project will be affected by the availability of land. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** * **Ministry of Road Transport and Highways:** The issuing authority of the notification. * **National Highway Authority of India (NHAI):** The document footer lists "NHAIPIUDURGAPURNH193a3D," indicating NHAI involvement, specifically a Project Implementation Unit (PIU) likely based in Durgapur. * **Competent Authority:** Responsible for considering and disallowing objections. * **Central Government:** Ultimately responsible for declaring the acquisition. * **Timelines/Procedures:** * The policy sets the date of publication in the Official Gazette as the trigger for the land to vest absolutely in the Central Government. * The policy references previous notification S.O. 4811 E Dated 22nd November 2021 and public announcements on 25th December 2021 in "The Times of India and Bartaman," indicating an existing legal procedure involving notification and objection periods. * Compensation and rehabilitation procedures are not specified within the text, but are likely dictated by the National Highway Act, 1956. **8. Expected Outcomes / Impact of Changes:** The intended outcome of this policy is to secure the land necessary for the NH19 Panagarh Palsit Section project. The likely impacts include: * **Facilitation of Infrastructure Development:** The acquisition will enable the widening and improvement of NH19, improving transportation infrastructure. * **Potential Displacement:** Landowners and residents may face displacement and require relocation assistance and/or compensation. * **Economic Development:** Improved transportation infrastructure can lead to increased economic activity in the region. **9. Conclusion:** The notification outlines the formal acquisition of land for the NH19 Panagarh Palsit Section project, signifying a crucial step towards improving connectivity and facilitating economic growth. The Central Government, through the Ministry of Road Transport and Highways, has initiated this process to widen and improve the highway, addressing the need for enhanced infrastructure. This policy is of significant importance to landowners, businesses, and residents in the affected region, and stakeholders involved in the NH19 development project. The timely and equitable implementation of this policy is crucial to minimize disruption and maximize the benefits of the infrastructure development.
