जारी की र्ई भारत सरकार के सड़क पररवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1724(अ) तारीख 16 अप्रलै , 2024 और का.आ. 2889(अ) तारीख 22 जलु ाई, 2024 जो भारत के राजपत्र, असािारण, भार् II, खण्ड 3, उपखंड (ii) में प्रकाधित की र्ई थी, द्वारा जम्मू और कश्मीर राज्य के जम्मू धजले में दिल्ली लुधियाना अमृतसर कटरा एक्सप्रेसव े (NH No. NE5) दकमी 3+800 से दकमी 7+300 तक, मौजूिा राष्ट्रीय राजमार् ग NH-144A , के धनमागण (चौड़ा करने/चार लेन का बनान,े आदि), अनरु क्षण, प्रबंिन और प्रचालन के धलए उस अधिसचू ना स े उपाबद्ध अनुसूची में धवधनर्िष्टग भूधम का अजगन करन े के अपने आिय की घोषणा की थी; और उक्त अधिसूचना का सार उक्त अधिधनयम की िारा 3क की उपिारा (3) के अिीन तारीख "दिनाकं 25 अप्रलै , 2024 और 03 अर्स्त, 2024" को "डले ी एक्सले धसयर" और "िधै नक सवरे ा" िोनों म ें 6040GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्रकाधित दकया र्या था ; और आक्षेप प्राप्त हुए थे और सक्षम प्राधिकारी ने उन पर धवचार कर धलया ह ै और आक्षेपों को अननुज्ञात कर दिया ह ै ; और सक्षम प्राधिकारी न े उक्त अधिधनयम की िारा 3घ की उपिारा (1) के अनुसरण में, केन्द्रीय सरकार को अपनी ररपोटग िे िी ह ै ; अतः अब, केन्द्रीय सरकार, सक्षम प्राधिकारी की उक्त ररपोटग प्राप्त हो जाने पर और उक्त अधिधनयम की िारा 3घ की उपिारा (1) द्वारा प्रित्त िधक्तयों का प्रयोर् करते हुए, यह घोषणा करती ह ै दक उक्त अनुसूची म ें धवधनर्िगष्ट भूधम का पूवोक्त प्रयोजन के धलए अजगन दकया जाना चाधहए ; और अब, केन्द्रीय सरकार, उक्त अधिधनयम की िारा 3घ की उपिारा (2) के अनसु रण में यह घोषणा करती ह ै दक इस अधिसूचना के राजपत्र में प्रकािन पर, उक्त अनुसूची में धवधनर्िगष्ट भूधम सभी धवल्लंर्मों से मुक्त होकर आत्यधन्द्तक रूप स े केन्द्रीय सरकार में NHAI/PIU/Jammu/DPR-Satwari/0001/3D] अभय िैन, जनििे क MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 19th September, 2024 S.O. 4033(E).— Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways, S.O. 1724(E) Dated 16, April 2024 and S.O. 2889(E) Dated 22 July, 2024, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intension to acquire the land specified in the Schedule annexed to the said notification for building (widening/four-laning, etc.), maintenance, management and operation of Delhi Ludhiana Amritsar Katra Expressway (NH No. NE5) from Km 3+800 to Km 7+300 along the existing NH-144A in the district JAMMU in the UT of Jammu and Kashmir. And whereas the substance of the said notification has been published in "Daily Excelsior" and "Dainik Savera" dated 25 April, 2024 and 03 August, 2024; under sub-section (3) of section 3A of the said Act; And whereas objections have been received and the same have been considered and disallowed by the competent Authority; And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
